All designs must be received by 11.59pm AEDST. “FACE FACTS TEES” PROMOTION TERMS AND CONDITIONS Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. The Promoter of this promotion is MediaBrands Australia Pty Ltd (ABN 19 002 966 001) of 100 Chalmers Street, Surry Hills, NSW 2010. Entry is only open to residents of Australia between the ages of 15 years old and 21 years old at the date of entry. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Entry in this promotion is conditional on providing this information. The information provided by entrants will be used by the Promoter for the purposes of conducting this promotion. Entrants consent to the storage of their personal information on the databases of the Promoter and its related bodies corporate. VOTING ROUND Entries will be divided into the following age categories: ‘15 – 18 years old’ and ‘19 – 21 years old’ (Categories). Entries validated by the Promoter in accordance with clause 10, will be displayed in an online gallery on the website www.facefactstees.com.au for public viewing and voting during the Promotional Period. By entering this promotion, entrants consent to the Promoter publishing their entry on the website and using the entry for related press, public relations or television promotions. Multiple votes are permitted, subject to the following: (a) other website users will be permitted a maximum of one (1) vote per entry; and (b) each vote must be submitted separately and in accordance with voting requirements and these Terms and Conditions. Votes will be automatically calculated through the website. The ten (10) valid entries from each Category which receive the highest total number of votes for that Category during the Promotional Period will proceed to the final judging round (Finalists). In the event of a tie, judges will individually judge each tied entry based on its depiction or support of an 'anti-drugs' theme. FINAL JUDGING ROUND Each Finalist entry will be individually judged by the judges based its depiction or support of an 'anti-drugs' theme. The design must either incorporate the ‘Ecstasy. Face Facts’ logo or be placed outside the design in the bottom right hand corner. The judges will consist of a panel of representatives from the Promoter and the Commonwealth Department of Health and Ageing. Judging of the Finalist entries will occur between 01/03/2012 and 05/03/2012. The judges will select a winner and a runner-up in each Category who will be eligible to receive the prizes described below. The winners and runners-up in each category will be notified by telephone within two (2) working days of the end of the judging period. All reasonable steps to notify winners of the results of the judging will be taken by the Promoter. PRIZES The winner and the runner-up in the 15 – 18 Years Old Category will be eligible to receive: Winner: The best valid Finalist entry in the 15 – 18 years old Category, as determined by the judges, will win $2,000 and a $250 Moshtix voucher. Runner-Up: The next best Finalist entry in the 15 – 18 years old Category, as determined by the judges, will win $500 and a $250 Moshtix voucher. The winner and runner-up in the 19 – 21 Years Old Category will be eligible to receive: Winner: The best valid Finalist entry in the 19 – 21 years old Category, as determined by the judges, will win $2,000 and two (2)Creamfields 2012 tickets. Runner-Up: The next best Finalist entry in the 19 – 21 years old Category, as determined by the judges, will win $500 and two (2) Creamfields 2012 tickets. Cash prizes will be awarded in the form of a cheque. Any ancillary costs associated with redeeming the Moshtix voucher are not included. Any unused balance of the Moshtix voucher will not be awarded as cash. Redemption of the Moshtix voucher is subject to any terms and conditions of the issuer including those specified on the Moshtix voucher. Creamfields2012 Tickets can be used at: Adelaide 27/04/12,Melbourne 28/04/2012; Sydney 29/04/2012; Perth 05/05/2012; Gold Coast 06/05/0212.The Promoter will award the Creamfields 2012 ticketsto a festival closest to a winner’s ordinary residential address (to be determined by the Promoter in its sole discretion). Transport to and from departure point and Creamfields 2012, spending money, meals, items of a personal nature and all other ancillary costs are not included in the Creamfields2012 ticket prizes. Creamfields2012 ticket prizes must be taken to coincide with the relevant Creamfields2012 or will be forfeited. The Creamfields2012 ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. By entering this promotion, entrants consent, to the Promoter printing their entry on t-shirts and giving them away at various festivals, with no compensation being provided to the entrants. GENERAL The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter or vote repeatedly is prohibited and will render all entries or votes submitted by that individual invalid. The Promoter reserves the right, at any time, to verify the validity of entries, votes, voters and entrants (including an individual’s identity, age and place of residence), to disqualify any individual who submits an entry or vote that is not in accordance with these Terms and Conditions or who tampers with the entry or voting process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right, at any time, to invalidate any entries or votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or entries or votes that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts. The Promoter’s and judges decisions are final and no correspondence will be entered into. Prizes, or any unused portion of prizes, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. If any prizes are unavailable, the Promoter, in its discretion, reserves the right to substitute the prizes with prizes to the equal value and/or specification, as appropriate. If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash, unless otherwise specified. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights. Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, contains imagery depicting drug use, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
