TERMS AND CONDITIONS By entering ‘Herald Sun Mattise VIP Experience Promotion’, you are agreeing to the following terms and conditions: 1. STANDARD TERMS 1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry. 2. WHO CAN ENTER 2.1 Subject to clauses 2.2 entry is open to residents of Victoria only. 2.2 Directors, management, employees and their immediate families of The Herald and Weekly Times Pty Ltd, and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. 3. HOW TO ENTER 3.1 The competition commences on Saturday January 21, 2012 at 00:01 (AEDT) and concludes on Monday January 23, 2012 at 23:59 (AEDT) (‘the Competition Period’). 3.2 To enter the competition, readers need to SMS their name, address and daytime telephone number to the number as it appears in the Herald Sun. 1971 9700 3.3 Each SMS entry will be charged at a premium rate, namely $0.55 (including GST), which covers the entry and reply message. 3.4 The SMS entry mechanic is only open to readers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. For SMS help call 1300 131 276. 3.5 The time of entry will, in each case, be the time that the entry is received by Salmat IDR. 3.6 The Promoters, their agents, affiliates or representatives will not be liable for any late, lost or misdirected entries. 3.7 Entrants (including winners) in the competition may enter as many times as they like, however only one prize per person will be awarded. SMS entries via internet or computer generation are invalid and will not be accepted. 4. HOW TO WIN 4.1 Each entrant who has entered the competition over the Competition Period and registered all details in accordance with clauses 2 and 3 will be entered into the prize draw. The first valid entry drawn at random from the entire pool of entrants who entered during the competition period will be the major prize winner. The draw will take place at Salmat IDR, Level 2, 116 Miller Street, North Sydney, NSW, 2060 on January 24, 2012 at 10.00am (AEDT). 4.2 The winner will be notified by phone call within 2 days of the draw. The winners name will be published in the Herald Sun’s Public Notices Section on Saturday 28 January, 2012. 4.4 The Promoters’ decision in relation to any aspects of the competition is final and the Promoters will not enter into any correspondence regarding the result. 4.5 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoters in their absolute discretion. 4.6 Entries not completed in accordance with these terms and conditions will not be considered valid and will not be included in the draw. Indecipherable or incomplete entries will be deemed invalid. 4.7 The Promoters reserve the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoters. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 4.8 The Promoters reserve the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoters, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the Promoters, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoters. The Promoters reserve the right to disqualify a winner if the Promoters become aware that the winner and/or the winner’s entry is of a type described in this clause. 4.9 If the prize is unclaimed, an unclaimed prize draw will be held at 3.00pm (ADST) on April 24, 2012 at Salmat IDR, Level 2, 116 Miller Street, North Sydney, NSW, 2060, subject to any written directions given by the relevant state permit regulatory authorities. The unclaimed prize draw winner(s) will be notified in writing and their details will be published in the public notices section of the Herald Sun on March 22, 2012. 5. PRIZE 5.1 One (1) prize winner will receive: • A VIP Exhibition experience to Mattise: Drawing Life Exhibition including: - Two entry tickets to the Mattise: Drawing Life Exhibition which can be used for exhibition or UpLate. - Private curatorial tour of the exhibition (subject to QAG curator availability) - Two Mattise: Drawing Life merchandise packs • Dinner or lunch at the GOMA Restaurant. Dinner valid for Friday night only. • Return Virgin Australia economy airfares from Melbourne to Brisbane for two adults • Two nights’ accommodation at the Hilton Brisbane for two adults including breakfast daily at the Hilton Brisbane’s Vintage Bar + Grill. • Transfers from Brisbane airport to the Hilton Brisbane. Total value of prize up to $2500 5.2 Prize values are based on the recommended retail prices at the time of printing and may vary depending at the time of redemption. The Promoters accept no responsibility for changes in prize value between now and the ultimate prize redemption date. 5.3 The winner must travel between 27 January to 2 March 2012. 5.4 All elements of the prize are subject to availability. 5.5 Once booked, any changes made to the booking may incur a fee at the cost of the winner. 5.6 All components of the prize must be taken together. Travel Insurance is not included. Travel Prize does not include meals, spending money or transport to and from departure points. All other ancillary and travel costs are the winner’s responsibility. All additional costs incurred whereby the prize winner wishes to make variations to the travel are the winner’s responsibility and must be booked separately by the winner. All travel variations are subject to approval by the prize provider upon booking. Travel variations include, but are not limited to extension of travel duration, travellers outside of the age restriction and additional travellers. 5.7 Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and nonredeemable for other goods or services and cannot be taken as cash. 5.8 If the winner is under the age of 18 years the prize may be awarded, at the absolute discretion of the promoter, to their parent or legal guardian. In the event that the winner is under 18 years of age, the winner must be accompanied by an adult aged 21 years and over. 5.9 The major prize winner and their guest must travel together on the same flight as each other to their destination and must share the same itinerary. 5.10 The major prize winner and their guests will not accrue any frequent flyer points from taking this prize. 5.11 The major prize winner and their guests will be subject to, and must abide by the terms and conditions the airline and hotel. Any breaches of such terms and conditions may affect the ability to receive benefits of the prize. In that case, such benefits will be forfeited. 5.12 If for any reason a prize or part of a prize becomes unavailable the Promoters will endeavour to provide a substitute prize of equal value. The replacement prize is at the discretion of the promoter and negotiation will not be entered into. 5.13 In participating in the prizes, the winner agrees to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The winner grants the Promoters a perpetual and nonexclusive licence to use such footage and photographs in all media worldwide and the winner (and their guest) will not be entitled to any fee for such use. 5.14 The winner agrees that they will not sell or otherwise provide their story and/or photographs to any media or other organisation. 5.15 The winner must, on request by the Promoters, be able to provide evidence which, to the reasonable satisfaction of the Promoters, demonstrates that the winner is an eligible entrant (as per clauses 2.1, 2.2 and 2.3) and has complied with these terms and conditions. 6. NO LIABILITY 6.1 The Promoters shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. Neither are the Promoters responsible for any incorrect or inaccurate information, either caused by the entrant or any of the equipment or programming associated with, or utilised in this competition, or for any technical error, or combination thereof that may occur in the course of the administration of this competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft or destruction or unauthorised access to, or alteration of, entries. 6.2 If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoters which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoters reserve the right, in their sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation. 6.3 Except for any liability that cannot be excluded by law, the Promoters (including its officers, employees and agents) exclude all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following: a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); b) any theft, unauthorised access or third party interference; c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; d) any variation in prize value to that stated in these conditions of entry; e) any tax liability incurred by a winner or entrant; f) the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or g) participation in the prize. 6.4 The Promoters reserve the right, in their sole discretion, to disqualify any individual who the Promoters have reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoters’ legal rights to recover damages or other compensation from such an offender are reserved. 6.5 The prize winner and their companion acknowledge that he or she participates in the prize at his or her own risk. If a winning entrant becomes aware of any medical condition or impairment that will be detrimental to their health if they participate in the prize they must withdraw from the prize. The Promoters reserve the right to deem that a winning entrants or their companion is not sufficiently healthy or fit to participate in the prize. 7. PRIVACY CONSENT 7.1 Entry details remain the property of the Promoters, and their related entities and are collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners).
