How to enter
 
1. To be eligible to enter, individuals must spend $15 or more on any Yates product/s in one transaction from a participating outlet nationally between 9.00am AEST on 17/09/2012 and close of business on 11/11/2012. Participating outlets are all stores which have advertising material for this promotion displayed.
 
2. Eligible entrants must then enter online by visiting www.yates.com.au, follow the prompts to the competition entry page, input the requested details including their full name, residential address, valid email address, daytime telephone number, the store of purchase, and the last four (4) digits from the barcode of one of the Yates products/the Yates product purchased within the $15 or more spend and submit the fully completed entry form, so that it is received by 11.59pm AEDST on 11/11/2012. Entries must be submitted in accordance with these Terms and Conditions to be eligible.
 
Terms and conditions
 
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
 
2. Entry is open to Australian residents only.
 
3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
 
4. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
 
5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
 
6. Incomplete or incomprehensible entries will be deemed invalid.
 
7. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per qualifying purchase transaction; (b) each entry must be submitted separately and in accordance with entry requirements; © limit of four (4) entries per household per day is permitted; and (d) unrecognised barcodes will not be accepted.
 
8. Entrants must retain each original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of one or ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.
 
9. If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the internet account is held.
 
10. Promotion commences at 9.00am AEST on 17/09/2012 and ends for purchases at close of business on 11/11/2012. Final entries close at 11.59pm AEDST on 11/11/2012. All draws will take place at Handling Matters, 1/3 Green Street, Brookvale NSW 2100.
 
Major Prizes
 
11. A major prize draw will take place for each weekday of the eight eight week promotional period, with draws commencing on 18/09/2012 and concluding on 12/11/2012. There will be 40 major prize draws in total. All major prize draws will take place at 11am. Entries for each day open at 12.00am AEST/AEDST and close at 11.59pm AEST/AEDST, excluding entries for 17/09/2012, where entries open at 9am AEST. Each major prize draw will consist of entries received from the previous day and any non-winning entries from any previous major prize draws; excluding draws scheduled to take place on Monday which will include entries received from the preceding Friday, Saturday and Sunday and non-winning entries from any previous major prize draws. Due to Labour Day on Monday 01/10/2012, two draws will take place on Tuesday 02/10/2012 (one from entries received between 12.00am AEST on 28/09/2012 and 11.59pm AEST on 30/09/2012, and another draw containing entries received between 12.00am AEDST on 01/10/2012 and 11.59pm AEDST on 01/10/2012).
 
12. The first valid entry drawn in each major prize draw will win either a Papillionaire Sommer Bike valued at $503 or a Papillionaire Classic bike valued at $579. The winner will choose which bike they would like to receive, subject to the number of each bike available, as set out below. In the event that the bike chosen by a winner is no longer available (i.e. has been given away in previous major prize draws), a winner will automatically be awarded the other bike available.
 
13. There are 40 major prizes to be won in total. 28 Papillionaire Sommer bikes and 12 Papillionaire Classic bikes available.
 
Minor Prizes
 
14. All entries received during the entire promotional period (excluding winners of a major prize) will be entered into the minor prize draw. The minor prize draw will take place at 11.15am on 12/11/2012.
 
15. The first one hundred and twenty five (125) valid entries drawn in the minor prize draw will each win a Yates 125th anniversary pack which includes a Yates Garden Guide valued at $39.95 and a Yates Heritage Seed Tin valued at $22. Total prize value for the minor prize pack is $61.95.
 
16. There are 125 minor prizes to be won in total.
 
General
 
17. Winners will be notified by telephone and mail.
 
18. All winners will be published online at www.yates.com.au and the major prize winners’ names will also published in The Australian newspaper on 23/11/2012.
 
19. The Promoter’s decision is final and no correspondence will be entered into.
 
20. The major prize pool value is AU$21,032. The minor prize pool value is AU$7,743.75. The total prize pool value is AU$28,775.75.
 
21. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize or an element of the prize, then the prize (or that element of the prize) will be forfeited.
 
22. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.
 
23. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
 
24. Prizes are not transferable or exchangeable and cannot be taken as cash.
 
25. A draw for any unclaimed prizes may take place on 18/02/2013 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and mail and the names of any major prize winners will be published in The Australian on 22/02/2013.
 
26. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
 
27.
