Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions. 2. The promoter is Red Rooster Foods Pty Ltd, 1 Whipple St, Balcatta, WA 6021 (ABN 51008754096). (Promoter). Eligibility 3. Entry is open to Australian residents over 18 years only (Eligible Entrants), excluding directors, management, employees (and their immediate families) of the Promoter and its related bodies corporate and registered travel companions of employees of the Promoter and its related bodies corporate. 4. The promotion commences at 10:00am (AEDT) on Monday 25th June 2012 and closes at 6.00pm (AEDT) on Tuesday 4th September 2012 (Promotion Period). Only entries that are received during that time will be eligible for entry. Competition entry 5. To enter, Eligible Entrants must, during the Promotion Period: 5.1 Be an official fan of Red Rooster Australia’s Facebook page by clicking the ‘like’ button on that page; (http://www.facebook.com/RedRoosterAU ) 5.2 Enter the competition on the appropriate Facebook page by: 5.2.1 providing their personal details including their First and Last Name, Email Address, Phone Number, and Post Code, note your Date of Birth, (optional), and 5.2.2 writing a message in 25 words or less to tell us (in the space marked on that page) which 3 mates you would bring on a Hawaiian holiday and why. 6. If the Promoter considers (in its absolute discretion) that any entry: 6.1 is incomplete, indecipherable, or illegible; or 6.2 is unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, misleading, deceptive, contain objectionable content or are otherwise inappropriate, then the Promoter may disqualify that entry and it will not be eligible to win. 7. There is a limit of one entry per person for the duration of the Promotion Period. 8. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any Eligible Entrant if the Promoter considers (in its absolute discretion) the entry process has been tampered with or a submitted entry is not in accordance with these terms and conditions. 9. The Promoter is not responsible for any lost, late or misdirected entries. 10. The Promoter reserves the right to request winners to provide proof of identity and/or proof of residency at the nominated prize delivery address in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 11. Any entry that is made on behalf of an Eligible Entrant by a third party will be invalid. Judging 12. The winners will be the entries judged by a panel of judges appointed by the Promoter to be the most creative and original answer from the pool of entries submitted during the Promotion Period. Entries will be judged at 111 Cecil st, Level 4, South Melbourne at 10:30am (AEST) Monday 10th of September 2012. 13. The competition is a game of skill and chance plays no part in determining the winner. 14. Winners will be notified by email by no later than 6:00pm (AEST) on Tuesday 11th of September, 2012. If any prize remains unclaimed by 6:00pm (AEST) on Tuesday 9th of October, 2012, another winner for each unclaimed prize will be judged by the panel of judges from the remaining pool of entries at 10.30am (AEST) on Monday 15th of October, 2012 and the winner will be contacted by email by 6.00pm (AEST) on the same day. 15. The judges' decision is final and the Promoter will not enter into correspondence regarding the result. 16. The winners name will be published on Red Rooster Facebook wall AFTER they have been contacted and informed of their winning entry. 17. It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize. The Prizes 18. There are 2 prize winners. 19. Subject to these terms and conditions, each winner will receive: A trip supplied by Creative Holidays for a group of 4 persons (in total one of which persons includes the winner) travelling together, return economy class airfares ex any major port in Australia being Sydney, Melbourne, Brisbane, Adelaide, Hobart or Perth (including domestic fares where required) to Hawaii, return hotel transfers in Hawaii, with 5 nights accommodation staying at a minimum 4-Star property in Waikiki (Honolulu), including breakfast, with each person having their own room, plus a Waikele Premium Factory Outlets shopping tour plus a Pearl Harbour Arizona Memorial & Punchbowl tour for four. 20. Each prize is valued at a maximum of AUD $10,000 (i.e. the total prize pool for all prizes is valued at a maximum of, $20,000.00 + GST) as at 30th May 2012. The Promoter accepts no responsibility for any variation in the value of the prizes. 21. Each group of 4 must travel together with a single booking to be made for the entire group once the winners’ details are provided. 22. The prizes cannot be transferred, exchanged or redeemed for cash or any other products or services, or any travel related products or services, and must be redeemed as stated above. No variations on airlines or hotels can be accepted. 23. Each winner must redeem their prize and booking for their trip by 31st December 2012 and the trip must be completed by no later than 31st March 2013. Failure to redeem the prize and complete the booking by the required date or to complete the trip by the required date as stipulated will result in full forfeiture of the prize. 24. The winner and their travelling companions are responsible for all other expenses including but not limited to spending money, meals, drinks, transfers, laundry charges, activities, incidentals, taxes, government surcharges, energy surcharges, gratuities, service charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. 25. The winner and each traveling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide, Hobart or Perth). 26. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure City and their current flight schedule. Frequent Flyer points are not available from any airline. 27. It is each traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. 28. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade. 29. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winners. 30. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 31. By accepting the prizes, the winners agree to participate in and co-operate as required with all reasonable media editorial requests by the Promoter relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize. 32. Prize values are based upon the recommended retail prices as at 30 May 2012 The Promoter accepts no responsibility for change in prize value between that date and the ultimate prize redemption date. 33. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize. 34. Prizes will be awarded to the person named in the relevant winning entry. However, in a dispute, the Prize will be awarded to the account holder of the entry mechanism used to submit their entry. 35. Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter. 36. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result. 37. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. 38. It is a condition of accepting the prize that the winner may be required to sign a legal release form determined by the promoter in its absolute discretion. 39. The prizes are strictly subject to availability with the prize booking unable to be made until the winners names are provided to Creative Holidays by the Promoter. Rooms are not pre booked with failure to notify winner details in a timely manner possibly resulting in rooms becoming unavailable. In the event that Creative Holidays are for reasons beyond its control unable to book the rooms then the Promoter (on behalf of Creative Holidays) reserve the right to offer an alternative prize at similar value or lower (with the difference in value not to be less than $3000), but not exceeding the prize value stipulated above, and not later than the redemption timelines stipulated in condition 23. 40. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion. 41. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties. 42. The exclusion of liability in condition 41 does not apply to limit or exclude liability to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that condition (in which case that liability is limited to the maximum extent allowable by law). 43. Entry and continued participation in the Promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php. 44. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. By entering this competition, each Eligible Entrant releases Facebook from any action or claim arising out of the competition. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. 45. The Promoter collects personal information about entrants for the purpose of running this competition. Entry details remain the property of the Promoter. Eligible Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available. 47. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration , security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under law. |
