CONDITIONS OF ENTRY – $10,000 Lunchtime Member Fest MGF Promotion
Promoter: Jupiters Limited ABN 78 010 741 045 trading as Treasury Brisbane, top of the Queen Street Mall, Brisbane QLD 4001 ph (07) 3306 8888 (“Treasury”).
Promotion period
1. The $10,000 Lunchtime Member Fest MGF Promotion (“Promotion”) will be held at Treasury commencing at 11.00am on Wednesday 15th August 2012 and concluding at the end of the final prize draw at 1.30pm on Friday 28th September 2012 (“Promotion Period”). All times are listed in Australian Eastern Standard Time.
2. A total of twenty one (21) prize draws will be drawn at The Main Gaming Floor stage, Level 1 at Treasury (“Draw Location”) during the Promotion Period. Prize Draws will be held at 1.30pm (each a “Prize Draw”) on Wednesday 15, 22, 29 August 2012, Thursday 16, 23, 30 August 2012, Friday 17, 24, 31 August 2012 and Wednesday 5, 12, 19, 26 September 2012, Thursday 6, 13, 20, 27 September 2012 and Friday 7, 14, 21, 28 September 2012 (each a “Draw Day”) with six (6) winners drawn at each Prize Draw.
Entry requirements
3. Participation in the Promotion is open to all persons who:
(a) are 18 years of age or older;
(b) are members of the Absolute Rewards program operated by the Promoter and who have an Absolute Rewards membership card (“Membership Card”); and
(c) are not the subject of an exclusion direction or self exclusion order pursuant to the Casino Control Act 1982 (Qld).
People who meet the above conditions and continue to satisfy the conditions during the Promotion Period are referred to as “Eligible Entrants” and will be entitled to enter the Promotion.
4. The Promoter reserves the right to refuse any person entry in the Promotion.
Entries in a Prize Draw
5. To generate an entry in a Prize Draw (“Prize Draw Entry”) on a Draw Day an Eligible Entrant must swipe his or her current Membership Card at one of the Member Kiosks at the Draw location between 11am and 1.15pm on that Draw Day. Prize Draw Entries will only be included in the Prize Draw on the Draw Day when the Prize Draw Entry is earned.
6. Eligible Entrants are eligible to earn a maximum of one (1) Entry per Draw Day.
Prize Draws
7. Each Prize Draw Entry will be automatically allocated a unique individual entry number using the Casino Management System. The number range programmed into an approved Random Number Generator (“RNG”) will be set for each Prize Draw to include all the entry numbers for Prize Draw Entries included in that Prize Draw.
8. At each Prize Draw, the name and membership number of six (6) Eligible Entrants will be selected by random selection using the relevant entry numbers for that Prize Draw (each a “Selected Entrant”). The name and membership number of each Selected Entrant will be announced at the Draw Location. Selected Entrants must be “present at the Prize Draw” pursuant to Condition 10.
9. The promoter cannot guarantee that announcements can be heard in all parts of the Draw location or throughout the remainder of Treasury.
10. To be deemed “present at the Prize Draw”, the Selected Entrants must present themselves to a Treasury representative at the Draw Location or the Sovereign Room Desk Level 2, within three (3) minutes of their name being announced and provide suitable identification in accordance with Conditions 16 or 17 within five (5) minutes of presenting themselves. The Selected Entrant is not permitted to send a proxy to claim a Prize. Selected Entrants that are “present at the Prize Draw” will be eligible to win a Prize (each a “Winner”). There will be six (6) Winners at each Prize Draw.
11. If a Selected Entrant at a Prize Draw does not satisfy Condition 10 or does not otherwise satisfy these Conditions of Entry, the Promoter will immediately conduct up to three (3) re-draws at the Draw Location if required to find six (6) Selected Entrants who are “present at the Prize Draw”. If after three (3) re-draws, six (6) Selected Entrants who satisfy Condition 10 have not been found, those of the first six (6) Selected Entrants who were drawn at that Prize Draw (but who did not satisfy Condition 10) will make up the required number of Winners (six (6) in total) for that Prize Draw, and those Selected Entrants will not be required to comply with Condition 10 (each a “Default Winner”). To clarify, if after three (3) re-draws no Selected Entrants who satisfy Condition 10 have been found the first six (6) Selected Entrants who were drawn at that Prize Draw will be the Default Winners, or, if after three (3) re-draws only one (1) Selected Entrant who satisfies Condition 10 has been found the first five (5) Selected Entrants who were drawn at that Prize Draw (who are not already a Winner) will be Default Winners, or, if after three (3) re-draws only two (2) Selected
Entrants who satisfy Condition 10 have been found the first four (4) Selected Entrants who were drawn at that Prize Draw (who is not already a Winner) will be a Default Winner.
12. The Promoter will notify Default Winners of their win by telephone or mail in accordance with the details provided on their entry form or member records held by the Promoter and Default Winners will be required to collect their Prize from the Sovereign Room Desk Level 2 and provide identification in accordance with Conditions 16 or 17 at the time of collection.
