This "Trickopedia - Search for Australia's Most WACKO Dog Trick Promotion ("Promotion")") is conducted by Mars Australia Pty Ltd, ABN 48 008 454 313, trading as Mars Petcare Australia, of 1 Petcare Place, Wodonga VIC 3690 ("Promoter"). 2. The Promotion is a game of skill in which chance plays no part. 3. Entry to the Promotion constitutes acceptance of these conditions. 4. The Promotion is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 18 years of age, or older, as at the time of their entry; (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Promotion; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee. 5. Promotion entry opens at 11am on 13/8/12 and ends at 5pm on 14/10/12 ("Entry Period"). All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date. ENTRY - INTRODUCTION 6. Entry to the Promotion can only be made by internet. To enter, an Eligible Entrant must, during the Entry Period, use a compatible browser to visit www.trickopedia.com.au (the "Promotion Website") and follow the directions there. 7. As specified in these conditions, an Eligible Entrant may enter the Promotion by EITHER: (i) uploading a photograph of a dog performing a "trick" and providing a caption for that photograph (a "Photo and Caption Entry"); OR (ii) by providing a caption for a photograph of a dog that has been uploaded in someone else's Photo and Caption Entry (a "Caption Only Entry"). 8. There is no limit to the number of Photo and Caption Entries or Caption Only Entries that an Eligible Entrant may submit. PHOTO AND CAPTION ENTRY 9. To submit a Photo and Caption Entry, an Eligible Entrant must: (i) provide all details requested at the Promotion Website, including the entrant's first and last names, telephone number and email address; (ii) upload a photograph of a dog owned by the entrant on the date that the entry is submitted ("Dog") in which the Dog is performing a "trick" and which complies with the requirements of conditions 10 and 11 ("Photo"); (iii) provide the name of the Dog in the Photo (truncated to a maximum of 20 characters (including spaces) if the name (including spaces) exceeds 20 characters) ("Your Dogs Name"); (iv) provide an amusing caption for the Photo ("Caption"); and (v) agree to these Conditions and any representations, warranties and indemnities specified at the time of entry. 10. The Photo in each Photo and Caption Entry must: (i) be original; (ii) be free of any claims, including copyright claims, by other parties; (iii) be no larger than 2MB; and (iv) be uploaded in one of the following formats: jpeg; gif; png. 11. The Photo in each Photo and Caption Entry must NOT: (i) be offensive or be likely to cause offence to any person or group of persons; (ii) depict the Dog engaged in any activity that might injure the Dog or any other animal or person; (iii) promote or depict illegal or negligent activity; (iv) infringe the rights (including intellectual property rights, performer's rights or rights of reputation) of any person, whether as a result of being communicated to the public or otherwise; (v) include a brand or trademark of any dog treat or food other than SCHMACKOS; (vi) except for publication as provided for in this Promotion, have previously been shown to the public or a substantial number of members of the public; and (vii) in whole or in part, have been submitted as an entry in any other competition. 12. The Caption in each Photo and Caption Entry must: (i) be original (not have been submitted in any prior Photo and Caption Entry or Caption Only Entry); and (ii) be no longer than 50 characters (including spaces). 13. The Caption in each Photo and Caption Entry must NOT: (i) be offensive or be likely to cause offence to any person or group of persons; (ii) promote or depict illegal or negligent activity; (iii) infringe the rights (including intellectual property rights), of any person, whether as a result of being communicated to the public or otherwise; (iv) include a brand or trademark of any dog treat or food other than SCHMACKOS; (v) have previously been shown to the public or a substantial number of members of the public; and (vi) in whole or in part, have been submitted as an entry in any other competition. 14. The Dog's Name in each Photo and Caption Entry must NOT: (i) be offensive or be likely to cause offence to any person or group of persons; (ii) promote or depict illegal or negligent activity; (iii) infringe the rights (including intellectual property rights), of any person, whether as a result of being communicated to the public or otherwise; (iv) include a brand or trademark of any dog treat or food other than SCHMACKOS; 15. A Photo may be entered only once and only by ONE Eligible Entrant. If the same, or substantially the same, Photo is submitted in more than one entry, only the first entry received will be accepted. For the purposes of this provision, the time that the internet entry is received will be the entry time. If, in the Promoter's opinion, two or more Photos are the same, or are substantially the same, the Promoter may, in its absolute discretion, exclude one or more of the entries which submitted those Photos. CAPTION ONLY ENTRY 16. To submit a Caption Only Entry, an Eligible Entrant must: (i) provide all details requested at the Promotion Website, including the entrant's first and last names, telephone number and email address; (ii) select a Photo that is displayed on the Promotion Website that was not uploaded by the entrant (the "Selected Photo"); (iii) submit an amusing Caption for the Selected Photo; and (iv) agree to these Conditions and any representations, warranties and indemnities specified at the time of entry. 