Entry into the Channel [V] “Laneway Festival VIP” competition (the “Competition”) is open to all residents of Australia aged 18 years and over. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions. 2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter. 3. Competition begins at 9.00am (AEDT) on Monday 9th January 2012 and closes at 11.59pm (AEDT) on Sunday 22nd January 2012 (the “Competition Period”). 4. To enter the Competition and be eligible to win, entrants must: (a) be aged 18 years and over; (b) register for membership online at www.vmusic.com.au or www.maxtv.com.au ; (c) complete the online entry form and indicate which Laneway Festival event they would like to win tickets to from the list in clause 7 below; and (d) in 25 words or less answer the following question: “Which artist appearing at Laneway would you most like to chat with in the VIP bar and why? (the “Competition Question”). 5. All entries must include the requested information, including (not limited to) entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth. All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, includes (but is not limited to) any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrant’s responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period. 6. Only one entry per person per day is permitted during the Competition Period, however, the answer to the Competition Question in each entry by the same entrant must be unique and original. In the sole discretion of the Promoter, if the Promoter reasonably believes that an entrant has infringed the intellectual property rights of any third party, that entrant will be disqualified without notice. There are ten (10) prizes in total, consisting of five (5) major prizes and five (5) minor prizes: a) Each major prizes consist of a double VIP pass to ONE of the Laneway Festival events listed below, (as chosen by the entrant), valued at $400 (“Major Prize”); b) Each minor prize consists of a double General Admission pass to ONE of the Laneway Festival events listed below, valued at $280 (“Minor Prize”). ONLINE SKILL Date Event Saturday 28th January 2012 Brisbane Laneway Festival Saturday 4th February 2012 Melbourne Laneway Festival Sunday 5th February 2012 Sydney Laneway Festival Friday 10th February 2012 Adelaide Laneway Festival Saturday 11th February 2012 Perth Laneway Festival Each concert is referred to as an “Event”. The Major Prizes and the Minor Prizes will together be referred to as “Prizes”. 8. The total maximum Prize pool value is up to $3400. The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars. 9. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes. 10. The Prize must be used on the dates and at the venues specified in clause 7. All ancillary costs and expenses incurred in taking and using the Prizes (including but not limited to, transfers, spending money, food and travel insurance) are the sole responsibility of the Prize winners and guests. If a Prize winner cannot attend the Event, the Promoter may, at its sole discretion, award the Prize to the next best entry. 11. Entrants are advised that the use of the Prizes may be subject to prevailing terms and conditions of the venues, prize suppliers and/or event organisers. It is a condition of accepting the Prizes that the Prize winners and guests comply with all such terms and conditions and it is the Prize winners’ responsibility to first check the tickets and with the venues and/or event organisers regarding any such applicable terms and conditions before use. The Promoter takes no responsibility for any cancellations, postponements or any other changes to the Events and will not offer a substitute prize under any circumstances. 12. It is a condition of accepting the Prize that the Prize winners and their guests may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 13. The Promoter reserves the right to refuse to allow a Prize winner or his or her guest to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Prize. JUDGING AND AWARD OF PRIZE 14. The Competition will be judged on the basis of creativity at Channel [V], Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Monday 23rd January 2012 at 12.15pm (AEDT). Chance plays no part in the selection of the Prize winners. The Prize winner will be notified via email or phone on Monday 23rd January 2012 and their names published on the Channel [V] website from Tuesday 24th January 2012. The Prizes must be claimed within 3 days of the publication of the Prize winners’ names. ONLINE SKILL 15. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize. AGE 16. All Prize winners (and the guests of the Prize winners at the Events) must be 18 years or over. GENERAL 17. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof, that Prize winner will forfeit the Prize in whole and no substitute will be offered. 18. By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights, including copyright in their entry. Each entrant indemnifies the Promoter for any costs or loss incurred by the Promoter in the event that this warranty is false. 19. No responsibility will be taken by the Promoter, Channel [V]/MAX, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes. 20. The Promoter reserves the right, in its absolute discretion, to disqualify: a) any entry which, in the opinion of the Promoter, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; or b) any individual who tampers with the entry process, submits an entry that is not in accordance with these terms and conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter. 21. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel or vary the Competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion): a) a Prize winner does not satisfy the Competition entry requirements; or b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control. 22. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not: a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or b) be required to conduct the Competition at any other time. 23. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates. ONLINE SKILL 24. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into. 25. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition. 26. The Promoter collects entrants’ personal information for the purpose of conducting and promoting the Competition (including, but not limited to, determining and notifying winners).
