Terms & Conditions [/b]
1.   Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.   For the purposes of these Terms and Conditions, the following definitions apply:
a.   ‘Purchase’ means payment in full for the Participating Product during the Promotional Period to an Australian participating authorised Fisher & Paykel retail dealer. Purchase does not include: (i) rental payment plans with a term of less than 18 months; (ii) lay-buys or pre-orders; (iii) Commercial or business transactions involving the purchase of more than three (3) units total of Participating Products; (iv) purchases via eBay or similar online third party internet websites; (v) second hand products or (vi) purchases made in conjunction with any other offer.
b.   ‘Promotional Period’ refers to the period commencing 12.01am midnight AEST on 30/06/2012 and closes 11.59pm AEST on 31/08/2012.
c.   ‘Participating Product’ refers to the following Fisher & Paykel models:

Who is eligible to enter?
3.   Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, the Promoter’s associated companies, participating retailers and their agencies associated with this promotion are ineligible to enter. Entrants may enter this competition once only. This promotion is not open to trade (commercial) or wholesale customers.
4.   The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Identification considered suitable for verification is at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete or indecipherable entries will be deemed invalid.

How to enter
5.   To be eligible to enter, Purchase any Participating Product during the promotional period from an Australian participating authorised Fisher & Paykel dealer during the Promotional Period. Individuals must then go to www.fisherpaykelpromotions.com.au/escape and follow the links to the promotional entry page, input the requested details including the product serial number, their full name, email address, residential address and phone number, name and location of the Australian participating authorised Fisher & Paykel dealer. You must answer all questions on the form to be eligible. Entrants will receive an onscreen notification confirming receipt of entry. Entries must be received by the Promoter before the close of the promotional period to be eligible. Consumers will be awarded one entry per participating product purchased.
6.   All valid entries received during the Promotional Period will be entered in the Major Prize draw, and will also have a chance to win a Daily Prize.
7.   Undrawn entries in each Daily Prize Draw will be entered into subsequent Daily Prize Draws. If no entries are received for a particular Daily Prize Draw, then that Daily Prize will be awarded in the unclaimed Prize Draw.
8.   The following prizes will be awarded:

Major Prize Draw:

There are 20 major prizes to be won and are valid for 1 year after the winner is awarded the prize. Each major prize comprises of a Gourmet Holiday Escape to a choice of five locations. Winners have the choice between Brisbane, Melbourne, Sydney, Hobart or Adelaide. The major prize includes a complimentary cooking school class, a $250 Best Restaurant card, return economy class flights from winners nearest Australian major city (to be decided by the Promoter, in the Promoter’s discretion), return private transfers from airport to accommodation, 2 nights in 4 star accommodation with daily breakfast valued at $2,785 RRP.
9.   All travel is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partner. All bookings must be made at a minimum of forty five [45] days in advance of requested departure date. All bookings and documentation regarding the prize must be made via Free-2-Travel Holidays Pty Ltd or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices. No portion of the prize is redeemable for cash. The prize is not refundable or transferable. Winners are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. Winners and their companion must have valid travel insurance for their period of travel.

Daily Prize Draw:

There are a total of 63 Global Knife sets to be won in the Daily Prize draws during the Promotional Period. The first valid entry drawn in each Daily Prize Draw will win a Global Knife set including a 8cm Paring Knife, 14cm Vegetable Knife, 20cm Cooks Knife, 22cm Bread Knife valued at $599 RRP.
10.   Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of a prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
11.   There are a total of eighty three [83] prizes to be awarded (63 Daily Prizes and 20 Major Prizes).
12.   Total prize pool is valued at up to AU $93,437 RRP.

Prize Draws:
13.   All prize draws will be conducted at PrimeFocus Suite 403/62 Beach Street Street, Port Melbourne, Victoria 3207 as follows:
a.   The Major Prize draw will take place at 12:00pm midday (AEST) on 03/09/2012.
b.   The Daily Prize Draw will be conducted at 12.00pm midday (AEST) on each day from 01/07/2012 to 01/09/2012 (inclusive). The first valid entry randomly drawn in each draw from all entries received during the previous calendar day will win a Daily Prize (subject to verification).


Winner Notification
14.   The provisional winner will be notified in writing using the details listed on the winner’s entry form and their names will be published in The Australian newspaper on 19/09/2012 and available online at the promotional entry page via www.fisherpaykelpromotions.com.au/escape. All provisional winners will be required to send the promoter their original or a photocopy of their original eligible purchase receipt to a reply paid address for verification purposes to claim their prize. The receipt must be received by 28/11/2012 (prior to the unclaimed prize draw) in order to be verified as a winner in the promotion. Failure to provide the proof of purchase as set out for all entries when requested may, in the absolute discretion of the Promoter; result in invalidation of ALL of that entrant’s entries and forfeiture of any right to a prize.

Prize terms
15.   Prizes will only be delivered in Australia and each winner should allow 28 days from the prize validation date.
16.   The prize is subject to availability, not transferable or exchangeable and cannot be taken as cash.
17.   If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
18.   Each winner should look to the manufacturer of products and provider or services awarded as prizes for all warranties.

Unclaimed Prize draw
19.   The Promoter reserves the right to redraw in the event of a prize winner being unable to satisfy these terms and conditions or forfeiting or not claiming the prize. If required the Promoter will conduct a further draw at the same draw location (Prime Focus, Suite 403/62 Beach Street, Port Melbourne, VIC, 3207) at 12.00pm midday (AEDST) on 28/11/2012 to distribute any prizes unclaimed by this date. The Winner of this draw will be notified in writing using the details listed on the winner’s entry form and their names will be published in The Australian newspaper on 12/12/2012.

Variations
20.   The Promoter reserves the right to vary these Terms and Conditions or any of the terms of entry applying to this promotion or to modify, terminate, suspend or reschedule this promotion without notice but subject to State and Territory legislation.

Exclusions and liability
21.   This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to the Promoter and not to Facebook. Any personal information collected as part of this promotion will be held by the Promoter in accordance with its privacy policy and relevant privacy legislation. You have the right to access, update and correct such information.
22.   If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
23.   Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. If for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorized intervention, fraud, technical failure or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries.
24.   Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The promotion is not valid in conjunction with any other offer, unless otherwise advised. The Promoter accepts no responsibility for lost, delayed, misdirected or illegible entries. Except for any liability that cannot be excluded by law, the Promoter and its respective related bodies corporate (including their officers, employees and agents) and Facebook excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

Intellectual property
25.   The Promoter (or its associated or affiliated companies or third parties who have licensed its brands to the Promoter or contributed to the application) (Content Owner) own or license from third parties all application content. All application content remains the sole property of the applicable Content Owner and is protected under all relevant copyright, trade mark and other applicable laws. Nothing on the application should be construed as granting any license or rights to use or distribute any application content, without the Promoters express written agreement or of the other applicable Content Owner.

Use of personal information
26.   The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. The Winner agrees to be available for reasonably publicity purposes without compensation including, but not limited to, photographs and interviews and agrees that their name and town or city may be published by the Promoter including on national television, in newspapers, magazines and online.

General Conditions
27.   Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Jurisdiction
28.   These terms and conditions shall be governed by and construed in accordance with State Government legislation.
