Red M&M – “Cleo Bachelor” Promotion
Terms and Conditions of Entry


1. Instructions on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Entry is open to residents of Australia aged 18 years or over only. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 3. Only one entry per person will be permitted. 4. The promotion commences on 16th January 2012 and closes 11:59pm AEDST on 18th March 2012 (Promotion Period). 5. To enter, individuals must visit www.cleo.com.au/wildcard, follow the prompts to the promotional entry page and provide all requested details including their name, address, daytime telephone number and email address and an answer to the promotional question “Tell us why you think RED should be the Cleo Bachelor of the Year in 2012!” in 25 words or less, and submit the fully completed entry form during the Promotion Period. 6. The judging will take place at the Promoter’s premises and will begin on 19th March 2012. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. 7. The winner will be notified by phone and mail using contact details provided in their entry. Notification will take place by 22nd March 2012. 8. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit, and originality of the answer provided to the promotional question. 9. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into. 10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 12. The best valid entry, as determined by the judges, will be deemed the winner and will receive a trip for two (2) adults valued at up to $9,740 (depending on point of departure). The prize consists of the following: o 1 night twin share accommodation at a minimum three star hotel in Sydney, NSW valued at up to $1,200; and o 2 x Tickets to the Cleo Bachelor Event in Sydney valued at $2,500. If the winner is from VIC, SA, TAS, WA, QLD, NT or ACT, the winner will also receive 2 x return economy class airfares from the winner’s nearest capital city in Australia to Sydney valued up to $6,040 (depending on point of departure). 13. In the event the winners nearest capital city is Sydney, the airfares component of the prize will not be included and the airfare component of the prize will not be redeemable for cash. Prize does not include transport to and from departure point, spending money, meals, transfers, items of a personal nature, in-room charges, incidentals and any ancillary costs associated with redeeming the prize. These are the responsibility of the winner. 14. Total prize pool valued at up to $9,740 depending on point of departure. 15. Prize must be taken to coincide with the Cleo Bachelor Event and is subject to booking and flight availability. Prize must be taken as a package and must be redeemed in full by 31st May 2012. The Promoter will notify the winner of the exact travel time at winner notification. 16. Redemption of prize is subject to booking and availability at time of booking. 17. The prize is valid for two persons aged 18 years and over only. 18. The winner (and his/her companion) must depart from and return to the same departure point and travel together. 19. Itinerary to be determined by the Promoter in its absolute discretion. 20. Frequent flyer points will not form part of the prize. 21. Prize is subject to the standard terms and conditions of individual prize and service providers. 22. It is a condition of accepting the prize that the winner and their travel companion present a valid credit card at the time of redemption of the prize in order to cover the costs of any incidentals and costs incurred throughout their stay. 23. Where any part of the prize is awarded in the form of a voucher/letter/ticket/pass, the Promoter shall not be liable for any voucher/letter/ticket/pass that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of voucher/letters/tickets/passes is subject to terms and conditions stipulated on voucher/letter/ticket/pass and to the standard business guidelines of the relevant service provider/ accommodation venue. Any ancillary costs associated with redeeming any voucher or gift card are not included in the prize. Any unused balance of any voucher or gift card will not be awarded as cash. 24. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to either provide an alternative prize to the same value as the original prize or to cancel, terminate, modify or suspend the promotion, as appropriate. 25. Entries not completed in accordance with the Terms and Conditions or received after the closing date will not be considered. Indecipherable or incomplete entries will be deemed invalid. 26. If for any reason the winner does not redeem the prize, (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash. 27. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification. 28. The Cleo Bachelor Event tickets are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize. 29. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. 30. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. 32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 33. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) if the Cleo Bachelor Event is cancelled and/or rescheduled/postponed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; (g) redemption of a prize; and/or (h) participation in this promotion. 34. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate. 35. As a condition of accepting the prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 36. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. 37. By entering the competition, the entrant consents to receipt of any email and/or communication regarding the competition, and other emails/ communications which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in. 38. Further to clause 36, By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. A request to opt out, access, update or correct any information should be directed to the Promoter. 39.
