How to enter

To enter the major prize draw simply visit your local Pharmore Pharmacy between 6th August and the 26th of August 2012 and purchase any item* in-store and show your Privilege Card to be automatically entered into the draw.

To enter the Facebook competition simply visit the Pharmore Pharmacies Facebook page and enter your details into the offical entry form. You will need to of made a purchase* at your local Pharmore Pharmacy between the 6th and the 26th of August. Entries close 2nd September 2012.

Entry is only open to residents of Victoria aged 18 years or over who are existing Pharmore Privilege Card members or who become Pharmore Privilege Card members at any Pharmore Pharmacy between 6/08/2012 and 26/08/2012. For the sake of clarity, individuals who become members of the Pharmore Privilege Card rewards program by signing up in-store during the promotional period will be considered existing members of the Pharmore Privilege Card rewards program for the purposes of this promotion and will be eligible to enter the draw via the methods outlined for existing members.

 
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.


PROMOTIONAL PERIOD


Promotion commences on 6/08/2012 and ends for purchases in-pharmacy at close of business on 26/08/2012. Online entries close at 11:59pm AEST on 02/09/2012.
HOW TO ENTER THE MAJOR PRIZE DRAW (“Major Prize Draw”)


To receive an automatic entry into the Major Prize Draw, individuals must make a purchase (excluding prescription purchases) from any participating Pharmore Pharmacy in Australia and have a staff member swipe their Pharmore Privilege Card at the time of purchase between 6/08/2012 and close of business on 26/08/2012 (“Qualifying Transaction”).


Multiple entries into the Major Prize Draw are permitted, subject to the following: (a) only one automatic entry permitted per Qualifying Transaction; (b) only one Entry permitted per Qualifying Transaction; and (b) each entry must be submitted in accordance with entry requirements.
Entrants must retain a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.


HOW TO ENTER THE MINOR PRIZE DRAW (“Minor Prize Draw”)
Once entrants have made a Qualifying Transaction at a Pharmore Pharmacy, an email will be sent to the email account registered on their Pharmore Pharmacy Privilege Card membership account, inviting the entrant to visit the Pharmore Pharmacy Facebook page for an opportunity to enter a second draw (“Minor  Draw”).
To enter the Minor Prize Draw, individuals must visit www.facebook.com/pharmorepharmacies, “Like” the Pharmore Pharmacies page (if they do not already “Like” the page), follow the prompts to the promotion entry page and complete the Minor Prize Draw Entry Form (including their full name, postcode, telephone number, and a valid email address) and submit the fully completed entry form so that it is received by 11:59pm AEST on 02/09/2012.
Only one entry into the Minor Prize Draw permitted per person.


DRAWS & PRIZES


The draws will take place at Pharmore Pty Ltd, 56-58 Ricketts Road, Mount Waverley, VIC 3149 at 12:00pm AEST on 04/09/2012. Winners will be notified by telephone, email or mail, and their names will be published on www.facebook.com/pharmorepharmacies and www.pharmore.com.au.


The first valid entry drawn in the Major Prize Draw will win a MasterCard® GIft Card valued at $2,500. The two subsquent valid entries will win a MasterCard® GIft Card valued at $500 each.


The first valid entry drawn in the Minor Prize Draw will win a MasterCard® GIft Card valued at $500.


Total prize pool value is $4,000. The promoter takes no responsibility for any variation in the prize value or type of gift card.
The use of the MasterCard® Gift Card prizes are governed by the Westpac MasterCard® Gift Card Conditions of Use which can be viewed at http://www.westpac.com.au/docs/pdf/pb/GiftCardConditionsofUse.pdf. MasterCard® Gift Card prizes have an expiry date of 12 months from the date of issue. The winner should seek support from the Westpac Bank for card balances and transaction enquiries, on Gift Card Call Centre on 1800 204 965 within Australia, or +61 2 9293 9292 from overseas (fees may apply).


The promoter is not responsible for any lost or stolen MasterCard® Gift Cards; and will not be replaced by the promoter.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.


Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.


A draw for any unclaimed prizes may take place on 16/10/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing and their names will be published on www.pharmore.com.au.


GENERAL


Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or illegible entries will be deemed invalid.


If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter’s decision is final and no correspondence will be entered into.


Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.


If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.


Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.


Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.


Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) the use of a prize.


As a condition of accepting the prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.


The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
