CHANNEL [V] “VIP ACCESS – SPLENDOUR IN THE GRASS” COMPETITION TERMS AND CONDITIONS
ENTRY INTO THE COMPETITION


1. Entry into the Channel [V] “VIP ACCESS – SPLENDOUR IN THE GRASS” competition (the “Competition”) is open to all residents of Australia aged over 18 years or over. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these Terms and Conditions.
2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter.
3. Competition begins at 10am (AEST) on Tuesday 3 July 2012 and closes at 23.59pm (AEST) on Friday 20 July 2012 (the “Competition Period”).
4. To enter the Competition and be eligible to win, entrants must:
(a) Be 18 years of age or over;
(b) register for membership online at www.vmusic.com.au;
(c) complete the online entry form;
(d) in 25 words or less answer the following question, “Why are you a massive Splendour fan?” (the “Competition Question”).

5. All entries must include all mandatory information as indicated on the form, which includes (not limited to the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth. All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, infringe the intellectual property rights of any third party, contain any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrant’s responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period.
6. Only one entry per membership per day is permitted during the Competition Period, however, the answer to the Competition Question in each entry by the same entrant must be unique and original. In the sole discretion of the Promoter, if the Promoter reasonably believes that an entrant has infringed the intellectual property rights of any third party, that entrant will be disqualified without notice. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.
PRIZE
7. There is one (1) x Prize/s in total, which consists of:
a) Four (4) x VIP tickets to SPLENDOUR IN THE GRASS being held from Friday 27 July to Sunday 29 July 2012 at Belongil Fields in Byron Bay, NSW, valued at a maximum $2800;
b) Accommodation for 4 people only for five (5) x consecutive nights in a beach house located at Nautilus 4.(4/46 Lawson Street, Byron Bay, NSW 2481) from Thursday 26 July to Tuesday 31 July 2012, valued at $3000;
c) Return flights for four (4) x people from the Prize winner’s major capital city to Gold Coast airport, valued at $4000
d) Return transfers x four (4) will be provided by Byron Bus Shuttle pick up from Gold Coast Airport and drop off to the accommodation address above; valued at $500 including GST (NB: further details will be provided to the winners regarding the transfers);
e) Opportunity to meet BLOC PARTY and DJANGO DJANGO on the weekend of Splendour in the Grass. The meet-and-greet will take place at the festival, as organised with the Prize winner and the event promoter, this is subject to the artist’s and event promoter availability at event; and
f) The Prize winner and guests also have the opportunity to dance on stage with the HILLTOP HOODS during their set at Splendour in the Grass in a gorilla suit (optional); this is subject to the artist’s and event promoter’s and artist’s availability.
(“Prize”).
8. The total maximum Prize pool value is up to $10300.
The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars.
9. Entrants are advised that the use of the Prizes may be subject to prevailing terms and conditions of the venues, prize suppliers and/or event organisers. It is a condition of accepting the Prizes that the Prize winners and guests comply with all such terms and conditions and it is the Prize winners’ responsibility to first check the tickets and with the venues and/or event organisers regarding any such applicable terms and conditions before use. The Promoter takes no responsibility for any cancellations, postponements or any other changes to the show and will not offer a substitute prize under any circumstances.
10. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize or cash. The contents of the Prizes will be at the Promoter’s sole discretion.
11. Only one Prize per person will be awarded.
JUDGING AND AWARD OF PRIZE
12. Eligible Competition entries will be judged on the basis of originality and creativity at Channel [V], Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Saturday 21 July 2012 at 9.00am (AEST). Chance plays no part in the selection of the Prize winners. The Prize winner will be notified via email or phone on Monday 23 July 2012 and his/her name will be announced LIVE on Channel [V]
13. S ‘The Riff’ on Saturday 21 July at 10:30am and published on the Channel [V] website from Saturday 21 July 2012. The Prizes must be claimed within 2 days of the publication of the Prize winners’ names.
14. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.
15. It is a condition of accepting the Prize that the Prize winners and their guests may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
16. The Promoter reserves the right to refuse to allow the Prize winners or his or her guests to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Prize.
AGE
17. All Prize winner and all guests must be 18 years or over to partake in the Prize.
TRAVEL
18. ItisaconditionofentrythatthePrizewinnerandtheirguestsmustbeavailabletotraveltoandstay in Byron Bay on the dates in Clause 7 to coincide with the event. If for any reason the Prize winner or one or more of the guests is unable to travel, the whole Prize (or where possible,
19. In the event that the Prize winner is a resident of the Gold Coast, Byron Bay or other locations near that area (which shall be determined at the absolute discretion of the Promoter), the flight component of the Prize will be forfeited in full and no substitute will be offered.
20. All ancillary costs and expenses incurred in taking and using the Prize (including but not limited to mini bar, spending money, telephone calls, food, beverages, insurance and taxes) are the sole responsibility of the Prize winner and their guest, unless expressly stated as being part of the Prize.
21. Prize winners are advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize.
22. It is a condition of accepting the Prize that the Prize winners and their guests may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
23. Airfare tickets are available on the regular scheduled services of each airline. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
24. A credit card imprint or cash deposit may be required from the Prize winner at check in to the hotel for any incidental charges. The Prize winner and guests are solely responsible for all such incidental charges and for any expenses or costs arising out of any damage or modification to the rental property as the result of the action, negligence or omission of the Prize winner and guests during their stay at the property.
25. The Promoter reserves the right to refuse to allow the Prize winner or one or more of the guests to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Prize.
26. It is the Prize winner’s responsibility to consult the festival website and other local transport information services to organise transfers between the airport, hotel and to the event site.
GENERAL
27. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof, that Prize winner will forfeit the Prize in whole and no substitute will be offered. This clause also applies to any guests of the Prize winner.
28. By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights (including copyright) in their entry. Each entrant indemnifies the Promoter for any costs or loss incurred by the Promoter as a result of this warranty being false or incorrect.
29. No responsibility will be taken by the Promoter, Channel [V]. FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes or using the Prizes.
30. The Promoter reserves the right, in its absolute discretion, to disqualify at any time:
a) any entry (including those judged as a winning entry) which, in the opinion of the Promoter, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry (including those judged as a winning entry) that is not in accordance with these Terms and Conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter.
31. The Promoter reserves the right, in its absolute discretion, to at any time, cancel or vary the Competition or to cancel or vary the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
a) a Prize winner does not satisfy the Competition entry requirements; or
b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.
32. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:
a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or
b) be required to conduct the Competition at any other time.
33. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
34. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
35. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for (and the Prize winner and guest agree to release the Promoter from liabilities relating to) any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury or sickness suffered or sustained including any due to the Promoter’s negligence) as a result of accepting or using the Prize or entering the Competition.
36. The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions.
37. By entering the Competition, all entrants agree that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and audio-visual recordings) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants, subject to the Promoter’s privacy policy which is available at www.vmusic.com.au; for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, irrevocable, transferable and royalty- free licence in any such written answers, photographs /images and audio-visual recordings. Each entrant consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
