The Sponsor is Toyota Motor Corporation Australia Limited (ABN 64 009 686 097) of 155 Bertie Street, Port Melbourne, VIC 3027 (the Sponsor). 1. STANDARD TERMS 1.1 Information on how to enter (including the entry form) forms part of the terms of entry. 2. WHO CAN ENTER? 2.1 Subject to clause 2.2 and 2.3, entry is open to Australian residents over the age of 18 whose permanent residential address is within the digital radio metropolitan licence areas in Adelaide, Brisbane, Melbourne, Perth or Sydney (the “Metropolitan Digital Radio Licence Area(s)”). 2.2 The entry form will provide a space for you to insert your residential postcode to find out whether you live within a Metropolitan Digital Radio Licence Area (the “Postcode Checker”). If the Postcode Checker does not state that you live within a Metropolitan Digital Radio Licence Area then you will not be eligible to enter the Competition. The result of the Postcode Checker is final and no correspondence will be entered into. 2.2 Directors, management, employees and their immediate families of: Commercial Radio Australia Ltd (the “Promoter”) and its member stations; radio stations participating in the outdoor broadcast on 24 August 2012 and their associated or networked radio stations; and Toyota Motor Corporation Australia Limited (the “Sponsor”) and their associated agencies and companies are not eligible to enter. 3. HOW TO ENTER 3.1 The Competition commences on Monday 23 July at 00:01 (AEST) and concludes on Tuesday 21 August at 23:59 (AEST) (the “Competition Period”). 3.2 In order to enter, you must log-on to www.digitalradiotoyota.com.au and register your name, residential address (including postcode), daytime telephone number and email address, gender and age range, choose which Toyota model you would like to win out of the options available and choose your favourite radio station in your Metropolitan Digital Radio Licence Area from a drop down menu. 3.3 Only one entry is allowed per person.  3.4 To be eligible to enter, you must live permanently within a Metropolitan Digital Radio Licence Area as shown by the Postcode Checker. 3.5 You must state your full residential address and postcode on the entry form and you will automatically be entered in the draw for the State in which you live, provided that you live within the Metropolitan Digital Radio Licence Area in that State. If you do not live within a Metropolitan Digital Radio Licence Area then you will not be permitted to proceed with your entry to the Competition. 3.6 You must provide proof of your residential address if required to do so by the Promoter. If you do not provide proof of residence when asked to do so you may be disqualified from the Competition, at the Promoter’s sole discretion. 3.7 The time of entry will be the time at which the completed online entry form is received by the Competition’s online database. Entrants will be presented with a confirmation page once the completed email entry is submitted by the entrant congratulating them and reminding them to be eligible to win the Prize they are required to attend the event. Entries received outside of the Competition Period will be deemed invalid and ineligible to enter the Competition. 3.8 Entry details and any intellectual property subsisting in the entries become and remain the property of the Promoter and will not be returned to the entrant. 3.9 The Promoter reserves the right in its sole discretion to reject bulk entries which it considers to have been generated using software to generate multiple entries. 4. Receipt of a Prize vehicle is subject to the winner being able to lawfully take possession of the Prize vehicle and comply with all registration and compulsory third-party insurance requirements of the state/territory in the state/territory the winner elects to register the Prize vehicle. The Prize vehicle will be available for collection from the Toyota dealership nominated by the Promoter near the winner’s place of residence. Prize value is driveaway price given at the opening date of the Promotion Period and the Promoter takes no responsibility for any change in value.] 4.8 Prizes must be collected by 23 November 2012 or, if the Prize has not been delivered by Toyota, the Winner must confirm that it will collect the Prize once it becomes available. If Toyota has not delivered the Prize by 23 November, it will provide the Winner with a letter stating that a transfer of the Prize will take place on a specified date, no later than 24 February 2012. In the event that a prize is not collected in accordance with these terms and conditions, a further draw for the prize will be held at the same time and place as the original Digicon draw, on 23 November 2012. The Winner of the redraw will be notified by email and the results of any redraw will be published in The Australian on 5 December 2012. 