Terms & Conditions: Continental Tyres Gift Card Promotion
Acceptance by you
1. The Continental Tyres Gift Card Promotion is provided by JAXQuickfit Franchising Systems Pty Ltd, Suite B110, 20 Lexington Drive, Norwest Business Park, Bella Vista NSW 2153, ABN 52 112 050 058 (“the Promoter”).
2. The benefiting party is Continental Tyres of Australia Pty Ltd, 2 Scholar Drive, Bundoora, VIC, 3083,
ABN 50 136 883 148
3. The Continental Tyres Gift Card Promotion will be advertised in participating JAXQuickfit stores, on the http://www.jaxquickfit.com.au/ website, JAXQuickfit catalogues and various media including radio, online and in print.
4. These Terms and Conditions apply to the promotion (including without limitation the information on how to claim your gift card). By participating in the promotion you acknowledge that you have read and understood, and agree to be bound by these Terms and Conditions. IF YOU DO NOT ACCEPT THESE CONDITIONS YOU MUST NOT REDEEM THE OFFER.
5. The Continental Tyres Gift Card Promotion commences 1 March 2012 at 08:00 Australian Eastern Daylight Savings Time (AEDT) and finishes on 30 April 2012 at 23:59 Australian Eastern Standard Time (AEST) (“Promotional Period”).
6. The participant will receive a $50 JAXQuickfit gift card, by redemption (see clause 7), through purchasing four (4) Continental tyres. Offer applies to the purchase of any four (4) Continental Passenger, SUV, 4x4, recreational or light commercial tyres from the participating JAXQuickfit stores between 1 March 2012 and 30 April 2012. Offer excludes 13” & 14” tyres. All four (4) tyres must be purchased on the same invoice (“The Offer”).
7. The JAXQuickfit gift card will be sent out via registered mail after registering details with the unique invoice number for redemption online at http://www.jaxquickfit.com.au/ .
8. Redemption of The Offer will be available from the website (see clause 7) up until 23:59 (AEST) on 31 May 2012, after that date it will no longer be able to redeem the gift card.
9. The Offer is not available to trade, fleet and JAXQuickfit account customers.
Gift Card Terms of use
10. Gift cards are issued by Edge Loyalty Systems ABN 16 006 716 730 on behalf of the promoter. Purchasing or using the gift card means you accept these conditions.
11. Gift cards are valid for 12 months from date of issue.
12. Gift cards can be used multiple times until the value on card has been expended, in this case to the value of $50. Once the amount has been expended it will no longer be valid for use.
13. Card may be used to purchase goods or services at retailers in Australia with "EFTPOS" facilities who accept the card, when the gift card has enough unused value to make the purchase. Some merchants may choose not to accept the gift card.
14. Gift cards will be activated prior to you receiving the card and cannot be redeemed for cash, reloaded, returned for a refund, have their balances consolidated to a new gift card, or be replaced after expiry and are not legal tender, account cards, credit or debit cards or securities.

15. Keep your gift card secure - anyone holding the gift card can use its value to make purchases. If your gift card is lost or stolen, or you suspect an unauthorized transaction, immediately report this by calling 1300 557 467. We may be able to stop gift card value being used, but require the card number, original balance and expiry date.
16. We may replace a faulty, lost or stolen gift card at our discretion. Any replacement gift card will have the same unused value (at the time of replacement) and expiry date. Apply by calling us on 1300 557 467. You must present the original receipt and reference number (located on the back of your gift card). Make a record of the reference number and keep separate from your receipt. Gift cards will be void if they are defaced, mutilated, altered or tampered with in any way. We may subject gift cards to verification and security checks in our absolute discretion.
17. If you have a query or complaint about the gift card, please contact the helpdesk on 1300 557 467. We are not liable for the availability, quality or fitness for purpose of any goods or services purchased with the gift card.
18. Any dispute about goods or services purchased with the gift card must be resolved with the supplier. Except for rights which cannot be excluded, any conditions or warranties implied or imposed by legislation or otherwise are excluded from these conditions of use. To the extent permitted by the law, our liability is limited to replacing faulty gift cards.
19. If you think there has been a mistake transaction on your gift card contact the store where the mistake was made.
20. We may cancel any gift card, or the gift card scheme, for any reason at any time without notice. If so we may either provide a refund or a replacement gift card of equivalent value unless we reasonably suspect fraud in relation to a gift card. The gift card remains our property.
Your personal information
21.As a result of you entering the promotion, we will collect certain personal information about you, such as your email address. This information will be used to:
i. send you news, information about our other promotions or products and/or general marketing material which we believe may be of interest to you;
ii. provide you with news, information and material in relation to the promotion;
iii. monitor who is participating the promotion;
iv. profile participants
We may share your personal information for any purpose incidental to your participation into and our operation of the promotion only unless otherwise stated.
22. By participating in the promotion, you are agreeing to receive further information from us delivered via email to the email address you use to participate in the promotion. If you wish to stop receiving this information, you may unsubscribe at any time using the unsubscribe facility included in each communication that we send you. We collect your information so that you can participate in the promotion. If you do not give us the information, you cannot participate. We may use this information for the purposes of the conduct of the promotion and the compilation of survey results and evidence. We may disclose this information to third parties who provide us with administrative services. This information will be stored at the office of the Promoter. You indemnify us
23.You release and agree to keep us indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by us, our directors, employees, agents and representatives arising out of your participation in the promotion or any claim by a third party arising from an act or omission by you.
Failure to comply and severability
24.We are not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.
