WIN A MALAYSIAN ADVENTURE COMPETITION TERMS AND CONDITIONS

Entry into the competition is based on acceptance of these terms and conditions.
This is a promotion by The Big Canvas Pty Ltd, Level 1, 242 Clarendon Street, South Melbourne, ABN 44 802 521 589 in conjunction with Tourism Malaysia Sydney, Level 2, 171 Clarence Street Sydney NSW 2000.
Entry is open to all residents of Australia over the age of 18. However, employees and the immediate families of The Big Canvas, Tourism Malaysia, airline partners and their associated agencies and companies are not eligible to enter.
The prize draw opens on 17th August 2012 at 12:00 AEST and entries close 16th September 2012 at 23:59 AEST.
The prize includes return economy flights to Kuala Lumpur and Penang with Air Asia X subject to the terms and conditions stated on their voucher and below, (flights depart from Sydney, Melbourne, Gold Coast, and Perth only) and 2 nights accommodation at Traders Hotel Kuala Lumpur, including breakfast daily, for 2 people and 2 nights accommodation at the Golden Sands Resort by Shangri-La in Penang, including breakfast daily, for 2 people. The prize does not include any Airport Taxes or Surcharges which must be borne by the winner. Prize also includes an AUD 500 travel card. Total Prize value AUD 3500. Note: This excludes any airport taxes and surcharges.
Indication of the value of the prize is based on current fares and land pricing, at the time of printing but subject to variation according to supplier offers. No discounts can be given for any variation in price at the time of redemption. The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
This competition will be conducted through various channels, including; landing pages, microsites, Facebook and emails, one winner will be judged from entries from all sources. (This list is not exhaustive).
The entries will be judged on 19th September 2012 at 12:00 AEST at Level 2, 171 Clarence Street, Sydney NSW 2000, Australia. The winner will be notified by email within 2 days of the draw. The winner should accept the prize within 5 days by a confirmation email; should the winner not accept the prize a new winner will be judged on 27th September 2012 at 12:00 AEST at the same location as the original judging. The winner will be notified by email within 2 days of the draw. The winner will be published on www.tourismmalaysia.com.au and on Tourism Malaysia’s facebook page.
Prize winners are advised that tax implications may arise from their prize winning and they should seek independent financial advice prior to the acceptance of the prize.
It is the responsibility of the prize-winner to ensure that they and their travelling companion have a valid passport for travel and that it is valid for at least 6 months after their arrival back to Australia. Other nationals, resident in Australia should check Visa requirements before departure from Australia.
It is possible that a credit card number will be requested by our suppliers to guarantee the booking. Charges will only be made in the case of cancellation or for any additional extras that may be booked.
The winner will book their stay on their own initiative before 30th November 2012 and travel must be completed before the expiry dates of the respective prize vouchers. Advance reservation is required at least 30 days prior to arrival. The prize is subject to availability. However, dates selected that fall on or within periods during Australian school holidays and/or any special events and blackout dates at the selected destination are not included and alternative dates must be selected by the winner. Where possible the promoter will endeavour to fulfil the winner's holiday choice and dates. The original voucher is to be handed in upon arrival at check-in.
The winner agrees to their name, suburb of residence and imagery being used in future promotional and marketing purposes, for an unlimited length of time without remuneration.
Each entrant agrees that the promoter may collect their personal information and use it to provide the entrant with marketing material via, mail, telephone and electronic messages for an indefinite period of time. By opting-in, the promoter may share information collected with its affiliated partners who may also contact the entrant in these ways. Products included in the prizes cannot be substituted or forfeited for cash. No items are transferable.
The prize offered is for maximum of two people, sharing twin share accommodation on consecutive days stay.
The prize, or any unused portion of the prize, is not exchangeable for other goods or services and cannot be taken as cash. The prize is not transferable. Without limiting the above, the prize or any component of the prize cannot be sold on e-Bay or any other online auction site. The prize must be taken as offered and cannot be varied with the exception of adding additional holiday products, which is at an additional cost and must be paid for by the winner at the time of booking. The Prize may be redeemed by the Winner only. No relative, partner or friend of a Winner may claim any part of the Prize nor may the Winner transfer any part of a Prize to any other person. The Prize may be used by the Winner plus any other 3rd party inclusive in their booking.
The winner and their companion are responsible for all other expenses including passports, visa applications (if applicable), spending money, meals, drinks (alcoholic/non-alcoholic), activities, incidentals, energy surcharges, gratuities, in country taxes, services charges and all other ancillary costs.
The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier's requirements.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability, which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm each winner's identity, age, residential or email address, eligibility to enter and claim the prize and any information submitted by the winner in entering the promotion, before issuing the prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter's satisfaction within the time requested, that winner's entry will become invalid. The prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify the prize, subject to any written directions from a relevant regulatory authority.
Air Asia X TERMS & CONDITIONS

Tickets are valid for up to 6 months from date of issue (outgoing and return flights must be completed within this period) and are non-refundable, non-transferable and not exchangeable for cash or any other benefits in kind.
All bookings are subject to availability.
Bookings cannot be made on flights during weekends, eve of public holidays, public holidays and other embargo periods. Please do check with AirAsia X for said periods.
Changes to the flight destinations are not permitted unless agreed upon by AirAsia X.
AirAsia X will not entertain any request to extend the validity period.
The prize DOES NOT include all relevant airport taxes and fees.
Prize is subject to AirAsia X Terms and Conditions of Carriage.
The terms and conditions of any third party will apply to the prize where applicable.
The prize does not include anything not listed above including but not limited to: travel insurance, passports, visas, meals, baggage allowance, taxes not included in the price of the ticket, ground transportation or any other costs of a personal nature not stated.
Compliance with any health or other government requirements is the responsibility of the/each prize-winner and companion.
Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
There can be no changes (name of traveller, travel date, etc) made to travel arrangements once bookings are made.
AirAsia X accepts no responsibility for any damage, loss (including but not limited to direct, indirect and consequential loss), liability, injury or disappointment incurred or suffered by the winner or their guest in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
AirAsia X retains the right to substitute the prize with another of similar value in the event the original prize offered is not available due to circumstances beyond its reasonable control.
All bookings must be made directly to AirAsia X via the contact person provided. Bookings cannot be made via a third party.
By making a booking, the winner and guest are deemed to have agreed to the terms and conditions of this prize as well as AirAsia X’s terms and conditions of carriage available at airasia.com.
AirAsia X reserves the right to amend the terms and conditions listed at any time without prior notice.
