Entry into the Channel [V] “THE CHANGE-UP” competition (the “Competition”) is open to all residents of Australia aged 18 or over. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these Terms and Conditions. 2. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars. 9. All ancillary costs incurred in taking and using the Major Prize (including but not limited to transport, spending money, food and taxes) are the sole responsibility of the Major Prize winner and guests, unless specifically stated as included as a part of the Major Prize. 10. It is a condition of accepting the Prizes that the winners must comply with any conditions of use of the Prize and the Prize supplier’s requirements and/or reasonable directions from the Promoter. 11. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other Prizes. Any attempt to resell or auction all of any part of the Major Prize will result in immediate cancellation of the Major Prize and no substitute will be offered under any circumstances. Only one Prize per person will be awarded. JUDGING AND AWARD OF PRIZE 13. The Competition will be judged on the basis of originality and creativity at Channel [V] and MAX, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Friday 27 January 2012 at 10:00am (AEDT). Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via phone or email on Friday 27 January 2012 and their names published on the Channel [V] websites from Monday 30 January 2012. The Prize must be claimed 7 days of the publication of the Prize winners’ names. 14. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize. ONLINE SKILL AGE 15. The Major Prize winner and the guest must be 18 years of age or over. TRAVEL 16. The Major Prize must be booked by 31 March 2012 and travel must commence by 30 September 2012. A minimum of one month’s notice must be given to book the travel. If the Major Prize is not used within these dates, the Major Prize is forfeited in whole and no substitute prizing or cash will be offered under any circumstances. Flights and accommodation is subject to availability at time of booking; the Prize supplier reserves the right to substitute accommodation and flights with alternative prize of the same value at its discretion. 17. If the Major Prize winner is from Tasmania, the ACT or NT, all applicable connecting flights and transfer to the nearest flight departure capital city (set out in clause 7) will be the sole responsibility of the Major Prize winner and guest, including all costs and arrangements. 18. The Major Prize winner and guest must travel at the same time and depart from the same capital city and are responsible for transport from their respective residence to the airport at their nearest capital city for the flights 19. Travel insurance is advisable for the Major Prize winner and his/her guest, though all such arrangements are the sole responsibility of the Major Prize winner and his/her guest. 20. It is the sole responsibility of the Major Prize winner and guests to ensure that their personal travel documentation is valid and check with all government travel advisory and immigration authorities regarding travel requirements and eligibility. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements are the sole responsibility of the Major Prize winner and his/her guest. 21. Airfare tickets are available on the regular scheduled services of each airline. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline. Flights may not be direct flights to the final destination. 22. A credit card imprint or cash deposit may be required from the Major Prize winner at check in to the hotel for any incidental charges. Once accommodation vouchers are issued they are non-changeable. 23. The Major Prize winner is advised that tax implications may arise as a result of accepting the Major Prize and they should seek independent financial advice prior to acceptance of their prize. 24. The Major Prize winner will accept the Major Prize at his/her sole risk. With the exception of liability which cannot be excluded by law, the Promoter and the prize provider shall not be liable for any loss, damage or costs of any kind suffered (including but not limited to indirect or consequential loss) or for any personal injury, sickness or suffered or sustained by the Major Prize winner or his/her guest as a result of taking the Major Prize. As a condition of accepting the Major Prize, the Major Prize winner and his/her guest agree to release the Promoter and the prize provider from all liabilities, loss or damage of any kind arising out of or in connection with the acceptance and participation in the Major Prize. 25. It is a condition of accepting the Major Prize that the Major Prize winner and his/her guest may be required to sign a deed of acceptance and release in a form determined by the Promoter in its absolute discretion. 26. The Major Prize winner and his/her guest are advised to consult their healthcare professional ONLINE SKILL regarding recommended immunisations and/or health checks prior to travelling and to check for travel warnings and any perceived hazards with appropriate authorities, including www.dfat.gov.au. 27. The Promoter and the associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the Major Prize winner and guest to first check with all government travel advisory information regarding the safety and situation of the destination of their chosen destination/event. 28. The Promoter is not responsible for any cancellation, delay or rescheduling of transport and any costs incurred as a result (including, without limitation, any accommodation costs will be the sole responsibility of the Major Prize winner). 29. The Promoter reserves the right to refuse to allow the Major Prize winner or one or more of his/her guests to take part in any or all aspects of the Major Prize, if the Promoter determines, in its absolute discretion, that a Major Prize winner or one or more of his/ her guests are not in the mental or physical condition necessary to be able safely to participate in the Major Prize. 30. It is a condition of accepting the Major Prize that the Major Prize winner complies with any prevailing terms and conditions of the Prize supplier, as notified by the Prize supplier to the Major Prize winner before any booking is made. GENERAL 31. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter.
