The Everyday Rewards Week of Winning - Terms & Conditions of Entry

The Everyday Rewards Week of Winning (the "Promotion") is a promotion conducted under the Other Benefits component of the Everyday Rewards Program.

1. Information on how to enter the Promotion and a description of the prizes that may be won in the Promotion form part of these Terms & Conditions of Entry. Participation in the Promotion constitutes acceptance of these Terms & Conditions of Entry. Entries not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify any Cardholder from the Promotion if any entries do not comply with these Terms & Conditions of Entry.

2. The Promotion is open to all Members who have registered for the Everyday Rewards Program. Entry into the Promotion is free.  Directors, management and employees of Salmat Digital Pty Ltd and its agencies directly associated with this Promotion are ineligible to enter.
These Terms & Conditions of Entry will be displayed at everydayrewards.com.au at the commencement of the Promotion.

3. Definitions within this Promotion:
Card - means an Everyday Rewards Card issued by the Promoter as part of the Everyday Rewards Program.
Cardholder - means a person who holds an Everyday Rewards Card, and who is Registered according to the Everyday Rewards Program database. 
Promoter - Woolworths Limited ABN 88 000 014 675 of 1 Woolworths Way, Bella Vista, NSW, 2153.
Promotion - means The Everyday Rewards Week of Winning promotion governed by these Terms & Conditions of Entry and conducted as a promotion under the Other Benefits component of the Everyday Rewards Program.
Promotional Period - means 10.00am AEST on Sunday 2 September 2012 to 23.59pm AEST on Sunday 9 September 2012.
Registered - means that all mandatory Cardholder information has been correctly completed in the legal name of the Cardholder, according to the Everyday Rewards database.

4. The Promotion commences at 10.00am AEST on Sunday 2 September 2012 & entries close 23.59pm AEST on Sunday 9 September 2012. (“Promotion Period”).

5. To enter the Promotion, click on the link in the Everyday Rewards Week of Winning email or enter your registered Everyday Rewards card number in the field on the entry page each day during promotional period. One entry will be recorded for each registered Everyday Rewards cardholder per day.

6. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

7. Each daily Prize winner will be determined by an automated random draw of all valid entries received by the Promoter in the entry period for that daily Prize draw. Prize draws will take place at 9:00am AEST respectively at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney, NSW 2060 as per the table below. Relevant draw close times and dates and draw dates are as follows.

Each entry is valid for one daily Prize Draw only and non-winning entries will not roll into remaining daily draws.

8. If a member enters the draw on the 7th day, all of their previous daily entries will be entered into the draw for the 7th day (Final Daily Draw) as bonus entries. Entrants who only enter on days 1-6 will only receive entries for the day they entered. Members must enter on the 7th day to be eligible to go into the draw for the Final Daily Prize. The maximum number of entries per Everyday Rewards member for the final day prize draw is 7.

9.  The first valid entries drawn from each lot of daily entries will win the daily Prize/s. Each daily Prize winner/s will be contacted by phone or email within 2 days of the draw, and in writing within 7 days of the draw. All Winners whose prize is valued at over $250 will have their names and state published in The Australian newspaper on Thursday 13 September 2012. All winners will have their name published on the Everyday Rewards website within 2 days of the daily draws. If any winning entry is invalid, that entry will be discarded and the daily Prize will be awarded by randomly drawing another entry in accordance with these Terms and Conditions of entry.

10. Daily prizes, with the exception of the 7th day prize (Final Daily Prize) will be awarded randomly at each draw, to the total of 225 prizes over days 1-6, plus 1 prize on day 7. Winners will be notified of which prize they have won at the time of notification as listed in clause 9.

11. There will be a total of 226 prizes. The Total Prize pool value is $83 690

Final daily prize (Day 7)
The final daily prize (Day 7) is a Holden Cruz CD Automatic Hatch valued at $21 990. Prize includes: all on road costs, registration, comprehensive 12 months insurance from Woolworths Insurance up to the value of $1700 subject to insurance terms and conditions and eligibility, dealer delivery costs and prestige paint.  Any additional optional extras are the responsibility of the winner. Prize is not exchangeable and cannot be redeemed for cash. Collection of the prize is the responsibility of the winner and the winner should allow 28 days from prize draw for availability of their prize. The promoter will negotiate a date and time suitable for collection of the prize. The promoter will advise the location that the vehicle will need to be collected from. If the winner is unable to register the vehicle in their name they are to nominate another person who agrees to have the vehicle registered in their name.

