Participation
This competition (the “Competition”) is conducted by Virgin Mobile (Australia) Pty Ltd (ABN 67 092 726 442) of Level 8, 213 Miller Street, North Sydney, NSW 2060. Phone: 02 9028 0173 1600 (the “Promoter”).
Entry to the Competition constitutes acceptance of these Terms & Conditions. All entry instructions and prize information published by the Promoter form part of these Terms & Conditions.
This is a game of skill and chance plays no part in determining the winners. All Entries will be individually judged according to their originality and creativity. The Promoter's decision is final and no correspondence will be entered into.
The Competition is only open to “Eligible Entrants”. An Eligible Entrant is an individual who is a resident of Australia aged 18 years or older as at time of entry, excluding any:
employee of the Promoter or any of its related corporations or any of their agencies, printers, suppliers, providers or participating retailers who are associated with the Competition;
spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and
person who the Promoter has previously notified is not permitted to enter the Promoter’s competitions.
Prior to entering into the Competition, all Eligible Entrants are required to obtain the consent of their four friends to enter into the Competition on their behalf, in accordance with these Terms and Conditions.
The Competition commences at 09:00 hrs Australian Eastern Daylight Time (AEST) on 23 July 2012 and closes 16:00 hrs AEST on 8 August 2012 (“Promotional Period”).
Entry
In order to enter and participate in the Competition, an Eligible Entrant must first sign up to become a member of Facebook. To become a member of Facebook, the Eligible Entrant must visit www.facebook.com and in accordance with the Facebook’s directions, correctly sign up to Facebook. A Social Network’s terms of use will apply to the Eligible Entrant’s social network membership. At the time of signing up, the Eligible Entrant will be required to create their own Facebook profile.
If an Eligible Entrant uses WAP and/or mobile Internet to participate in the Competition: the Eligible Entrant must be identified as having a clear relationship with the end mobile device and have the bill payer’s consent to use WAP or mobile Internet to participate in the Competition. Accessing mobile content including web-based content may incur data charges. An Eligible Entrant will need to refer to the terms of their carrier contracts for details and costs as costs vary from plan to plan. The charges for all data services will appear on the Eligible Entrant’s next mobile phone bill. All general queries relating to mobile bills should be directed to the Eligible Entrant’s mobile phone carrier.
To be eligible to enter, Eligible Entrants must:
During the Promotional Period visit www.facebook.com and either log into their Facebook profile or follow the prompts to register a new Facebook account.
To enter, Eligible Entrants must, during the Promotional Period, visit www.fairgobro.com.au (the “Website”).
Click the “Create your entourage” link on the Website homepage, and then click “Enter Now”.
Allow all permissions as requested to allow access to your Facebook information.
Select four Facebook friends (“Four Friends”) who are:
Residents of Australia; and
Are over 18 years of age at time of entry.
Answer in 25 words or less why you and the Four Friends you have picked are the best people to join Doug on his tour of Australia.
Fill in your details including your name, email, mobile number, accept these Terms and Conditions and click the “Submit” form to complete your entry.
By entering the Virgin Mobile Fair Go Bro Entourage Competition you agree:
that any photos, likeness or entry may be used by Third Parties for the Third Parties’ future promotional and marketing purposes without further reference or compensation to you;
that any Third Party may duplicate, alter, adapt and utilise your photos, likeness or entry as the Third Party wishes at any time, anywhere and by any means. Third parties may license, authorise or otherwise transfer the rights in your photos or entry to others to do the same;
to unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of your moral rights in photos or statements taken from you, or created of your image, as the Winner throughout the Prize Period, or your photos and entry submitted (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (“Moral Rights”)
to waive all Moral rights to your likeness, photos or any imagery as submitted as part of your entry or taken of you throughout the Prize Period that arise outside Australia; and
not to institute, maintain or support any claim or proceeding for infringement of your Moral Rights in your photos as submitted as part of your entry, images created of your likeness, or photos as taken of you prior to and throughout the Prize Period.
For the purposes of Clause 9, Third Parties includes Virgin Mobile Australia and includes but is not limited to any person natural or corporate.
Incomplete, indecipherable, profane or illegible entries will be deemed invalid.
“Virgin Mobile Australia” may communicate messages with Eligible Entrants, via Facebook. The number of messages will be determined by the Promoter in its absolute sole discretion.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence or relationship to Virgin Mobile Australia) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof that winner will forfeit their prize in whole and no substitute will be offered, subject to State Regulation.
Any entry that is made on behalf of an Entrant by a third party, or otherwise by proxy, will be invalid.
Winners
There will be one winner judged (“Winner”).
Entries will be judged during the period commencing at 09:00 hrs AEST on Thursday 09th August and finishing at 14:00 hrs AEST Thursday 09th August at Virgin Mobile, Level 8, 213 Miller Street, North Sydney, NSW 2060 (“Judgement Period”). The Promoter’s decision is final and no correspondence will be entered into
The Judgement Period will determine the most creative “Winner” and second most creative “Runner Up”.
The Winner will be notified by e-mail & telephone on Thursday 9th August at 15:00 hrs AEST and will have until 12:00 hrs AEST on Friday 10th August to supply all required documentation including: full name, date of birth and proof of age documents for themselves. The Winner’s Four Friend’s nominated to be attending will also be required to supply full names, contact details and proof of age.
