Terms & Conditions
Participation
This Promotion is conducted by Virgin Mobile (Australia) Pty Limited (ABN 67 092 726 442) of Level 8, 213 Miller Street, North Sydney, NSW 2060, phone: 02 9028 0173 ("Promoter").
Entry into the Promotion constitutes acceptance of these Terms & Conditions. All entry instructions and Prize information published by the Promoter form part of these Terms & Conditions.
This is a game of skill and chance plays no part in determining the winners. All entries will be individually judged based on the originality and creative merit of the answer provided to the promotional question. The Promoter's decision in relation to all aspects of this promotion is final and no correspondence will be entered into.
Subject to Clause 6, the Promotion is only open to individuals who are:
a resident of Australia;
aged 18 years or older as at the time of entry into the Promotion;
available to travel to Melbourne, VIC from 3 November 2012 to 7 November 2012 and accept the Prize during the time period specified in the Terms and Conditions in clause 25; and
either an existing Virgin Mobile customer (and the specified account holder) or a Facebook friend of an existing Virgin Mobile customer who can participate in the Prize with them as specified (if they are drawn as a winner)
("Eligible Entrant").
The following individuals are ineligible to enter:
employees of the Promoter or any of its related corporations or any of their agencies, printers, suppliers, providers or participating retailers who are associated with the Promotion;
the spouse, de facto spouse, ex-spouse, de-facto spouse, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew child/ step-child or sibling (whether natural or by adoption), step-brother, step-sister or 1st cousin of any person outlined in Clause 6a;
persons who the Promoter has previously notified as not being permitted to enter the Promoter's competitions or promotions; and
Virgin Mobile Australia customers who have Ported their number to another carrier (transferred their number to another carrier), transferred their service into someone else's name or whose service has been cancelled either by the customer or Virgin Mobile Australia as at the time of the draw.
The Promotion commences at 10:00 Australian Eastern Standard Time ("AEST") on 10 September 2012 and closes at 15:00 Australian Eastern Daylight Savings Time ("AEDST") on 8 October 2012 ("Promotional Period").
In order to enter and participate in the Promotion, any Eligible Entrant who is not an existing Virgin Mobile customer must be a member of the social networking website Facebook. If they are not a member of Facebook, the Eligible Entrant must visit www.facebook.com, and in accordance with Facebook's directions, correctly sign up to Facebook. Facebook's terms of use will apply to the Eligible Entrant's Facebook membership. At the time of signing up, the Eligible Entrant will be required to create their own Facebook profile.
Entry
If an Eligible Entrant uses mobile Internet either on a Mobile phone or another internet enabled device to participate in the Promotion, then the Entrant must be identified as the account holder of the end mobile/internet device. Accessing mobile content including web-based content may incur data charges. Eligible Entrant's will need to refer to the terms of their service provider and plan for details and costs. Any charges will then be charged as per the terms and conditions of the provider. All general queries relating to mobile bills should be directed to the Eligible Entrant's service provider.
To enter, Eligible Entrants must complete the entry mechanic below that applies to them during the Promotional Period:
Entry Method A: Customer Entry (Entry via this method is only open to Eligible Entrants who are an existing Virgin Mobile Australia customer):
visit www.fairgobro.com.au ("Website");
navigate to the "Make Me a Star" page";
confirm they are an existing Virgin Mobile Australia Customer;
accept the Terms and Conditions by ticking the check box;
follow the prompts on the Promotion entry form and input the requested personal details (including their full name, a valid email address and Virgin Mobile Service number);
provide an answer to the promotion question "Tell us in 25 words or less what your ludicrous request would be for your chance to win?; and
g) submit the fully completed entry form so it is received by 15:00 AEDST on 8 October 2012.

Entry Method B: Customer Friend Entry (Entry via this method is only open to Eligible Entrants who: i) are Facebook friends with an existing Virgin Mobile Australia customer at the time of entry, ii) have received consent from their Facebook friend to use their friend's personal details in order to enter this Promotion, and iii) have obtained consent/agreement from their nominated Facebook friend that the friend will participate in the Prize with them as required if the Eligible Entrant is drawn as a winner):
visit the Website;
enter via the "Make Me a Star" page;
select that they are not an existing Virgin Mobile Australia customer;
accept the Terms and Conditions by ticking the check box;
allow Facebook Connect permission to access their basic information;
tag a Virgin Mobile Australia customer from their Facebook friend list ("Friend"), enter that nominated Friend's Virgin Mobile Customer's Mobile Service number and tick the check box confirming that they have obtained permission from their nominated Friend to use their personal details to enter this Promotion;
follow the prompts on the Promotion entry form and input their requested personal details (including their full name, a valid email address and mobile telephone number);
provide an answer to the promotional question "question "Tell us in 25 words or less what your ludicrous request would be for your chance to win?; and
submit the fully completed entry form so it is received by 15:00 AEDST on 8 October 2012.
