Competition and Promoter 1.1. By entering the “FOX FOOTY Essendon v Hawthorn” Game of Skill Competition (Competition) and in consideration for the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Information on how to enter and prize details form part of these Conditions of Entry. 1.2 The promoter of the Competition is FOX SPORTS Australia Pty Limited ABN 16 065 445 418 of 55 Pyrmont Bridge Road, Pyrmont NSW 2009 (Promoter). 2. Subject to paragraph 2.2, entry into the Competition is open to all permanent residents of Australia. 2.2 The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter and its related corporations and associated agencies are not eligible to enter the Competition. 2.3 Each eligible entrant may only submit one entry in the Competition. 3. Competition Period 3.1 The Competition commences at 12:00pm Australian Eastern Standard Time (AEST) on 24 July 2012 and closes at 9:00am AEST on 26 July 2012 (Competition Period). 3.2 Entries not received during the Competition Period or not completed in accordance with these Conditions of Entry will not be eligible to win. 4. How to enter Eligible entrants must, during the Competition Period, send an email to foxfooty@foxsports.com.au with their full name, contact phone number and answer to the following question (which must be 50 words or less): “Clarkson v Hird – which coach is better and why?” (Entry Question). 5. Prize and notification 5.1. Judging of all entries received during the Competition Period will be conducted by the Promoter on 26 July 2012 at 50 Dorcas Street, Southbank VIC 3005. 5.2. The two entrants who submitted the most creative and unique answers to the Entry Question (as judged by the Promoter in its sole discretion) in accordance with these Conditions of Entry will each win one AFL Reserve double pass to the Essendon v Hawthorn AFL Premiership Season match on Friday, 27 July 2012 at Etihad Stadium, valued at AU$79. 5.3. The maximum total prize value is AU$158 (including GST). 5.4. The prize winners will be notified by telephone or email on 26 July 2012. 5.5 The Promoter accepts no responsibility for any variation in the value of the prize. The prize is not transferable or exchangeable. The prize is not redeemable for cash and must be taken as offered. In the event that the prize is not available, the Promoter reserves the right to substitute a prize of equal or greater value. 5.6 The prize winners acknowledge that the AFL reserves the right, in its absolute discretion, to change the 2012 AFL Premiership Season program without notice. 5.7 The prize winners are responsible for all expenses not specified in these Conditions of Entry, including but not limited to, all transfers, accommodation, transport to and from Etihad Stadium, meals, drinks, insurance (including medical, travel and health), items of personal nature (including gratuities, telephone and in-room charges), spending money and all other ancillary costs. 5.8 Each prize winner acknowledges that the prize is subject to additional terms and conditions imposed by third party prize suppliers, including the AFL. The prize winner must become acquainted with any such additional terms and conditions prior to taking the prize. The prize winner and the prize winner’s guest must comply with all ticket conditions, supplemented by the conditions of entry imposed by the venue operator. The Promoter does not accept responsibility and is not liable for any conditions imposed on the taking of the prize by the AFL, the venue operator or any other third party prize supplier, or the breach of those conditions by any person. 5.9 If a prize winner is aged under 18 years, the prize will be awarded to the prize winner’s parent or guardian on their behalf. 6. Information for Prize Winner All entrants agree to provide the Promoter with identification and/or proof of age if selected as a prize winner. In accepting a prize, the prize winner and their parent or guardian (if applicable) agree to the release set out below. The form of identification and/or proof of age are at the discretion of the Promoter. 7. Limitation of Liability 7.1 Except for any liability that cannot by law be excluded (including as set out under paragraph 7.3), the Promoter, its related corporations and associated agencies (and any of their personnel) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant (including a prize winner and their guest) in connection with the Competition or a prize, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, its related corporations and associated agencies (and any of their personnel); and (iii) any liability for personal injury or death. 7.2 No responsibility will be taken by the Promoter or its authorised agents for lost, ineligible, misdirected or late entries due to technical reasons or any other reason. Entries that are not genuine or are incomplete, late or in any way fraudulent will be declared void. 7.3 Nothing in these Conditions of Entry limits, excludes or modifies, or purports to limit, exclude or modify, the statutory implied guarantees/warranties as provided under the Competition and Consumer Act 2010 (Cth) and the ASIC Act 2001 (Cth), including the statutory consumer guarantees under the Australian Consumer Law, or similar laws in the States and Territories of Australia. 8 Privacy By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the entrant’s personal information to assist in conducting the Competition or communicating with the entrant in regard to special offers from the Promoter. Entrants in the Competition acknowledge that the Promoter may share an entrant’s personal information with the Promoter’s Australian related entities which may contact the entrant with special offers. If an entrant elects to receive information from third parties, the Promoter may also disclose the entrant’s personal information for that purpose. Entrants can access the personal information the Promoter holds about them, notify the Promoter that they do not wish the information to be disclosed or notify the Promoter that they do no wish to receive further promotional material by writing to the Promoter at 55 Pyrmont Bridge Road, Pyrmont NSW 2009. 9 General 9.1 All entries must be original to and created solely by the entrant. All entries and all copyright and other rights in such entries and/or other materials become the property of the Promoter and will not be returned. Each entrant agrees to provide a written assignment of all rights to the Promoter if requested. By submitting an entry and any other materials (excluding any personal information) to the Promoter in connection with the Competition, each entrant: (a) specifically authorises the Promoter to use and/or license third parties to use such entry in whole or in part, throughout the universe, in perpetuity in or on any and all media, whether currently in existence or developed in the future, and alone or together or as part of other information, content and/or material of any kind or nature; (b) represents and warrants that all elements contained in the entry or other material: (i) are original to the entrant and fully cleared for use as contemplated in these Conditions of Entry; (ii) do not and will not, in any way, violate or breach any of the terms of any other agreement the entrant may be a party to; (iii) do not contain defamatory, tortious or otherwise unlawful, untrue or inaccurate information, infringe or violate any copyright or other right; or contain any matter the publication or sale of which will violate any law; (iv) are not obscene or likely to cause offence; (v) are not in any way cruel or abusive; and (vi) will not require the Promoter to pay or incur any sums to any person or entity as a result of Promoters’ use or exploitation of the same; and (c) unconditionally and irrevocably consents to any act or omission which would otherwise infringe any of their moral rights in the entry and waives all moral rights in the entry that arise outside Australia. 9.2 This Competition is a game of skill. Chance plays no part in determining the prize winner. 9.3 Acceptance of the prize constitutes consent on the prize winner’s part to allow the use of the prize winner’s name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law. 9.4 No correspondence will be entered into and the judges’ decision is final and binding. 9.5 If for any reason the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the fairness or integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the Competition. 9.6 The prize winner is advised that tax implications may arise from the prize and should seek independent financial and taxation advice prior to their acceptance of the prize.