4.9 Vehicles depicted in any promotional material are not necessarily the same colour as the Prize vehicle. The Winner will not be able to select the vehicle colour - this will be determined by the Promoter and Toyota Australia in their absolute discretion. 4.10 Unless expressly stated in these Terms and Conditions all other expenses associated with redeeming the Prize becomes the responsibility of the Winner. 4.11 In participating in the competition and winning the Prize, the Winner must agree to participate and co-operate as required in all editorial and on-air activities relating to the Competition, including but not limited to being interviewed and photographed at the Outdoor Broadcast. The Winner agrees to grant the Promoter a perpetual and non-exclusive licence (including the right to sub-licence) to use their name and such footage and photographs in all media worldwide and the Winner will not be entitled to any fee for such use. 4.12 The Winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation. 4.13 Prizes are not transferable and cannot be redeemed for cash. The Winner should seek independent financial advice about any tax implications that may arise from the Prize winnings. 4.14 The Sponsor is solely responsible for the fulfilment of the Prize. 4.15 The Winner and the Sponsor acknowledge that the provision of the Prize is the sole responsibility of the Sponsor, not the Promoter. The Winner agrees that the Promoter accepts no responsibility or liability for any delay or failure by the Sponsor to deliver the prize or failure by the Sponsor to meet any of its obligations in these conditions of entry or otherwise. The Sponsor releases from and indemnifies the Promoter from and against all liability, cost, loss or expense arising out of a claim by a Winner (or his or her successors or representatives) in respect of delivery of the Prize. 4.16 In the event that a part of a Prize is no longer available, subject to regulations, the Promoter and/or Sponsor reserve the right to substitute prizes in their discretion to the same and equal value. The Promoter and/or Sponsor will not be liable for any damage to or delay in transit of the Prize. 5. HOW TO WIN 5.1 All entries completed and submitted through www.digitalradiotoyota.com.au in accordance with these Terms and Conditions will be stored on the competition entry database administered by Digicon Ltd, at 40 Leichhardt St, Spring Hill, Brisbane, QLD 4000 (Digicon). 5.2 This is a game of chance. 5.3 On Wednesday 22 August 2012 at 09:00am (AEST) Ten (10) finalists (Finalists) for each Metropolitan Digital Radio Licence Area will be selected by means of a random electronic draw conducted by Digicon. 5.4 All Finalists will receive an email on Wednesday 22 August 2012 between 09:15am AEST and 12:00 noon AEST advising them that they are required to attend the Outdoor Broadcast in their State of residence, where a second draw will take place to determine the winner of the Prize. Where possible, entrants will be reminded on Thursday 23 August 2012 via SMS between 09:15am AEST and 12:00 noon AEST. The Promoter may contact Finalists outside these hours in its sole discretion if it has been unable to contact Finalists during the above time periods. 5.5 If a Finalist is unable to attend the Outdoor Broadcast in their Metropolitan Digital Radio Licence Area, they will be entitled to choose a proxy who can attend the second draw on their behalf (the Proxy). 5.6 The Finalist must notify the Promoter that it intends to appoint a Proxy in advance of the Outdoor Broadcast, and must provide the Promoter with the name, address and telephone number of the Proxy. The Proxy must present identification to the Promoter at the Outdoor Broadcast before participating in the Competition. 5.7 The Proxy acts on behalf of the Finalist and must adhere to all the Competition Terms and Conditions, as though they are the Finalist. In particular, the Proxy must agree to participate and co-operate as required in all editorial and on-air activities relating to the Competition, including but not limited to being interviewed and photographed at the Outdoor Broadcast. The Proxy agrees to grant the Promoter a perpetual and non-exclusive licence (including the right to sub-licence) to use their name and such footage and photographs in all media worldwide and the Proxy will not be entitled to any fee for such use. 5.8 If the Finalist is unable to attend the Outdoor Broadcast or appoint a Proxy, the Promoter may instead appoint a Proxy to attend the Outdoor Broadcast on the Finalist’s behalf. 