Olympus PENtathlon Photo Competition – Game of Skill
Terms and Conditions
1. Information on how to enter the Olympus PENtathlon Photo Competition and prizes form part of these Terms and Conditions. As a condition of participation, Participants accept these Terms and Conditions and any rules, policies or procedures that may be adopted by the Promoter from time to time. To the extent of any inconsistency, these Terms and Conditions prevail.
2. Entry to the Olympus PENtathlon Photo Competition (the “Competition”) is only open to Australian residents over 18 years of age. Employees of the Promoter (and their immediate families), are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. The Competition commences (AEST) 6pm, Sunday the 22th of July 2012 and ends at 11:59pm (AEST) on Sunday the 19th of August 2012. No responsibility is accepted for lost, delayed or misdirected entries.
4. Photographs will be judged in five separate categories. These categories will be Portrait, Landscape, Macro, Black and White (B&W) and Freestyle. To participate in the Competition, Participants must upload a total of one (1) photograph only via a category’s app on the Olympus Imaging Australia Facebook Page (Olympus AU) at www.facebook.com/Olympus.AU. Participants may submit photographs for one or all of the categories but may only upload one photograph for each category. Each category must be entered via it’s individual competition app. Any entries incorrectly uploaded to the wrong category will not be considered for judging. It is up to the Participant to ensure that their entry is properly uploaded. Participants must provide personal details including; full name, date of birth, country of residence, email address and contact telephone number.
5. Participants warrant that he/she was the sole photographer responsible for taking or otherwise creating each photograph and that he/she is the sole owner of the copyright to such photograph. By entering the Competition, the Participant confirms that all persons appearing in the photograph have consented to the entrant submitting the photo as part of this competition.
6. Entrants retain copyright in their photographs. By submitting the photo/s to the Promoter, the Participant grants the Promoter and assignees a non exclusive, perpetual, irrevocable permission to use the winner’s photographs without fee for the purposes of marketing and promoting the Competition and any future competitions run by the Promoter. This permission extends to publication and reproduction for the above purposes in the media, on catalogues, posters, postcards, publications, on the internet. Where possible, entrants will receive credits with each use.
7. The Promoter reserves the right to exclude and remove any entry from the Competition at any time and to verify the validity of entries and participants to disqualify submissions not in accordance with these Terms and Conditions or tampers with the voting process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Incomplete and indecipherable entries and any entry which has incorrectly entered personal information or contact details shall be deemed an invalid entry.
9. Any theme for images submitted will be acceptable. Images that are considered unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, unduly sexually oriented, racially offensive, or that promote a commercial product or service, contain objectionable content or are otherwise considered inappropriate will be deemed invalid and rejected in the absolute discretion of the Promoter.
10. Winners will be announced 5pm (AEST) on Friday, 24th of August 2012 on the Olympus AU Facebook page. Individual winners will be contacted via email prior to public announcement.
11. Prizes will be awarded to the top entrant in each category as decided by the Olympus Imaging Australia judging panel.
12. This is a game of skill and chance plays no part in determining the winners.
13. The prize for each category shall be an Olympus PEN Mini Twin Lens Camera Kit including 14-42mm and 40-150mm lenses. The recommended retail price of each camera kit is $799. The total prize pool is valued at RRP $3995.
14. Prizes are not transferable and no cash alternative is available.
15. The Promoter reserves the right to cancel the Competition at any time and change these Terms and Conditions without prior notice to any Participant, if this is necessitated by unforeseen circumstances beyond the Promoter’s reasonable control.
16. The Promoter reserves the right to request Participants to provide additional proof of identity and residency. Identification considered suitable for verification is at the discretion of the Promoter.
17. The Promoter’s decision on all matters pertaining to the Competition, including but not limited to any dispute as to the voting, identity of an Participant, eligibility to become an Eligible Participant or the Prizes is final and binding. No correspondence will be entered into between the Promoter and the Participants in this respect.
