d) not have been published previously or have won a prize or an award in any other competition;

The Promoter may exclude any entry that does not meet these criteria.
7. Incomplete or indecipherable entries will be deemed invalid.
8. If there is a dispute as to the identity of an entrant, the Promoters reserve the right, in their sole discretion, to
determine the identity of the entrant.
9. Promotion commences 9:00am AEDT 11/02/2012 and closes at 11.59pm AEDT on 19/02/2012. Entries will be judged
by Dick Smith, 2 Davidson St, Chullora NSW 2190.
10. Between 9:00am AEDT and 5:00pm AEDT on 21/02/2012 Dick Smith will individually judge each entry based on it’s
literary and creative merit in response to the question posed by the Promoter.
11. The judges may select additional reserve entries that they determine to be the next best, and record them in order, in
the case an invalid entry or ineligible entrant is selected as the provisional winner.
12. The winners will be notified by email, and will be required to supply residential address.
13. This is a game of skill and chance plays no part in determining winners. Entrants will be required to submit in one
hundred and twenty (120) characters or less what they would be willing to do for a new PS Vita.
14. The Promoter’s decision is final and no correspondence will be entered into.
15. The 2 most creative valid entries as determined by the judges pursuant to clause 13 of these Terms and Conditions,
will win a PS Vita (WiFi version only).
16. If for any reason a winner does not redeem the Prize within 28 days of being notified by email, then the Prize will be
forfeited.
17. The promoter accepts no responsibility for the successful delivery of email notification.
18. Total Prize pool value is $698.
19. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash.
20. All entries submitted become the property of the Promoters. Entries will not be returned to any entrant. As a
condition of entering into this promotion, each entrant licenses the Promoters to use their entry in any media for an
unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each
entrant warrants to the Promoters that each entry submitted is an original literary work of the entrant that does not
infringe the rights of any third party. The entrant agrees to indemnify the Promoters against all costs and claims by third
parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe
their moral rights pursuant to the Copyright Act 1968 (Cth).
21. Entrants consent to the Promoters using the entrant's name, likeness, image and/or voice in the event they are a
winner (including photograph, film and/or recording of the same) in any media for an unlimited period without
remuneration for the purpose of promoting this competition (including any outcome), and promoting any products
manufactured, distributed and/or supplied by the Promoters.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to
any reason beyond the reasonable control of the Promoters, the Promoters reserve the right, in their sole discretion, to
the fullest extent permitted by law (a) to disqualify any entrant; or
(b) to modify, suspend, terminate or cancel the promotion, as appropriate.
23. The Promoter is not responsible for late or misdirected entries and takes no responsibility for any entries not correctly
lodged.
24.The Promoter and its related companies, employees and agencies shall not be liable for any loss, damage or personal
injury (including but not limited to indirect or consequential loss) suffered by an person arising directly or indirectly out of
or in connection with entering this promotion or claiming/winning any prize, except as required by law.
25. The Promoter is not responsible for the transmission or receipt of any incorrect information associated with entries,
either caused by user error or any equipment or programming malfunction associated with this competition.
26. Entry and continued participation in the Promotion is dependent on entrants following and acting in accordance with
the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php.
27. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants
understand that they are providing their information to the Promoter and not to Facebook. The information an entrant
provides will only be used for the purposes outlined in clause 29 of these Terms and Conditions. Any questions,
comments or complaints about this promotion must be directed to the Promoter and not to Facebook.
28. All entrants unconditionally and irrevocably release and discharge Facebook from any and all liability in relation to this
Promotion.
29. If you enter this competition, the Promoter will collect personal information about you so that you can participate in
the competition and the Promoter can administer the competition. Entry is conditional on providing this information.
When the entrant gives their consent by "opting in" you give your consent to receive marketing information, the Promoter
may use the information for promotional, marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning the entrant.
