It doesn’t matter if your backyard is an outback farm, a suburban veggie patch or an apartment balcony. We want to know – how does your backyard grow?! If you are between 8 and 16 years old, get your cameras out and start looking around your backyard. You can enter a photo or a short video (<2 mins) and show everyone what is unique about your backyard and local environment. Need some ideas? Have a look at these suggestions and then get your thinking caps on! A thriving herb garden that is used in the family’s cooking every day A community garden where neighbours grow and share their produce A garden that has been hit by floods and is in the process of rehabilitation A prized bed of roses that requires lots of maintenance and care A backyard lemon tree that has been in the family for three generations The challenges posed by snails and bugs that live in the veggie patch The list goes on… be creative! TERMS & CONDITIONS Terms and Conditions 1. The Promoter is Landcare Australia Limited (ABN 63 008 656 513), Level 1, 6 Help St, Chatswood, NSW 2067 2. Entry instructions and prize information form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions. Competition Entry 3. Entry is only open to: Individuals and families with individuals aged 8 – 16 years at the time of registration. Primary and Secondary schools located within Australia, including out of school centres, day care centres, preschool, public and private primary and high schools. To be eligible, the majority of students must be aged between 8 – 16 years at the time of registration. Teachers can register an entire school, particular class or group (such as a school environment group). Groups or organisations (including commercial and not-for-profit) within Australia where the majority of those participating are aged between 8 – 16 years at the time of registration. 4. Each registrant must have a unique email address. 5. Promoter’s decisions are final, and no correspondence will be entered into. 6. Entries open Monday 10th September and close no later than Friday 16th November at 5pm EST. 7. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonablecontrol of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 8. The Promoter accepts no responsibility for late, lost or misdirected entries. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of an entrant. 10. The Promoter assumes no responsibility for any error, defect, delay, theft or unauthorised access to or alteration of entries. Subject to any written directions given under the applicable law, if for any reason, the competition is not capable of operating as planned, including infection by computer viruses, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, or properconduct of the competition, then the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this competition. The Promoter reserves the right, in its sole discretion, to disqualify any individual. Prizes 11. Prizes will be awarded to the winner in each of the four categories – Photo 8 – 11 years; Photo 12 – 16 years; Video 8 – 11 years; and Video 12 – 16 years. 12. As the winners entered as individuals will be under 18 years of age, the prize will be awarded to his/her parent or guardian. For school or group entries, the prize will be awarded to the individual whose name appears on the registration form, who will accept the prize on behalf of the school or group. 13. If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash. 14. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of prize) with a prize to the equal value and/or specification, subject to any written directions from the regulatoryauthority. 15. The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise contact details provided by an entrant. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered asprizes. Intellectual Property and Privacy 16. Ownership (including intellectual property rights) in all entries (including text, photos and videos) are assigned to the Promoter upon submission and remain the property of the Promoter. 17. Participants consent to the Promoter using the participant’s name, likeness, image and/or voice in the event that they are a winner (including a photograph, film, file and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), Junior Landcare and Landcare Australia. 18. It is the sole responsibility of the entrant to ensure that the people who appear in their photo/video have given permission to be included. The Promoter bears no responsibility if entries contain images of people (including children) that have not given their permission to be photographed or recorded. Judging Criteria 19. The entries are judged on creativity, presentation, and by demonstrating they have thought of the following questions: why is your backyard unique; what environmentalissues impact on how it grows; and how do these environmental issues occur? Using this Website 20. Any costs associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall render an entry invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 21. The Promoter shall not be liable for any loss or damage suffered or sustained (including but not limited to consequential loss, loss of revenue, loss of profit or economic loss), including for personal injury or property damage suffered or sustained, as a result of accepting any prize or participation in any competition or prize,except for any liability which cannot be excluded by law. 22.
