Conditions of Entry
1. By entering this Promotion, Entrants agree to abide by these Conditions of Entry. The Promoter is Defected Pty. Ltd. (trading as The Defectors) ABN 22 140 475 798 of 3/145 William St, Darlinghurst, New South Wales, Telephone (02) 9993 0450 on behalf of 1$Day Limited, ACN 145 066 235, Level 27, 50 Bridge Street Sydney NSW 2000 Australia.
2. This Promotion is not sponsored, endorsed, administered by or associated with Facebook.
3. The Promotion commences as 10.01am AEST on 1 June 2012 and closes at 16.59pm AEST 24 August 2012 (Promotion Period).
4. Entry is open to any Australian resident aged 18 years or older (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the promotion and their related companies are ineligible to enter.
5. To enter the Promotion, Entrants must “Like” the 1$day Facebook page at https://www.facebook.com/1dollarday then accurately complete an online entry form on the 1$day Facebook page, guess how much money 1$day will raise by 25 August 2012, and submit it so that it is received during the Promotion Period (Entry).
6. Only one Entry via the Entry Form is permitted per Entrant. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promotion database. The Promoter is not responsible for any delay in, or failure of, transmission which causes an Entry not to be received within the Promotion Period.
7. The total Prize Pool is valued at AUD$500.00. There is only 1 (one) Prize = 1x $500 RedBalloon Voucher. The Prizes are not transferable or exchangeable. The entire Prize has been donated by RedBalloon (http://www.redballoon.com.au/).
8. The Winner will be selected as the closest guess to the real amount raised by 1$day from 1 January 2012 to 25 August 2012. The Judging will take place at 3/145 William St, Darlinghurst NSW 2010 on 30 August 2012.
9. Should there be more than one person with the closest guess, the person who submitted their answer first shall be selected as the Winner.
10. The Winner will be notified by telephone within two days of them being selected, will receive written confirmation within twenty-one days and their name will be published in The Australian newspaper on 6 September 2012. In their written confirmation, winners will be provided with details of how to claim their Prize and the date by which they must claim their Prize (Prize Claim Date). Winners may need to provide sufficient identification in order to claim their Prize.
11. If the Prize is unclaimed by the Prize Claim Date, subject to any directions from a regulatory authority, the Promoter may on 30 November 2012 and otherwise at the same time and location as the Judging, select an alternate winner, being the person with the second closest guess (or the person who submitted the correct answer second in time if paragraph 9 above applies) , in order to distribute the unclaimed Prize (Unclaimed Prize Selection). In the case of a winner, they will be notified by telephone within two days of the Unclaimed Prize Selection, receive written confirmation within twenty-one days and their names will be published in The Australian newspaper on 11 December 2012.
12. The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.
13. The Promoter is not liable for any loss, damage or personal injury suffered or sustained as a result of, in connection with, or arising out of the Promotion or taking the Prize.
14. If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
15. 1$Day Limited has authority to fundraise throughout Australia: New South Wales, the Australian Capitol Territory, South Australia, Western Australia, the Northern Territory, Tasmania, Victoria and Queensland. With our launch focus on Australia, we have not sought approvals to fundraise outside Australia.
16. The collection, use and disclosure of personal information in connection with the Promotion is governed by the Privacy Act 1988 (Cth). By entering the Promotion, Entrants agree and consent to the Promoter:
a. using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming the Prizes and any other matter connected to or incidental to the Promotion;
b. using the Entrant’s personal information for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including email and SMS, unless an Entrant otherwise withdraws their consent to the use of their information in this manner; and
c. using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and for any other purpose at the Promoter’s sole discretion.