Incomplete, indecipherable or illegible entries will be deemed invalid and will not constitute an eligible entry.
Only one (1) entry permitted per Eligible Entrant per Judging Period. Additional or duplicate entries received from an Eligible Entrant during a Judging Period will be marked invalid and only the first eligible entry received during that Judging Period will be judged. Each entry submitted by an Eligible Entrant must be unique. All entries must be submitted in accordance with the Terms and Conditions.
If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
"Virgin Mobile Australia" may communicate messages to Eligible Entrants via Facebook, where applicable. The number of messages will be determined by the Promoter in its absolute sole discretion.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant's identity, age, place of residence or relationship to Virgin Mobile Australia or an existing customer of Virgin Mobile Australia) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, that winner will forfeit their Prize in whole and no substitute will be offered.
Any entry that is made on behalf of an Eligible Entrant by a third party, or otherwise by proxy will be invalid.
There will be twelve (12) Winners judged ("Winners").
The entries received during the Promotional Period will be entered into one (1) of four (4) "Judging Periods", depending on the date the entry is received. Entries into each Judging Period will open and close on the dates/times outlined in the table below. The entries received during each Judging Period will be judged in accordance with the criteria outlined in clause 3, and a prize will be awarded to the three (3) entrants who submit the best valid entry (as determined by the judges) in each Judging Period. The Promoter may select additional reserve entries which it deems to be the next best and record them in order in case an invalid entry or ineligible entrant is selected as a provisional winner. Winners will be notified in writing by email and by telephone.

If an Eligible Entrant has entered via the Entry Method B: Customer Friend Entry mechanic, the Promoter reserves the right to disqualify this entry if it is determined that the Friend does not meet the eligibility criteria outlined in Clause 4 (including in relation to the Friend's identity, age, place of residence or relationship to Virgin Mobile Australia).
If an Eligible Entrant has entered via the Entry Method B: Customer Friend Entry mechanic, the Eligible Entrant and their Friend will each be contacted by telephone to determine their relationship and confirm their acceptance of the Prize before being the Prize is awarded. If either the Eligible Entrant or Fiend do not accept the Prize, then the Prize will be forfeited and awarded to the valid Eligible Entrant with the next best entry (as determined by the judges) from that Judging Period.
The Promoter's decision is final and no correspondence will be entered into.
Prize
The three (3) valid entries deemed to be the best (as determined by the judges) in each Judging Period will each win a trip for two (2) adults to the Virgin Mobile Australia Winning Post Marquee at the 2012 Melbourne Cup, valued up to $20,000 depending on point of departure ("Prize"). If a winning Eligible Entrant entered the Promotion via Entry Method A: Customer Entry, they can nominate any individual aged 18 years or over to accompany them. If a winning Eligible Entrant entered the Promotion via Entry Method B: Customer Friend Entry, they must be accompanied by the existing Virgin Mobile customer, who is aged 18 years or over, that (i.e. the Friend) they listed at the time of entry. Each Prize includes:
accommodation for two (2) adults at The Grand Hyatt Melbourne for four (4) nights, with check-in on 3 November 2012 and checkout on 7 November 2012,;
four (4) breakfasts for each adult (on a set menu determined by the Promoter);
access for two (2) adults to the exclusive Virgin Mobile Australia Winning Post Marquee on 6 November 2012; and
additional activities (to be determined by the Promoter), additional meals (to be determined by the Promoter), additional transfers (to be determined by the Promoter) and gifts (to be determined by the Promoter) for two (2) adults, valued up to $10,000;
If the winner is from NSW, TAS, SA, NT, ACT, QLD or WA, the Prize will also include:
return Business Class flights via Virgin Australia for two (2) adults from the winner's nearest capital city to Melbourne Tullamarine Airport (including flight taxes and surcharges). Business Class flights are subject to availability. Whilst every effort will be made to provide Business Class flights, in order to meet required arrival times, some winners and companions may need to fly Economy. For the avoidance of doubt, winners or companions who are required to fly Economy will not be compensated; and
return airport transfers for two (2) adults from the Melbourne airport to the accommodation;
If a winner is from VIC, then the Prize does not include airfares or airport transfers and the airfare and airport transfer component of the Prize is forfeited and not redeemable for cash.
Prize must be taken from 3 November 2012 to 7 November 2012 and is subject to booking and flight availability.
Winners must ensure that their nominated travel companion has consented to these Terms and Conditions.
