“HEAD AND SHOULDERS SAMPLE” PROMOTION
TERMS AND CONDITIONS
1. Information on how to claim and the reward form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these Terms
and Conditions.
2. Claims are open to Australian residents only. Employees (and their immediate
families) of the Promoter, and agencies associated with this promotion are
ineligible to enter. Immediate family means any of the following: spouse, exspouse, de-facto spouse, child or step-child (whether natural or by adoption),
parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew,
brother, sister, step-brother, step-sister or 1

cousin.
3. Promotion commences on Friday 7
th
September 2012 and ends on Friday 30
th
November 2012 or once a total of 40,000 valid claims have been received,
whichever is first to occur (“Promotional Period”).
4. To be eligible to claim, the participant must enter all of their details into the
mandatory fields in the registration form at www.rougemag.com.au and then
submit the competed registration form during the Promotional Period. The
participant agrees to become a member of rougemag.com.au as part of this
promotion.
5. The first 40,000 valid claims will each receive a Head and Shoulder sample.
6. There is a strict limit of one Head and Shoulders sample per person during the
Promotional Period. Offer is strictly limited to the first 40,000 valid claims
received.
7. Successful claimants will be notified immediately online (upon claim submission).
Delivery of samples will occur within 28 days of claim submission.
8. There is no cash alternative to the samples. The samples are non-refundable
and non-transferrable and cannot be exchanged by the claimants for an
alternative reward.
9. The Promoter will not be liable for any samples that do not reach the successful
claimants for reasons beyond the Promoter's reasonable control.
10. Promoter’s decision is final and no correspondence will be entered into.
11. Claims will be deemed to be made at the time of receipt of claim by the Promoter
or its contractors and not at the time of its transmission by the claimant.
Incomplete or incomprehensible claims will be deemed invalid. The Promoter and
its contractors accept no responsibility for late, lost or misdirected claims.
12. The Promoter reserves the right, at any time, to verify the validity of claims and
claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these
Terms and Conditions or who tampers with the claim process. Errors and
omissions may be accepted at the Promoter's discretion. Failure by the Promoter
to enforce any of its rights at any stage does not constitute a waiver of those
rights.
13. Incomplete or indecipherable claims will be deemed invalid.
14. If there is a dispute as to the identity of a claimant, the Promoter reserves the
right, in its sole discretion, to determine the identity of the claimant.
15. Total value of the rewards in this promotion is AUD $20,000.
16. If for any reason a claimant does not take the reward by the time stipulated by
the Promoter, then the reward will be forfeited.
17. If any reward is unavailable, the Promoter, in its discretion, reserves the right to
substitute the reward with a reward to the equal value and/or specification,
subject to any written directions from a regulatory authority.
18. If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the reasonable
control of the Promoter, the Promoter reserves the right, in its sole discretion, to
the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to
any written directions from a regulatory authority, to modify, suspend, terminate
or cancel the promotion, as appropriate. The Promoter’s legal rights to recover
damages or other compensation in relation to any such interference are
reserved.
19. The use of any automated claim software or any other mechanical or electronic
means that allows a claimant to automatically claim repeatedly is prohibited and
will render all claims submitted by that claimant invalid.
20. Except for any liability that cannot be excluded by law, the Promoter and any of
their respective employees, officers, contractors and agents (and employees and
officers of their contractors and agents) exclude all liability (including negligence),
for any personal injury; or any loss or damage (including loss of opportunity);
whether direct, indirect, special or consequential, arising in any way out of the
Promotion, including, but not limited to, where arising out of the following: (a) any
technical difficulties or equipment malfunction (whether or not under the
Promoter’s control); (b) any theft, unauthorized access or third party interference;
(c) any claim that is late, lost, altered, damaged or misdirected (whether or not
after their receipt by the Promoter) due to any reason beyond the reasonable
control of the Promoter; (d) any variation in reward value to that stated in these
Terms and Conditions; (e) any issues, outside of the reasonable control of the
Promoter, with postage of the samples and arrival of products to recipients; or (f)
use of a reward.
21. All claims become the property of the Promoter.  By participating in this
promotion, unless otherwise advised by the claimant, each claimant consents to
being entered into one or more databases by the Promoter's contractors and the Promoter and its contractors may use the Provided Information, for an indefinite
period unless otherwise advised by the claimant, for the conduct of this
promotion (including disclosing Provided Information to third parties, including but
not limited to agents, contractors, service providers, offer suppliers and as
required, to Australian regulatory authorities) and in any media or form of
communication to the claimant for future promotional, marketing and publicity
purposes of the Promoter including sending electronic messages to the entrant
or telephoning the entrant. Entry is conditional on providing Provided Information.
The Promoter and its contractors may disclose any or all of the Provided
Information, including personal details, to its other contractors and related
companies in the Procter & Gamble groups (some of which may be outside
Australia) and may authorise those contractors and related companies to use it
for similar purpose.  The Promoter and its contractors may use the Provided
Information or authorise its use without any further reference, payment or other
compensation to the claimant. Claimants have the right to access and correct
any personal information being held by the Promoter by addressing that request