The winner should look to the manufacturer of products awarded as prizes for all warranties.

Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.

If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent/guardian on their behalf.

Prize is not exchangeable & cannot be taken as cash.

13. If a winner does not claim their prize within 3 months from the date and time of determination of that winner, their entry will be deemed invalid and the Promoter may conduct such further draws at the same place as the original draws as are necessary, subject to regulatory authority. The unclaimed prize draw will take place at 12:00 noon AEDST on Monday 10 December 2012 at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060. In the event of an Unclaimed Prize Draw, the prize winners will be contacted by phone within 2 days of the draw and in writing within 7 days of the draw. All prize Winners whose prize value is over $250 will have their names and state published in The Australian newspaper on Monday 17 December 2012.

14. The Promoter accepts no responsibility for any tax implications that may arise from winning of the prizes.  Independent financial advice should be sought.

15   The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize     delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

16 Entries must be received within the entry period times and dates as outlined in clause 7. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.

17 Any entry that is made on behalf of an Entrant by a third party will be invalid.

18 Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

19 In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

20 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

21 If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.

22 Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

23 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

24 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

25. The Promoter reserves the right to disqualify all entries from any Cardholder who is in breach of the Terms & Conditions of Entry or the Terms and Conditions of the Everyday Rewards Program, or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the Promotion.

26. The Promoter and its agencies and companies associated with this Promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person's negligence) relating to the Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law). The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

27. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. The Promoter, Salmat Digital Pty Limited and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

28. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

29. Salmat Digital Pty Limited, on behalf of The Promoter, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat Digital Pty Limited for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.

30 Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.

31. The Promoter may use any personal information that a Cardholder has provided to it as part of the Everyday Rewards Program for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. For purposes of public statements and advertisements the Promoter will only publish the winner’s first initial, surname and state.  The Promoter may disclose the information for those purposes to its related bodies corporate and contractors. Unless the Cardholder has opted-out of communication within their Registration, the Promoter may use personal information a Cardholder has provided to send the Cardholder information about Woolworths' products and services (including via electronic means), and may disclose the information to its related bodies corporate, agencies and contractors (including call centers, advertising agencies and direct mail houses) the Promoter engages for that purpose.  In most cases you can gain access to your personal information by contacting the General Manager Corporate Services, Woolworths Limited, PO Box Q70, QVB, Post Shop Sydney 1230 or phone the Woolworths  Privacy Helpline  on 1300 134 802.  The Promoter is bound by the National Privacy Principles contained in the Privacy Act (Cth) 1988.  A copy of the Promoter's privacy policy can be viewed at the Website.  To request access to, or to update, personal information the Promoter holds about them, entrants can contact the Promoter in writing at Everyday Rewards, PO Box 8000, Baulkham Hills NSW 2153.

32. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.

22 Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

23 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

24 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

25. The Promoter reserves the right to disqualify all entries from any Cardholder who is in breach of the Terms & Conditions of Entry or the Terms and Conditions of the Everyday Rewards Program, or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the Promotion.

26. The Promoter and its agencies and companies associated with this Promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person's negligence) relating to the Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law). The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

27. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. The Promoter, Salmat Digital Pty Limited and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

28. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

29. Salmat Digital Pty Limited, on behalf of The Promoter, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat Digital Pty Limited for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.

30 Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.

31. The Promoter may use any personal information that a Cardholder has provided to it as part of the Everyday Rewards Program for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. For purposes of public statements and advertisements the Promoter will only publish the winner’s first initial, surname and state.  The Promoter may disclose the information for those purposes to its related bodies corporate and contractors. Unless the Cardholder has opted-out of communication within their Registration, the Promoter may use personal information a Cardholder has provided to send the Cardholder information about Woolworths' products and services (including via electronic means), and may disclose the information to its related bodies corporate, agencies and contractors (including call centers, advertising agencies and direct mail houses) the Promoter engages for that purpose.  In most cases you can gain access to your personal information by contacting the General Manager Corporate Services, Woolworths Limited, PO Box Q70, QVB, Post Shop Sydney 1230 or phone the Woolworths  Privacy Helpline  on 1300 134 802.  The Promoter is bound by the National Privacy Principles contained in the Privacy Act (Cth) 1988.  A copy of the Promoter's privacy policy can be viewed at the Website.  To request access to, or to update, personal information the Promoter holds about them, entrants can contact the Promoter in writing at Everyday Rewards, PO Box 8000, Baulkham Hills NSW 2153.

32. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.