5.9 The Finalist or its Proxy must attend the Outdoor Broadcast in their Metropolitan Digital Radio Licence Area. 5.10 Upon arrival at the Outdoor Broadcast, the Finalists and Proxies must go to the designated meeting point (the Promoter will inform the Finalists and Proxies in advance of the location of the designated meeting point) between 8.00am and 8.15am (times refer to the actual time in each State). Upon arrival, they must provide photo identification and proof that they permanently reside in that Metropolitan Digital Radio Licence Area before being permitted to proceed further in the Competition. Proxies must provide identification and proof of residence on behalf of the Finalist whom they represent. If any Finalist or its Proxy fails to provide such proof, the Promoter reserves the right to disqualify that Finalist from the Competition. 5.11 Each Finalist or Proxy must select one of 10 keys, when requested to do so by the Promoter. One of the 10 keys will unlock a clear plastic box containing a Toyota branded key ring. The Finalist whose key unlocks the clear plastic box will be the Winner in that Metropolitan Digital Radio Licence Area. 5.12 All Winners will be notified in writing by the Promoter. 5.13 The Winners’ names will be published on www.commercialradio.com.au and advertised in The Australian newspaper on Wednesday 5 September 2012. The Promoter will not enter into any correspondence regarding the result of the draws for the Finalist or the Winners. 5.14 The Promoter and/or Sponsor reserves the right to request that the Winner provide proof of residence, age and/or identity prior to awarding Prize. Identification considered suitable for the verification is at the sole discretion of the Promoter. 5.15 It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 5.16 It is a condition of accepting a Prize that the Winner must comply with all the conditions of use of the Prize and the Prize supplier’s requirements. To the extent of any inconsistency with these Terms and Conditions, the terms and conditions of the Prize supplier prevail. 5.17 The Promoter reserves the right to redraw the Competition in the event that an entrant, who was initially deemed to be the Winner, is unable to satisfy any of these Terms and Conditions. 6. NO LIABILITY 6.1 Any costs associated with entering this Competition or claiming Prizes (such as internet service charges) are the responsibility of the entrant. 6.2 Subject to any restrictions in law and subject to clause 6.4, the liability of the Promoter however arising, whether by breach of any condition or warranty implied by statute or of this agreement or of any duty of tort (including negligence) is limited to the total value of the relevant Prize. 6.3 The Promoter, the Sponsor and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit (including via the Internet or other electronic means), or late, lost or misdirected mail. 6.4 The Promoter, the Sponsor and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim suffered or brought by an entrant; a) during the Competition draw b) whilst undertaking any travel connected with their entry into the Competition; d) in their participation in this Competition or in any Prize; e) as a consequence of late, lost or misdirected mail; f) as a result of failure to comply with any of these terms and conditions; g) as a result of use of the Prize; h) as a consequence of the malfunction of the Internet, electronic communication or Postcode Checker; or g) due to the publication of any material, including any statements made by any staff member, journalist, radio broadcaster or other entrants or any other person. 6.5 The Promoter and its affiliates accept no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available. 6.6 The Promoter and its affiliates accept no responsibility for any problems or technical malfunction of the Postcode Checker and reserves the right to take any action that may be available to cancel, terminate, modify or suspend the Competition, subject to State legislation. The Promoter will not enter into any correspondence regarding the Postcode Checker. 6.7 If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or for any other reason which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available or to cancel, terminate, modify or suspend the Competition, subject to state legislation. 6.8 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions. 6.9 The Promoter and Toyota Australia accept no responsibility for any mechanical, body or paint repairs or repairs or maintenance of any kind relating to the Prize after the date and time of prize collection by the Winner.
