TERMS AND CONDITIONS 1. Information regarding prizes and instructions on how to participate in this promotion form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Nothing in these Terms and Conditions restricts, excludes, modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). 2. Entry is only open to Australian residents aged 18 years or over. Employees, directors and officers of the Promoter and agencies associated with this promotion (and each of their immediate families) are ineligible to enter. 3. Promotion commences at 12.01am on 03/09/12 and ends at 11.59pm on 30/09/2012 (“Promotional Period”). 4. To enter, during the Promotional Period, entrants must: a) visit the CHUX® Facebook page at www.facebook.com/chuxproducts,‘Like’ the page; and b) fully complete and submit an entry form found on the Facebook page, including your nominee (see condition 5) and providing requested contact details (including telephone and email address and an Australian residential address) as well as an original answer, in 25 words or less on “why your nominee would benefit from some extra colour in their life". 5. Entrants may nominate an area of the local community or the home of a friend, a family member or acquaintance to receive a ‘colour refresh’; including a colour consultation from Chux Collections ambassador and international colour expert, Chris Brazel (as described in condition 10). An area of the local community can include, but is not exclusive to a sports club, an aged care home, a school or a community centre. The nominated area/property must be privately-owned and the entrant must get the consent of the nominee to participate in the promotion and undergo a colour refresh. 6. The Promoter’s judging panel will review all valid entries received during the Promotion Period and each entry will be individually judged based on originality and creative merit. This is a game of skill and chance plays no part in determining the winners. 7. Subject to condition 11, the valid entry judged to be the best entry will win the major prize, being a colour consultation and ‘colour refresh’ for their nominated area/property from Chux Collections ambassador and international colour expert, Chris Brazel, valued at up to $5,000 (further described in condition 10), and $1,000 worth of Bunnings vouchers for themselves. 8. The two valid entries judged to be the next best entries (i.e. the second and third best entries) will each win a runners-up prize, being $1,000 worth of Bunnings vouchers for their nominee, and $500 worth of Bunnings vouchers for themselves. 7336790/1A 9. Vouchers are subject to expiry and any terms and conditions imposed by the supplier. 10. For the major prize, Chris Brazel will: a) complete a colour consultation for the winning nominated area/property in person or remotely (at the discretion of the Promoter) e.g. with photos and/or Skype, dependent on the location of the winning nomination ; and b) recommend and source materials for, and complete a colour refresh for the winning nomination in agreement with the nominee contact’s wishes, either personally or, with advanced agreement from the nominee contact, with the help of a small team of volunteers. 11. It is a condition of being eligible to receive a prize that the nominees of entrants selected as winners agree to: a) the same terms and conditions set out in this document; b) for the major prize, allow and facilitate prize fulfilment within 30 days of notification of the winner; and c) before and after photos from the Chux Collections ‘colour refresh’ being used in Chux publicity and media materials. The Promoter can do what it deems necessary to satisfy itself that such agreement has been obtained. If agreement cannot be obtained from nominees, the relevant entry will be deemed not to comply with these Terms and Conditions, the entrant and nominee will not be entitled to receive a prize and a new winner will be selected. 12. The major prize winning entrant and nominee, and the two runner up prize winning entrants will be notified by phone or email by close of business on 01/10/2012. The winning entrants’ and nominees’ names may also be published on Facebook at www.facebook.com/chuxproducts, and the entrants and nominees consent to such publication. 13. Entries must be received during the Promotional Period and each entrant may only enter once. Multiple entries are not permitted. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. 14. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including the entrant’s identity, age and place of residence) and to disqualify any entrant who the Promoter believes has submitted an entry that is not in accordance with these Terms and Conditions or has tampered with or manipulated the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Identification considered suitable for verification is at the Promoter’s discretion. Entrants who enter using multiple email addresses or aliases may be disqualified. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 15. Incomplete or indecipherable entry forms will be deemed invalid. The Promoter’s decision in relation to all aspects of this promotion is final and no correspondence will be entered into. Unless otherwise agreed, entrant prizes will be sent to the winners’ Australian residential addresses, as specified on their entry form within 28 days of emailing notification to each winner. The Promoter will contact the major prize 7336790/1A winning nominee by sourcing contact details or using contact details as specified by the entrant during entry, to arrange prize fulfilment within 30 days of winner notification. 16. Entrants are providing their information to the Promoter and not to Facebook. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook and entrants completely release Facebook from any and all liability in connection with this promotion. 17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to by reason of infection by computer virus, network failure, bugs, tampering with or manipulation of the entry process or conduct of the promotion, unauthorised intervention, fraud, technical failures) the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to terminate, modify, cancel or suspend the promotion, or invalidate any affected entries, as appropriate. 18. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter their details and enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 19. If an entry is deemed by the Promoter not to comply with these Terms and Conditions, the entry will be discarded and the entrant will not receive a communication in this regard. No correspondence will be entered into. All entries become the property of the Promoter. In the event of a prize not being accepted or claimed, the judges will select an alternate winner with the entry judged to be the next best entry to receive that prize. 20. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. 21. Once the prizes have left the Promoter’s/supplier’s premises, the Promoter and its agencies and companies associated with the promotion will not be responsible for any delay in delivery, loss or damage to that prize. Prizes are not transferable or exchangeable and cannot be redeemed for cash. In the event for any reason a winner does not take the prize, when specified by the Promoter, then the prize will be forfeited by the winner and cash will not be supplied in lieu of the prize. Where a prize is unavailable for any reason, the Promoter may substitute the prize for a prize of equal or higher value and/or specifications, as determined by the Promoter. 22. The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, incomplete, incorrectly submitted, delayed, corrupted, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (including but not limited to entrant error or omission, alteration, tampering, deletion, theft, destruction, transmission interruption or communications failure); or (d) any tax liability incurred by an entrant; except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 7336790/1A 23.