Entry into the Flemington Racecourse and the Virgin Mobile Australia Winning Post Marquee is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication or inappropriate behaviour, whilst participating in any element of the Prize.
Once successfully contacted by the Promoter, the winning Eligible Entrants will have 72 hours from the time they are contacted to confirm their acceptance of the Prize by completing the registration survey provided and supplying all required documentation (including their full name, date of birth and proof of age documents for themselves and to supply full name, contact details and proof of age documents for their nominated companion, or in the case of a Customer Friend Entry winner, their listed Friend).
Once successfully contacted by the Promoter, the winner's nominated companion (or in the case of a Customer Friend Entry winner, their listed Friend) will have 72 hours from the time the they are contacted to confirm their acceptance of the Prize by completing the registration survey provided and supplying all required documentation (including their full name, date of birth and proof of age documents).
In the event that a winner and their nominated companion do not complete the required documentation (as outlined above) within the specified period of time, they will forfeit the Prize, and the entry deemed to be the next best (as determined by the judges) from that Judging Period will be contacted and offered the Prize.
An Eligible Entrant will not be deemed to be a valid winner until all disclaimers, waivers and any other relevant documentation has been supplied to Virgin Mobile.
As a condition of accepting the Prize, Eligible Entrants and their nominated companions consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media, including radio, for an unlimited period without remuneration for the purpose of promoting this competition, and promoting any products manufactured, distributed and/or supplied by the Promoter.
If for any reason a winner does not take a Prize (or an element of a Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.
If any winner cannot be contacted despite every reasonable effort made by the Promoter by 10:00 AEDST on 12 October 2012, their Prize will be deemed unclaimed. The Promoter may award any unclaimed Prizes from a Judging Period to the Eligible Entrant who submitted the next best valid entry (as determined by the judges) during the corresponding Judging Period.
If any Prize (or part of any Prize) is unavailable, the Promoter, in its sole discretion, reserves the right to substitute the Prize (or part of the Prize) with another prize to the equal value and/or specification.
The total prize pool for this Promotion is valued at a maximum of up to $255,361.01
Prizes, or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash.
It is a condition of accepting a Prize that each winner must comply with all of the conditions of use of a Prize and any Prize supplier requirements.
The winners and their companions are responsible for any additional expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the Prize), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances, however any such insurance must be paid for by the winner and their companion, as incurred.
A credit card imprint or cash deposit will be required from the winner at accommodation check-in for all incidental charges. Once accommodation is booked, it is non-changeable.
The winners and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure and on their return from the airport to their residence.
Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city airport and their current flight schedule. Frequent Flyer points are not available from any airline.
It is the traveller's personal responsibility to ensure that they have valid documentation, which meet the requirements of government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend or modify a Prize, subject to any written direction from a relevant regulatory authority.
Prize winners and the companions of the prize winners must comply with all Terms and Conditions as stated for entry into Flemington Racecourse (as found at www.flemington.com.au) in order for the prize winner and their guests to gain entry to the Flemington Racecourse grounds.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Website is the Eligible Entrant's responsibility and is dependent on the Internet or Mobile Service Provider used.
All entries (which shall include answers to the promotional questions and comments) submitted become the property of the Promoter. Entries will not be returned to any entrant. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome).
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
The Promoter assumes no responsibility for: (i) any technical or electrical issues that may arise in connection with the Promotion (whether or not under the Promoter's control), including with any third party platform such as on Facebook; (ii) any incorrect or incomplete information which may be communicated in the course of the administering this Promotion; (iii) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (iv) any variation in Prize value to that stated in these Terms and Conditions; (v) if the Promotion is cancelled, terminated, modified or suspended; and/or (vi) any tax liability incurred by a winner or Eligible Entrant. Individuals should obtain independent tax and financial advice; or (vii) taking of/participating in the Prize. The Promoter does not guarantee that Facebook will be available at all times during the Promotional Period or that the Eligible Entrant will be able to access or use the Facebook services during the Promotional Period, and the Promoter will not be held responsible in this regard. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
It is a condition of accepting a Prize that each winner and their companion sign a participation agreement in a form determined by the Promoter.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. Eligible Entrants should direct any request to access, opt-out, update or correct information to the Promoter. All entries become the property of the Promoter. Entry and continued participation in the Promotion is dependent on Eligible Entrants entering through Facebook Connect following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. It is the Entrant's responsibility to comply with Facebook's term of use policies. Eligible Entrants understand that they are providing their information to the Promoter and not to Facebook. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an Eligible Entrant, as a result of participating in this Promotion (including taking/use of a Prize), except for any liability which cannot be excluded by law.
