Terms and Conditions for CatchOfTheDay.com.au Summer Tennis Competition

1 Definitions

1.1 AEDT means Australian Eastern Daylight Time.
1.2 Daily Prize means Prince Ozone Seven Tennis Racquet valued at $249.00.
1.3 Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
1.4 Main Prize means Sony Bravia 40” E4500 Full HD LCD TV valued at $999.00.
1.5 Promoter means CatchOfTheDay.com.au Pty Ltd (ABN 22 149 779 939) of 64-70 Cochranes Road, Moorabbin, Victoria
1.6 Promotional Period means the period starting on 16 January 2012 at 11:00am AEDT and ending on 29 January 2012 at 11:59pm AEDT.

2 Who May Enter

2.1 Entry is only open to Australian residents aged eighteen (18) years or over who hold a current valid Australian driver’s licence.
2.2 Employees and their Immediate Families of the Promoter (or any related entity of the Promoter) as well as agencies associated with this promotion are ineligible to enter.

3 Requirements for Entrants

3.1 Participation in this promotion is deemed acceptance of these Terms and Conditions.
3.2 It is compulsory for entrants to provide their full name and email address to enter the promotion as the winner will be notified by email.

4 Validity

4.1 To enter, entrants must, during the Promotional Period submit the fully completed entry form on the CatchOfTheDay.com.au Facebook Application.
4.2 Only one (1) entry permitted per person.
4.3 Incomplete entries will be deemed invalid.
4.4 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s sole and unfettered discretion.

5 The Prize

5.1 The prizes for the CatchOfTheDay.com.au Sony Bravia 40” Giveway are the Main Prize and 14 Daily Prizes.
5.2 Total prize value for this competition is up to AUD$4,485.00.
5.3 The prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
5.4 If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

6 Details of Draw

6.1 The draw for the Main Prize will take place at the CatchOfTheDay.com.au Braeside office located at 198 Boundary Road, Braeside, Victoria on 30 January 2012 at 2:00pm AEDT. The winner of the Main Prize will be drawn at this time.
6.2 Each Daily Prize will be drawn at the CatchOfTheDay.com.au Braeside office located at 198 Boundary Road, Braeside, Victoria, at 2pm daily starting on 17 January 2012, during the Promotion Period where the winner of each Daily Prize will be drawn.
6.3 The winners of the Daily Prizes will be announced daily at 3pm AEDT on the Catchoftheday.com.au:
(a) website: www.catchoftheday.com.au;
(b) Twitter feed; and

6.4 The winner of the Main Prize will be announced on 30 January 2012 at 3pm AEDT on the Catchoftheday.com.au:
(a) website: www.catchoftheday.com.au;
(b) Twitter feed; and

6.5 All winners of the Daily Prizes and the Main Prize must sign any release form(s) as may be required by the Promoter (and its associated agencies and companies), and/or any other third party directly or indirectly involved in and with the prize and refusal to sign such form(s) shall result in the immediate forfeiture of the prize and that person shall have no claim, action or recourse at law or otherwise, against the Promoter in respect of the forfeiture.
6.6 A draw for any prize (Daily Prize or the Main Prize), if unclaimed, will take place at the CatchOfTheDay.com.au Braeside office located at 198 Boundary Road, Braeside, Victoria four (4) months following the initial draw for the given prize at 10:00am AEDT and allocated to a new winner. The winner will be notified in the same manner as 6.3.

7 Method of Claiming Prize

7.1 The winner is not required to be on-site at the draw. Once a winner is announced of the prizes, the Promoter will contact that winner to make arrangements for the delivery of the prize.
7.2 If for any reason the winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.

8 Database

8.1 All entries will be entered into a database and the Promoter may use entrants’ names and addresses for future marketing and promotional purposes unless notified otherwise in writing by the entrant.
8.2 Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
8.3 Subject to clause 8.4, the Promoter will classify all entries as confidential and will not disclose any entrant’s details to any other parties, and by entering the competition the entrants accept to receive email communications from the Promoter until the entrant opts out to receive the email communications from the Promoter.
8.4 The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.
8.5 All entries become the property of the Promoter.
 
9 General

9.1 Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9.2 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
(a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
9.3 The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
9.4 The Promoter reserves the right to alter or amend these Terms and Conditions, and conditions of operation of the Promotion, subject to the approval of the gaming authorities in each State or Territory, where required.
9.5 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
© any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by the winner or any entrant; or
(f) use of the prize.
