Mark Knopfler London Gig Competition
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Registration and entry in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is American Express Australia Limited (ABN 92 108 952 085) of 12 Shelley Street, Sydney NSW 2000 (“the Promoter”).
3. Promotion commences at 3.00pm AEST Thursday 30 August 2012 and ends at 9am AEST Friday 14 September (“Promotion Period”). Entries received outside the promotion period will not be accepted.
Conditions of entry
4. To be eligible to enter and win, entrants must be over the age of 18 years and be:
a) The primary holder of an eligible Australian Dollar American Express Card issued by American Express Australia Limited (or License Network Partners detailed in clause 5) and whose account(s) are in good standing; or
b) The primary holder of an eligible New Zealand Dollar American Express Card issued by American Express International (NZ), Inc. and whose account(s) are in good standing. (“Eligible Entrants”).
5. Card holders of “Licensed Network Partners” of American Express Australia Limited and American Express International (NZ),Inc. are also eligible:

6. To be eligible to enter and win, Eligible Entrants must purchase Mark Knopfler’s album Privateering with their American Express Card (at any available retail outlet or online store in Australia or New Zealand)
7. Once the winner is selected, proof of purchase will be required. E.g receipt of the album purchase showing method of payment as American Express.
8. Employees of American Express Australia Limited and any other agencies associated with this promotion, and their immediate families, are ineligible to enter.
The Prize
9. An Eligible Entrant will be eligible to win the one (1) prize on offer. There will be a total of one (1) winner.
10. There will be a total of one (1) prize consisting of:
a) Two Return economy airline tickets to London, leaving from the winners closest capital city;
b) Four nights accommodation for two in a hotel of at least a four star rating (up to the discretion of the Promoter); and
c) Two VIP passes to the intimate Mark Knopfler gig on 25 September at a secret location.
11. Total prize pool value is AU$12,000.00 (including GST)
How to Enter
12. To enter the competition Eligible Entrants must:
a) Purchase Mark Knopfler’s album Privateering with their American Express Card (at any available retail outlet or online store in Australia or New Zealand)
b) Visit the ‘American Express Australia’ Facebook Page and become a ‘fan’ of the ‘American Express Australia ’ Facebook Page by ‘liking’ the page, then follow the prompts to the competition entry page. You must have a Facebook account in order to view the American Express Facebook Page. You can create an account at www.facebook.com; and
c) Complete the application form on the competition entry page by answering the question in 25 words or less “If you were invited to play a duet with Mark Knopfler, what song you would want to play and why?” (“the Question”) and providing the following (text fields provided in entry form):
i. Full Name; and
ii. Email Address .
13. Eligible Entrants can only enter the competition once.
14. Eligible Entrants must agree to terms and conditions and to being contacted by the Promoter in conjunction with this competition.
Judging Criteria
15. The judging criteria for all entries submitted answering the Question is as follows:
a) Must describe in 25 words or less what song they would like to play as a duet with Mark Knopfler;
b) The response must be appropriate to share with people of all ages & walks of life; and
c) The creativity of the answer.
16. The competition will be judged by a panel of 3 judges provided by the Promoter .
17. The entry which the judges deem have satisfied all components of the judging criteria stipulated in clause 13 will win. The judge’s decision is final and no correspondence will be entered into.
18. This is a game of skill and chance plays no part in determining the winner.
Winner Notification
19. Judging will take place at 12pm AEST Friday 14 September 2012. The Winner will be notified by email by 5.00pm AEST Monday 17 September 2012.
20. The Prize winner will receive the travel components of their prize from Travelscene American Express. Please note that the winner must purchase their own travel insurance. The tickets for the Mark Knopfler private gig will be delivered to the winner’s hotel in London.
21. Prizes will be awarded to the person named on the application form as per clause 11 (c).
22. The winner must be available to fly to London from Australia or New Zealand on Sunday 23 September and return from London to Australia or New Zealand on Friday 28 September (or the nearest availability).
23. In the event the prize winner is unable to accept the prize, the Eligible Entrant with the next best entry as judged by the judges as per clause 14 will be deemed the new winner of the prize. The Eligible Entrant that is deemed the new winner will be notified by email within 3 business days of the judge’s decision.
General Conditions
24. The prize is not transferable or exchangeable and cannot be taken as cash in part and/or in full. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by The Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
25. Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.
26. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.
27. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
28. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any Eligible Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms &
Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
29. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.
30. It is a condition of acceptance of the prize that the winning Eligible Entrant’s American Express Card account must be current (during the Promotion Period and at the time of notification that they have won) and the winning Eligible Entrant must not be in default under their American Express Card contract.
31. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner. This includes, but is not limited to, meals, taxes, insurances, transport to and from departure point, transfers to and from the venue, items of a personal nature, in-room charges and all other ancillary costs are not included.
32. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
33. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
34. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being
interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
35. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with The Promoter or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
36. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
37. Prize values are based upon the recommended retail prices at the time of printing (inclusive of
GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
38. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
39. Should an Eligible Entrant’s contact details change during the Promotional Period, it is the Eligible Entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
40. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
41. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
42. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
43. Any cost associated with accessing the American Express’ Facebook Page is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.
44. Entry and continued participation in the Promotion is dependent on Eligible Entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php.
45. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an Eligible Entrant provides will only be used for the purposes outlined in this Terms and Conditions document. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook.
46. The Promoter and their related bodies corporate, their officers, employees and agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
47. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
48. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
49. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
50. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
51. By entering the promotion, unless otherwise advised, each Eligible Entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Eligible Entrant, including sending the Eligible Entrant electronic messages.
52. If required, Eligible Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
53. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right (subject to any written directions under applicable law) to cancel, terminate, modify or suspend the promotion.
54. No responsibility is accepted for late, lost or misdirected entries.
55. Incomplete or indecipherable entries will be deemed invalid
56. All entries become the property of American Express. The winner agrees to allow American Express to use his/her particulars for the purposes of marketing, publicity, promotional or direct mailing (unless they have already notified American Express Australia Limited to not do so).
Privacy Consent
57. To provide this competition, the Promoter needs to collect personal information about the Eligible Entrant. If the Eligible Entrant does not provide the information requested, the Promoter may not be able to provide the Eligible Entrant with the competition entry. The American Express Privacy Policy Statement sets out policies on management of personal information. To
arrange access to personal information about Eligible Entrant, request a copy of the American Express Privacy Policy Statement or enquire generally about privacy matters, write to the Promoter. The Eligible Entrant agrees that subject to the Privacy Act, the Promoter or their agents may do the following:
- Transfer personal information confidentially to the Promoter’s related companies or organisations that provide services in relation to this competition. This includes transferring personal information to the USA or other countries for data processing and servicing;
- Disclose Eligible Entrants' personal information to State and Territory lottery departments (if required);
- Publish winners' names as required under the relevant lottery legislation (if required); and
- use the winner's personal information in any media for publicity purposes associated with the competition without any further payment or other compensation, unless the winner otherwise notifies the Promoter at time of accepting the prize.