Prizes
13. At each Prize Draw the following prizes (each a “Prize”) will be awarded to the Winners in the order in which those Winners were drawn and following the awarding of prizes to the Winner/s (if any) any remaining prizes will be awarded to the Default Winners (if any) in the order in which those Default Winners were drawn:
a. First Prize: $2,500 cash and $2,500 Casino Dollars
b. Second Prize: $500 cash and $500 Casino Dollars
c. Third Prize: $500 cash and $500 Casino Dollars
d. Fourth Prize: $500 cash and $500 Casino Dollars
e. Fifth Prize: $500 cash and $500 Casino Dollars
f. Sixth Prize: $500 cash and $500 Casino Dollars
14. The total prize pool for this Promotion is $210,000 being $105,000 cash and $105,000 Casino Dollars.
15. Winners and Default Winners may choose to take the cash Prize in the form of cash or a cheque or a combination of both. Bonus Casino Dollars will be loaded to the winners Casino Dollar balance at the completion of each Prize Draw.
Identification
16. A Selected Entrant must produce valid acceptable identification to a representative of the Promoter to confirm their eligibility to win a prize. Valid identification acceptable to the Promoter will be either one form of valid photographic identification (Passport or Australian driver’s licence) with an undamaged clearly visible photograph, or two other forms of non-photographic identification acceptable to the Promoter. A Selected Entrant (or Default Winner) must also produce their Membership Card to confirm their eligibility to win a prize.
17. The Promoter reserves the right to waive or vary the identification requirements at its sole discretion in circumstances where the identity of a Selected Entrant is determinable by a representative of the Promoter without the assistance of these or any other form of identification.
General
18. Directors, management and employees of the Echo Entertainment Group of companies (including any related body corporate as defined in the Corporations Act 2001) and their immediate families, which has the meaning given to that phrase in the Charitable and Non-Profit Gaming Rule 1999 (Qld) are not eligible to participate in this Promotion. The Echo Entertainment Group comprises, but is not limited to the businesses of The Star, Jupiters Hotel and Casino, Treasury Casino and Hotel and Jupiters Townsville.
19. Prizes must be taken as stated and cannot be exchanged or redeemed for alternate prizes. Any tax liability or implication which attaches to a prize is the responsibility of the Winner or Default Winner claiming that Prize.
20. The Promoter is not responsible for any loss, damage or injury suffered or claimed (including, but not limited to, indirect or consequential loss or damage, personal injury or death, and direct or indirect loss or damage due to negligence or technical or mechanical malfunction) by an entrant in relation to entering or participating in this Promotion or taking or using the prizes offered (except that which cannot be excluded by law) except where that loss, damage or injury was caused by breach of these terms and conditions by the Promoter or the wilful or negligent acts or omissions of the Promoter. To avoid any doubt, the Promoter shall not be liable for loss caused by technical and mechanical malfunction which is outside the control of the Promoter.
23. Conduct of the entire Promotion, including decisions on the eligibility of persons to enter and validity of entry and prizes, shall be the responsibility of, and at the absolute discretion of, the Promoter.
24. To the extent that a situation or issue arises for which these terms and conditions make no provision or in relation to which the relevant terms and conditions are unclear, the Promoter reserves the right to make a decision regarding such situation or issue which is not inconsistent with these terms and conditions in its sole and absolute discretion.
25. While the Promoter intends to conduct the Promotion as offered, the Promoter reserves the right to cancel or change the Promotion or a prize offered in the Promotion if it can no longer continue the Promotion or offer a prize due to circumstances outside the Promoter’s control.
26. The Promoter accepts no responsibility for late or non-received entries. The Promoter does not guarantee the continuous or fault-free operation of the entry processes, including entry validating and receipting processes, during the Promotion. In the event of any technical difficulties with the Kiosk, the Promoter reserves the right to adopt a manual process of generating Entries.
27. Any entrant who tampers, or attempts to tamper, with the entry processes or tampers, or attempts to tamper with the processes used for the draws or who submits an Entry which is not valid in accordance with these terms will be subject to disqualification at the discretion of the Promoter.
28. Winners and Default Winners may be asked to participate in publicity or advertising at the request of the Promoter. Participation in any such publicity or advertising is at the sole discretion of the relevant Selected Entrants (or Default Prize Draw Selected Entrants). The names of Selected Entrants (or Default Prize Draw Selected Entrants) will not be published without their consent except as announced at the Draw Location.
29. Participation in the Promotion indicates acceptance of the terms and conditions governing the Promotion. These terms and conditions will be available at the Absolute Rewards Service Desk Ground and First Floor and Sovereign Room Desk Level 2 throughout the Promotion Period.
30. By participating in this Promotion, each entrant’s Entry/Entries becomes the property of the Promoter and may be used for the Promoter’s business analysis and marketing purposes in accordance with the Promoter’s privacy statement which can be viewed at http://www.treasurybrisbane.com.au. Privacy law allows entrants to access their personal information held by the Promoter in certain circumstances. Failure to supply the personal information requested may result in an entry being deemed invalid.
31. It is the responsibility of all winners to determine if they have won a Prize in this Promotion at the Absolute Rewards Desk or Sovereign Room Desk. Whilst Treasury will use all reasonable endeavours to contact Winners, it is the Winner’s ultimate responsibility to claim their prize.
