TERMS AND CONDITIONS OF ENTRY
By entering the WIN A V8 SUPERCARS AUSTRALIA HOT LAP COMPETITION “The Competition”, you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open only to all residents of Victoria 18 years and older who are able to provide proof of residency , such as a Drivers License, to the Promoters upon request.
2.2 Employees and their immediate families of The Promoter (Herald & Weekly Times Pty Ltd & V8 Supercars Australia), and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. HOW TO ENTER
3.1 The competition commences on Wednesday August 29, 2012 at 00.05 (AEST) and concludes on Sunday September 2, 2012 at 23:50 (“the Competition Period”).
To enter the competition, entrants must go to www.heraldsun.com.au/competitions during the Competition Period and submit the online entry form including the entrant’s full name, address, postcode, day contact number, email address and their answer, in 25 words or less, to the question ‘Who is your favourite V8 Supercar Championship driver and why?’. The most entertaining entry will win.
3.2 Only one entry per valid email address. Entries submitted via phone and email are invalid and will not be accepted.
3.3 The Promoters reserve the right to verify the validity of entries and disqualify an entrant for tampering with the entry process or for submitting an entry which is not in accordance with the terms and conditions.
3.4 Entrants (and winner) must be over the age of 18 years to enter the competition.
4. PRIZE
4.1 The prize consists of:
1 (one) Hot Lap at the Dick Smith Sandown 500 on Friday 14 September with Jack Daniels Racing’s Todd Kelly (the Hot Lap); and
1 (one) Family Pass (includes 4 (four) Weekend General Admission tickets to Dick Smith Sandown 500 14-16 September, 2012).
TOTAL PRIZE VALUED ATAPPROXIMATELY $10,448.00 (incl. GST) – includes a ‘money can’t buy’ element.
4.2 Prize conditions:
4.1.1 If for any reason the winner does not take the prize or any element of the prize on Friday 14 September, 2012, then the prize or any element of the prize will not be redeemable for cash. In event the prize winner is unable to redeem the prize on 14 September, 2012, the winner will forfeit prize in full.
4.1.2 The ability to participate in the Hot Lap is subject to certain height, weight and medical parameters as determined by V8 Supercars Australia in its absolute discretion. For safety reasons the passenger of the V8 Supercar Hot Lap ride must weigh no more than 100kg and be no taller than 190cm.4.1.3 The prize is not transferable, exchangeable or redeemable for cash. In the event that any prize item is unavailable; the Promoters reserve the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner. All other expenses, including travel to and from the venue, other than those outlined in the terms and conditions are the responsibility of the prize winner.
4.1.4 The winner agrees to consume no alcohol on the day of the Event. If the winner has consumed alcohol the prize will be forfeited.
4.1.5 The winner must wear closed toe shoes in order to participate in the Event. 4.1.6 In participating in the prizes, the winner agrees to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The winner grants the Promoters a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.
5. DETERMINATION OF WINNER
5.1 The winner will be judged at HWT, 40 City Road, Southbank, VIC 3006 from 12noon on Monday September 3, 2012. Chance plays no part in determining the winner.
5.2 The winner will be notified by telephone and email and his or her name will be published on the Herald Sun website and in the Herald Sun public notices section on 05 September 2012.
5.3 The Promoters’ decision is final and the Promoters will not enter into correspondence regarding the result.
5.4 If an entrant marks the “opt-in” box on the entry coupon, the entrant consents to storage of their personal information on the specified companies’ databases and the specified companies may use this information at any time in the future for promotional and marketing purposes regarding their respective products or services including contacting the entrant via electronic messaging.
6 NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters’ ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoters may in their absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.
6.2 By entering into this competition the entrant agrees that if they win, they must comply with the Conditions of Entry to the V8 Supercars Australia event. The entrant acknowledges and accepts that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize and that motor racing is dangerous, and that participation in the prize has a degree of danger. To the extent permitted by law, the winning entrant must exclude, release and forever discharge the Promoters, and all other persons involved in the conduct, promotion and organisation of the 2012 Dick Smith Sandown 500 V8 Supercars Australia and their respective employees, officers, agents and contractors from all liability for claims, loss, damage, cost or expenses (whether arising under statute, from negligence, personal injury, death, property damage, infringement of third party rights or otherwise) arising from or in connection with the participation in the relevant prize or attendance at the Sandown Motor Raceway or otherwise howsoever arising.
6.3 To be eligible to win the prize, entrants must: on request of the Promoters, execute any and all documentation (if any) necessary to give effect to 6.2 and sign a waiver and indemnity form (The Form) and agree to be bound by any other safety or timing conditions set by the Promoters and/or the driver or the V8 Supercar race team providing the Hot Lap prize to the winner. recognise the difficulties of running and attest that they are physically fit to compete safely in the Event and have not been advised otherwise by a qualified medical practitioner. If a winning entrant becomes aware of any medical condition or impairment that will be detrimental to their health if they participate in the Event they must withdraw from the Event. In the event that for any reason whatsoever a winner does not accept and take any element of the prize at the time stipulated by the Promoters then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
6.4 The Promoters and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: during the draw; whilst undertaking any travel connected with their entry into the draw;
in the participation in any prize; as a consequence of late, lost or misdirected mail; due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion; or due to circumstances outside the Promoters’ reasonable control.
6.5 The Promoters and their affiliates assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.6 If, for any reason, this competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoters which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoters reserve the right, in their sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to State Legislation.

The Promoters collect your personal information to assist us in providing the goods or services you have requested, to process your competition entries, and to improve our products and services. The Promoters are bound by the National Privacy Principles in the Privacy Act 1988. We or any of our Australian related companies may contact you by any means (including by SMS or e-mail) in the future to let you know about goods, services or promotions which may be of interest to you. We may also share your information with other persons or entities who assist us in providing our services or running competitions or with other companies who provide prizes for competitions or reader offers. HWT is part of a global media and entertainment group and would like to share your information with our related companies so that they can contact you with offers.
