“EASYWAY 10 YEARS OF PARTY IN A CUP” PROMOTION
TERMS AND CONDITIONS
1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of NSW, ACT, VIC, QLD and WA. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
3. Employees (and their immediate families) of the Promoter, participating EasyWay outlets and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences 01/12/2011 and closes last mail received on 31/12/2011, once stocks of scratch cards run out, whichever is first to occur (“Promotional Period”).
5. To be eligible to enter and receive a scratch card, whilst stocks of scratch cards last,, individuals must, during the Promotional Period, purchase any two (2) drinks (excluding bottled water and fresh juice) from any participating EasyWay outlet in NSW, ACT, VIC, QLD or WA. If the entrant does not receive a scratch card at point of purchase it is their responsibility to request one.
6. Entrants must then scratch their card to reveal whether or not they have won an instant prize. To claim a prize (excluding a major prize), entrants must present their winning card to a member of staff at the same participating EasyWay outlet at which they received the card during the Promotional Period. To claim a major prize, entrants must write their full name, address, daytime contact number, home phone number, and email address (optional) on the back of their winning card, and send it to “EasyWay 10 Years Of Party In A Cup Promotion”, C1, 200 Coward Street, Mascot NSW 2020 so that it is received by last mail on 31/12/2011. The Promoter recommends that winners use registered post; however, this is not a condition of claiming a prize and the cost to do so will be the responsibility of the winner.
7. Non-winners who have a “try again next time” message on their card can enter the 2nd chance draw for any unclaimed major prizes by writing their full name, address, daytime contact number, home phone number, and email address (optional) on the back of their card and sending their details and

original card to “EasyWay 10 Years Of Party In A Cup Promotion”, PO Box 606 Mascot NSW 2020 so that it is received by last mail on 31/12/2011.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant‟s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Multiple entries permitted, however only one (1) scratch card permitted per transaction (except where expressly permitted otherwise).
10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
11. Entries for the 2nd chance draw for any unclaimed prizes and all claims for instant win prizes must be received by last mail on 31/12/2011. The 2nd chance draw for any unclaimed major prizes will take place at EasyWay Franchising, C1, 200 Coward Street Mascot NSW 2020 on 13/01/2012 at 12pm AEDST.
12. Instant winners will be notified immediately in writing via their card and 2nd chance draw winners will be notified in writing via mail or email within two (2) business days of the draw. The names of major prize winners will be published in The Australian on 20/01/2012.
13. The Promoter‟s decision is final and no correspondence will be entered into.
14. Instant win major prizes:
(a) 1 x 1 Year of EasyWay drinks valued at $1,658.60. Prize will be awarded in the form of a voucher that entitles the winner to redeem one (1) specific EasyWay drink per day for 365 days. Each day will correspond to a specific drink option, to be determined by the Promoter in its absolute discretion.
(b) 5 x Apple iPad 2 16GB Wi-Fi valued at $579.
(c) 1 x return economy airfares to Taiwan for two (2) people valued at up to $2,000 depending on date and point of departure. Prize consists of return economy airfares from Sydney, NSW to Taiwan only. Flight departs from Sydney airport only. Winner will be responsible for their own travel to Sydney airport. 15. Instant win minor prizes:

16. In addition to the above, there will also be a “2nd chance” message printed on 2,625 selected scratch cards. Entrants who scratch this message on their scratch card will be entitled to redeem the card for a second scratch card.
17. During the entire duration of the flight prize, a nominated parent/guardian must accompany any person under 18 years of age. Frequent flyer points will not form part of the flights prize. Flights prize is subject to the standard terms and conditions of individual prize and service providers.
18. Any ancillary costs associated with redeeming any voucher are not included. Any unused balance of any voucher will not be awarded as cash. Redemption of any voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
19. If the winner of any major prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner‟s behalf.
20. If for any reason a winner does not redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
21. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
22. Total prize pool value is up to $53,666.10. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

23. A draw for any second chance draw prizes that are won but unclaimed may take place on 13/04/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing within two (2) business days of the draw and their names will be published in The Australian on 20/04/2012.
24. „Apple‟ and „iPad‟ are trademarks of Apple Inc. registered in the U.S and other countries. Apple Inc. is not a participant in or sponsor of this promotion.
25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
27. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 50,000 instant win scratch cards printed for this promotion.
28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter‟s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize

claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
30. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
31. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
