Terms & Conditions: Your Chance to Win $1 Million
Acceptance by you 1) The Your chance to win $1 million promotion (“the Competition”) is provided by BSR Franchising Pty Ltd ABN 21 122 556 094, 56 Lavarack Ave, Eagle Farm, 4009 (“the Promoter”)These terms & conditions (including without limitation to the information on how to enter and prize details which we publish in relation to the Competition) apply to the Competition and between the entrant and the Promoter. By entering the Competition, you acknowledge you have read, understand, and agree to be bound by these conditions. IF YOU DO NOT ACCEPT THESE CONDITIONS YOU MUST NOT ENTER THE COMPETITION. Entering the competition 2) Entry is only open to Australian residents aged 18 years or over. However employees and their immediate families of BSR Franchising Pty Ltd and associated agencies and contractors are ineligible to enter the Competition. 3) The competition will be advertised in store at participating Betta Home Living stores and online at www.betta.com.au and www.facebook.com/BettaAU. 4) The competition commences from Saturday 7 July 2012 at 12:01am (AEST) until Tuesday 31 July 2012 at 11.59pm (AEST) (“Promotional Period”). 5) To enter participants will be required to make a purchase of $50 or more at any participating Betta Home Living store during the promotional period and complete the online entry form located at www.betta.com.au and www.facebook.com/BettaAU with all requested information including registering the purchase made. All entrants who opt-in to the Club Betta newsletter will also receive a bonus entry into the draw.
All existing members of Club Betta will receive a bonus entry on compliance to these terms and conditions. Entrants must remain subscribed to the Club Betta newsletter for the duration of the Competition. Incomprehensible or incomplete entries will be deemed invalid. 6) The cost of accessing the promotional website will be dependent on the entrant’s individual service provider. 7) Entrants must retain their original proof of purchase to be eligible to claim their prize. 8) The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the
discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 9) Multiple entries are accepted, however each entry must be submitted with a separate unique tax invoice number. 10) The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry are of a type described in this clause. 11) Entries must be received during the Promotional Period. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruption, network congestion or any other reason. Any form of automated entry using any other devices or software will be deemed to be invalid. We reserve the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these terms & conditions. Prizes and winners. Major Prize. 12) All valid entries will be entered into the major prize draw. The major prize draw will take place at 11am (AEST) at the office of Salmat IDR Pty Ltd, Level 2,116 Miller St, North Sydney, NSW 2060 on Friday 17th August 2012. The first valid entry drawn will be awarded the major prize (“Winner”). The winner will be notified within 2 days of the draw. The winner will be notified of their prize in writing and will have their details published in the Australian on the Friday 24th August 2012. The major prize is attendance at an event to be held at the Betta Home Living store from which the Winner purchased the eligible product in order to enter the Competition at 12
noon (AEST) on Wednesday 29 August 2012 (“Event”). At the Event the Winner will be invited to spin a barrel which will contain envelopes numbered between 1 and 100 and then select one envelope from the barrel to open. The opened envelope will contain a message indicating what prize the Winner will be awarded as follows: 13) The maximum total prize pool value is up to $1,000,000. 14) The winner will be awarded the prize in the form of a cheque made out to the winner, or by EFT into the winner’s nominated bank account. 15) The prize cannot be transferred or exchanged. 16) It is a Condition Precedent that all promotional envelopes are the same shape, weight, size, colour and texture. 17) It is a Condition Precedent that the draw will be overseen by a representative of Venue Rating Agency Pty Limited 18)In the event that the original major prize Winner cannot be contacted or the Winner cannot attend the Event, the Promoter will nominate a proxy to select a winning envelope at the Event. If the selected prize remains unclaimed by close of business on Monday 19th November 2012, the Promoter may conduct an unclaimed prize draw at the same place as the original major prize draw on Tuesday 20th November at 11am (AEDT) to award the major prize, subject to any written directions from any regulatory authority. The first valid entry drawn in the unclaimed prize draw will win the selected prize held by the Promoter on behalf of the original Winner from the in store event held on Wednesday 29 August 2012. The winner of any unclaimed prize will be notified in writing and will have their details published in The Australian on Monday 26 November 2012 (“unclaimed prize winner’). 19) The prize will be awarded to the person named in the entry. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter. 20) Unless expressly stated in these terms and conditions all other expenses (including travel to and from the event) become the responsibility of the winner. 21) Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit. 22)By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize. 23) Independent financial advice should be sought as tax implications may arise as a result of accepting the prize. 24) Entry and continued participation in the Promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php 25) This promotion adheres to the terms and conditions set out in the Facebook promotion guidelines which can be found at: http://www.facebook.com/promotions_guidelines.php 26) This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The
information an entrant provides will only be used for the purpose of the promotion. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. 27) All entrants unconditionally and irrevocably release and discharge Facebook from any and all liability in relation to this Promotion. Disclaimers 28) The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result. 29) It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. 30) It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion. 31) The Promoter is
