Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Entry is only open to Australian residents. Entry is only open to natural persons, corporations are ineligible to enter. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion. 3. Promotion commences 18/7/2012 and entries close at 5:00pm AEST on 15/8/2012 (Promotional Period). 4. To enter, individuals must, during the Promotional Period, either: a. visit the McDonald’s® Australia Facebook page http://www.facebook.com/?sk=welcome#!/McDonaldsAU and access the McDonald’s® Spotify Facebook application (Application); b. follow the prompts to install and “Allow” the Application; c. using the Application, provide the requested details, create a new playlist (Playlist), provide a title to the Playlist, search the Spotify music service for a song to start the Playlist with, and provide a twenty-five (25) words or less description of the Playlist; d. send their Playlist to Facebook friends by following the prompts on the Application, requesting them to contribute one (1) song to the Playlist; and e. submit their Playlist, OR a. receive a Facebook request from a Facebook friend to contribute one (1) song to their Playlist; b. click on the link provided to visit the McDonald’s® Australia Facebook page http://www.facebook.com/?sk=welcome#!/McDonaldsAU and access the Application; c. follow the prompts to install and “Allow” the Application; d. using the Application, provide the requested details, search the Spotify music service for one (1) song to contribute to the Playlist; and e. submit the Playlist. 5. Incomplete, indecipherable or illegible entries will be deemed invalid. 6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 7. Entrants will receive one (1) entry for each Playlist they create, subject to the following: (a) each Playlist title and description must be substantially unique; and (b) each Playlist must be submitted separately and in accordance with entry requirements. 8. Entrants will receive one (1) entry for contributing a song to a Facebook friend’s Playlist, subject to the following: (a) only one (1) song contribution permitted per entrant per Playlist; (b) each song contribution must be unique for the relevant Playlist; and (c) each song contribution must be submitted separately and in accordance with entry requirements. 9. IMPORTANT: Each Playlist must contain ten (10) different songs to be eligible: one (1) song from the creator of the Playlist and nine (9) song contributions from Facebook friends. The Promoter encourages each entrant to request their Facebook friends contribute a song to their Playlist, until their Playlist contains ten (10) different songs, and is eligible for the promotion. 10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 11. This is a game of skill and chance plays no part in determining the winners. Each Playlist entry will be individually judged based on title, description and song selection. 12. Judging will take place at OMD, 32 Pyrmont Bridge Rd, Pyrmont NSW 2009 on 23/8/2012. The best ten (10) valid Playlist entries, as determined by the judges, will be deemed the winning Playlists. For each winning Playlist, the entrant who created the Playlist, and the nine (9) entrants who contributed a song to the Playlist, will each win a prize. Winners will be notified in writing. The Promoter’s decision is final and no correspondence will be entered into. 13. Each prize is a Premium Spotify account for one (1) year, valued at $143.88. Prizes are subject to the standard terms and conditions of individual prize and service providers. Any ancillary costs associated with redeeming a prize are not included. Any unused balance of a prize will not be awarded as cash. 15. If for any reason a winner does not redeem a prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited. 16. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification. 17. Ten (10) prizes will be awarded per winning Playlist. A hundred (100) prizes will be awarded in the promotion. Total prize pool value is $14,388. Maximum one (1) prize permitted per person. 18. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 19. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). 20. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate. 22. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 23. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize. 25. (ABN 70 154 200 941) (“Spotify”) collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter and Spotify may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter and Spotify. All entries become the property of the Promoter. 26.