17. The Caption in each Photo and Caption Entry must comply with the requirements for Captions that are submitted in a Photo and Caption Entry (see conditions 12 and 13). ENTRY - GENERAL 18. All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any delivery service or equipment. 19. All entries to the Promotion may be subject to verification and confirmation by the Promoter. An entrant MUST deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document. 20. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction; or (ii) fails to produce items as required by condition 19 or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's opinion, submits an entry which is not in accordance with these conditions. OFFER CONDITIONS (i) Limited offer – may be withdrawn at any time. (ii) Each sample is a SCHMACKOS STRAPZ with Fish 96g (“Sample”). (iii) Limit of two Samples per household. (iv) Offer available only to residents of Australian households. (v) Allow 30 days for receipt of Sample. (vi) Offer made by Mars Australia Pty Ltd, ABN 48 008 454 313, trading as Mars Petcare Australia, of 1 Petcare Place, Wodonga VIC 3690. (vii) Claimant personal information will be collected by or on behalf of the Promoter to enable it to administer the Offer and, if a Claimant consents, may be used to market its products to the Claimant. The personal information of each Claimant may be provided to others assisting in the conduct of the Offer, including the Offer administrator, and sample deliverers. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If a Claimant does not provide accurate personal information the Promoter may determine that they are not eligible to claim a Sample. PHOTO AND CAPTION DISPLAY 21. Subject to condition 22, the Photo, the Dog's Name and the Caption in each Photo and Caption Entry, and the Australian State or Territory in which the entrant resides, will be displayed on the Promotion Website after the Photo Upload Entry has been received until the end of the Entry Period. (The Promoter may also post the Photo included in Photo Upload Entry on one, or more, websites, including the SCHMACKOS Australia Facebook page, for public viewing for up to 1 year after the Entry Period.) 22. The Promoter may exclude the Photo, the Dog's Name and the Caption submitted with any Photo and Caption Entry from display on the Promotion Website (or remove a Photo and Caption from display) if in the Promoter's reasonable opinion: (i) the Photo does not comply with the requirements of conditions 10 and 11; (ii) the Caption does not comply with the requirements of conditions 12 and 13; or (iii) the Dog's Name does not comply with the requirements of condition 14. 23. Subject to condition 24, the Caption in each Caption Only Entry, together with the Photo that was selected at the time that the Caption was submitted and the Dog's Name for that Photo, and the Australian State or Territory in which the entrant resides, will be displayed on the Promotion Website after the Caption has been received until the end of the Entry Period. (The Promoter may also post the Caption included in a Caption Only Entry on one, or more, websites, including the SCHMAKCOS Australia Facebook page, for public viewing for up to 1 year after the Entry Period.) 24. The Promoter may exclude the Caption submitted with any Caption Only Entry (and the associated Photo) from display on the Promotion Website (or remove such a Caption and the associated Photo from display) if in the Promoter's reasonable opinion the Caption does not comply with the requirements of conditions 12 and 13. 25. The submission of Caption Only Entries means that a Photo that is submitted in a Photo and Caption Entry may be displayed on the Promotion Website multiple times each with one of the associated Captions. The Photo will be displayed with the Caption that was submitted by the entrant who uploaded the Photo and Caption Entry and also with the Captions for that Photo (if any) that are submitted in Caption Only Entries. VOTING 26. During the Entry Period members of the Australian public (a "Voter") may, in accordance with the voting requirements specified on the Promotion Website, vote at the Promotion Website for one Photo and its associated Caption that they consider to be highly entertaining (a "Vote"). 27. A Voter may vote: (i) only from an Australian IP address; (ii) only once a day for a Photo and its associated Caption; (iii) only manually (the use of automated means or a voting service is not permitted). 28. The Promoter may reject a Vote (whenever it was submitted) if: (i) the Promoter reasonably forms the opinion that the Vote was not submitted in accordance with the requirements of condition 27; (ii) the Vote was submitted in relation to a Photo and Caption that the Promoter has removed from the Promotion Website pursuant to condition 22; or the Vote was submitted in relation to a Photo and Caption that the Promoter has removed from the Promotion Website pursuant to condition 24. A Vote that has not been rejected by the Promoter is an Eligible Vote. WINNER DETERMINATION 29. Subject to condition 30, the ten Photos and Associated Captions that received the most Eligible Votes during the Public Judging Period (excluding any Photos and Captions removed from display) (the "Finalist Photos and Associated Captions") will be judged by the Promoter. 