not responsible for any incorrect or inaccurate information supplied by the entrant or for any of the equipment or programming associated with or utilised in the Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 32) In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, the Promoter is entitled to cancel, terminate, modify or suspend the Competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the Competition (“the Lotteries Departments”). 33) If for any reason the Competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by the Lotteries Departments), to cancel, terminate, modify or suspend the Competition. Exclusions and our liability 34) The Promoter shall not be liable for any loss or damage whatsoever or howsoever caused or suffered (including without limitation direct, indirect, negligent and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter the Competition or accepting any prize offered as part of the Competition, except for any liability which cannot be excluded by law. 35) The law implies various conditions and warranties which might apply to us supplying goods or services to you. We exclude all of those conditions and warranties to the fullest extent permitted by law, including without limitation implied warranties of merchantability and fitness for a particular purpose. 36) Provisions of the Australian Consumer Law and other statutes or regulations may grant or imply guarantees, conditions or warranties into the supply of goods and services to you. The Promoter will abide by these
provisions, unless permitted to exclude restrict or modify them, then to the extent permitted the Promoter’s liability under those provisions is limited as set out below. The liability in relation to goods we supply is limited at the option to: a) replacement of the goods or the supply of equivalent goods; or b) repair of the goods; or c) payment of the cost of replacing the goods or of acquiring equivalent goods; or d) payment of the cost of having the goods repaired; and the liability in relation to services we supply, is limited at the option to: a) the supplying of the services against; or b) the payment of the cost of having the services supplied again. Virus Warning 37) In entering the Competition, the entrant assumes the risks and responsibility for any loss, damage or consequence resulting directly or indirectly from viruses, damage or other defects in software or hardware required or associated with participating in the Competition. Termination 38) The Promoter may terminate or cancel your entry in the Competition immediately if you breach any of your obligations under these terms and conditions. Your personal information 39) As a result of entering the Competition, the Promoter will collect certain personal information about entrants, such as telephone number and email address. Unless the entrant objects, this information may be used to (i) send you news, information about our other promotions or products and/or general marketing material which the Promoter believes may be of interest; (ii) provide the entrant with news, information and material in relation to the Competition; (iii) monitor
who is entering the competition; and (iv) profile entrants. The Promoter may share entrants’ personal information for any purpose incidental to entering into and the operation of the Competition. All entries become the property of the Promoter. By entering the Competition, entrants are agreeing to receive further information from the Promoter delivered via email to the email address registered when entering the Competition. If you wish to stop receiving this information, entrants may unsubscribe by visiting www.betta.com.au and following the e-newsletter links to where an unsubscribe facility is given. An unsubscribe facility will also be given in each communication the Promoter sends. The Promoter collects entrants’ information so that they participate in the Competition. If an entrant does not give information, they cannot participate. The Promoter may use this information for the purposes of the conduct of the Competition and the Compilation of survey results and evidence. The Promoter may disclose this information to third parties who provide us with administrative services. This information will be stored at the office of the Promoter. By entering the competition, the entrant consents to the Promoter using and disclosing personal information in these ways. In addition, Salmat IDR Pty Ltd will be providing the Promoter with services that permit the running of the Competition. In doing so and
for that purpose, Salmat IDR will collect entrants’ details and provide them to the Promoter and others for that same purpose. If an entrant is not willing for this to occur they cannot participate in this Competition. Entrants may access their personal information by contacting the Salmat Privacy Officer by telephone on 02 8783 2700. The Promoter will not otherwise disclose personal information to third parties. If you advise us that you do not wish us to use your personal information for any particular purpose, we will endeavour to take the necessary measures to meet your request. Exceptions to this are: (i) where we are required to disclose information by law; (ii) where we believe that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for government or public security as a necessary part of their business; and (iii) if we notify you of an intended use or disclosure of your information and you do not object to that use or disclosure. You indemnify us 40) The entrant release and agree to keep The Promoter and their associated agencies indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by the Promoter, our directors, employees, agents and representatives arising out of your entry in the Competition or any claim by a third party arising from an act or omission by you. Failure to comply and severability 41) The Promoter is not liable for any failure to comply with these Conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force. Entire agreement and governing law 42) These Conditions, together with the information on how to enter and prize details which the Promoter publishes in relation to the Competition, constitute the entire agreement between the entrant and the Promoter as to its subject matter. By entering the Competition, you accept that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in New South Wales, in accordance with the laws in force in New South Wales from time to time.