If all required information and documentation is not supplied within the determined period, the prize will be forfeited and the Runner Up will be notified at 13:00 hrs AEST Friday 10th of August. The Runner Up will be required to supply all required documentation including: full name, date of birth and proof of age documents for themselves and to supply full names, contact details and proof of age for all guest nominated to be attending by 12:00 hrs AEST Saturday 11th of August.
Winners will be announced publicly via the Virgin Mobile Australia Facebook wall (www.facebook.com/VirginMobileAus) and on the Website, (www.fairgobro.com.au) no later than Wednesday 15th August.
“Prize” COMPONENT
The first (1st) valid entry judged from the competition (Winner) will receive a trip for five (5) to Sydney to be Doug Pitt’s Entourage (the “Prize”) for the period of 22nd August to the 24th August (the “Prize Period”) including:
Five (5) x Return economy flights from the winner’s nearest capital city to Sydney Airport valued at a maximum of $3000.00 (including flight taxes and surcharges).
Chauffeured car for 2 days valued at $1900.00
Accommodation for five (5) for 3 nights at “The Darling at The Star, Darling Harbour Sydney”, valued at a maximum of $2500.00
Five (5) x standard Spa Treatments (one per guest) at The Star valued at a maximum of $975.00
Lunch for Five (5) with Doug valued at a maximum of $500.00
Five (5) x Event or activity (Bridge Climb or equivalent) valued at a maximum of $1,255.00
Five (5) x $1000 Visa Gift Cards valued at $5000.00
The total Prize Pool of this Promotion is valued at a maximum of $15130.00 AUD
The Winner and the Four Friends must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure.
The Winner and the Four Friends are required to sign a release and indemnity form in favour of the Promoter and any prize providers and return that document to the Promoter prior to receiving the Prize.
The Winner and the Four Friends will be required to sign a participation agreement and return that documentation to the Promoter prior to receiving the Prize.
In order to accept a Prize an Eligible Entrant agrees that Representatives of the Promoter can take their photograph and/or video, and that the Promoter may use their name, likeness, image and/or voice, including any photograph, film and/or recording of them or any part thereof, (“Content”) in any media without geographical or time limitation, without further notice, reference or remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products. In order to accept a Prize, an Eligible Entrant agrees that all rights, title, and interest, including copyright, in the Content will become the property of the Promoter upon creation. The Eligible Entrant agrees that, in the event they are a determined Winner, the Eligible Entrant will participate in all reasonable promoted activities in relation to the Competition as requested by the Promoter until the end of the Prize Period.
At all times during the ‘Prize Period,’ the ‘Winner’ and their Four Friends must not act in a way that the Promoter or its representatives reasonably determine is contrary to community standards, violent, or in a way that could cause injury or harm to other individuals or otherwise compromise the integrity of the Competition. Should the Winner and any of their Four Friends not comply with this requirement, as determined by the Promoter or its representatives in their sole discretion, will be disqualified and any remaining components of the Prize may be withdrawn.
The Winners and their Four Friends are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
A credit card imprint or cash deposit may be required from the Winner at check-in to the accommodation, for all incidental charges. Once accommodation is booked, they are non-changeable.
The Prize must be taken in accordance with the event dates and is subject to accommodation and flight availability. The Prize cannot be changed once the booking has been made.
Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
It is the traveller's personal responsibility to ensure that they have valid documentation, which meet the requirements of government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.
Prizes are not transferable or exchangeable and cannot be taken as cash.
The Promoter may, at its absolute discretion, substitute the prize for a different prize of an equivalent value in circumstances where the Promoter deems it necessary.
It is a condition of accepting a Prize that a Winner must comply with all the conditions of use of a Prize and any Prize supplier requirements
General
If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way or cannot be conducted in accordance with how the Promoter originally intended, due to reasons beyond the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, civil unrest, strikes, dangerous conditions, computer bugs or viruses, tampering, technical failures, or any technical issues with any third party platform, including a Social Network and mobile communication platforms), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, or invalidate any individual from participating in the Competition.
The Promoter assumes no responsibility for: (i) any technical or electrical issues that may arise in connection with the Competition, including with any third party platform such as on Social Networks; (ii) any incorrect or incomplete information which may be communicated in the course of the administering this Competition; (iii) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (iv) any variation in Prize value to that stated in these conditions; (v) if the Competition is cancelled, terminated, modified or suspended; and (vi) any tax liability incurred by a winner or Eligible Entrant. Individuals should obtain independent tax and financial advice. The Promoter does not guarantee that a Social Network service will be available at all times during the Promotional Period or that the Eligible Entrant will be able to access or use a Social Network service during the Promotional Period, and the Promoter will not be held responsible in this regard. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or Prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. It is a condition of accepting a Prize in the “Virgin Mobile Fair Go Bro Entourage” Competition that any winner and their guests sign a participation agreement in a form determined by the Promoter.
The Promoter reserves the right, at any stage, to verify the validity of any Eligible Entrant (including name, age and place of residence) and disqualify any Eligible Entrant who does not participate in accordance with these conditions or tampers with the entry process. Errors or omission will be accepted in the Promoter’s absolute discretion. Failure to enforce any rights of the Promoter at any stage does not constitute a waiver of those rights
The Competition is in no way sponsored, endorsed or administered by Facebook. Eligible Entrants understand that they are providing their information to the Promoter and not to Facebook. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook.
The Promoter has the right to cancel the Competition at any time, without notice.