30. If there is a "tie" in the number of votes cast for a Photo and Associated Caption, such that there are more than ten Photos and Associated Captions to be judged, all the "tied" Photos and Associated Captions will be judged. (eg if the highest voting is 10,000 votes for one Photo and Associated Caption, 9,000 votes for another Photo and Associated Caption, 8,000 votes for another Photo and Associated Caption, and 7,000 votes for each of eighteen Photos and Associated Captions, then the 21 Photos and Associated Captions will be judged.) 31. The judging will be completed by 17/10/12 and ONE Finalist Photo and Associated Caption will be chosen as the winning Finalist Photo and Associated Caption. 32. In the judging, the Promoter will judge how amusing each Finalist Photo and Associated Caption is (the "Judging Criterion"). More is better. When judging the winning Finalist Photo and Associated Caption, a 60% weighting will be given to the Photo and a 40% weighting will be given to the Associated Caption. PRIZES 33. Subject to these conditions: (i) the Eligible Entrant who submitted the Photo in the winning Finalist Photo and Associated Caption will win $3,000 (the "Photo Prize"); and (ii) the Eligible Entrant who submitted the Associated Caption in the winning Finalist Photo and Associated Caption will win $2,000 (the "Caption Prize") . (If the same Eligible Entrant submitted both the Photo and the Associated Caption in the winning Finalist Photo and Associated Caption, they will win both the Photo Prize and the Caption Prize.) 34. If the entrant who submitted the Photo in the winning Finalist Photo and Associated Caption: (i) was not an Eligible Entrant or cannot be contacted by 6/11/12; or (ii) their Photo did not comply with these conditions, the Photo Prize will be awarded to the Eligible Entrant who, in a valid entry, submitted the Photo in the Finalist Photo and Associated Caption that is judged to be the next best Photo according to the Judging Criterion. 35. If the entrant who submitted the Caption in the winning Finalist Photo and Associated Caption: (i) was not an Eligible Entrant or cannot be contacted by 6/11/12; or (ii) their Caption did not comply with these conditions, the Photo Prize will be awarded to the Eligible Entrant who, in a valid entry, submitted the Caption in the Finalist Photo and Associated Caption that is judged to be the next best Caption according to the Judging Criterion. 36. The Photo in the winning Finalist Photo and Associated Caption may be featured on a limited edition SCHMACKOS pack during 2013. WINNER 37. The winner(s) will be notified by email. The notification may include instructions as to how the winner(s) is/are to claim their Prize and establish their entitlement to it. 38. In order to be entitled to a Prize, the winner must, if requested by the Promoter, agree to and sign: (i) an eligibility form confirming their compliance with the Conditions and eligibility to accept the Prize; and (ii) a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Promotion. A winner who does not comply with this condition forfeits their Prize. GENERAL 39. If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion. 40. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Promotion (whether as a result of one of the foregoing causes or otherwise). 41. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING. 42. All of the Promoter's decisions are final and no correspondence will be entered into. 43. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Promotion. Entrants should obtain independent tax and financial advice. 44. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Promotion or prize, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant's rights under the Competition and Consumer Act 2010. 45. Each winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media and any jurisdiction at any time or times without remuneration for the purpose of promoting this Promotion, the Promoter and/or any of the Promoter's products. 46. Each entrant who submits a Photo Upload Entry consents to the Promoter publishing the Photo included in their entry in any media and any jurisdiction for up to 1 year after the Entry Period without remuneration for the purpose of promoting this Promotion, the Promoter and/or any of the Promoter's products. 47. Each entrant who submits a Caption Upload Entry consents to the Promoter publishing the Caption included in their entry in any media and any jurisdiction for up to 1 year after the Entry Period without remuneration for the purpose of promoting this Promotion, the Promoter and/or any of the Promoter's products. 48. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Promotion and publicise its winners and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner may be provided to others assisting in the conduct of the Promotion, including the Promotion administrator, prize suppliers and deliverers, and to regulatory authorities.
