By entering, entrants accept these conditions. 2 Entry is open only to Australian residents aged 18 or over, excluding directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, the participating outlets or the agencies or companies associated with this competition. 3 The competition begins at 12.01am (AEST) on 01/09/12 and closes at 11.59pm (AEST) on 31/10/12 (Competition Period). 4 To enter, consumers must, during the Competition Period: (a) visit the Atrium Buffet or Market & Co venues at Crown Perth (Venues); (b) purchase a glass or 750ml bottle of Devil’s Lair wine from a Venue for on premise consumption (Eligible Purchase); (c) fully complete the Promotion Entry Form available at the Venues; and (d) put the Entry Form in the Entry Boxes located in the Venues. Consumers will be entitle to one entry in the competition for each glass Eligible Purchase. Each bottle Eligible purchase entitles a consumer to five entries in the competition. Limit of five entries per person per day. 5 All entries must be received by the Promoter during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter and not at the time of submission by the entrant. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. 6 A draw will be conducted at 10.00am (AEST) on 01/11/12 at Crown Perth Entertainment Complex, Great Eastern Highway, Burswood, 6100, WA. The first three valid entries randomly drawn from all valid entries received during the Competition Period will win the prizes in accordance with the order in which they are drawn. 7 There are three (3) prizes to be won: FIRST PRIZE: overnight accommodation for two people for 2 nights (who must be aged 18 or over) at Basildene Manor, Margaret River, consisting of: (a) Dinner for two at ‘Must Wine Bar’ 101 Bussell Highway Margaret River 6285 WA to the value of $150; (b) a tour and wine tasting at Devil’s Lair Estate Margaret River to the value of $150. Travel costs are not included. The winner must pay all travel expenses incurred in relation to claiming this prize including the cost of any air or vehicle travel if required. The First Prize is valued at $600. SECOND PRIZE: 1 Magnum (1.5 Litres) of Devil’s Lair Estate Cabernet Sauvignon signed by Oliver Crawford valued at a minimum $100. THIRD PRIZE: three (3) bottles of Devil’s Lair wines consisting of: (a) 1 x 750ml Devil’s Lair Chardonnay; (b) 1 x 750ml Devil’s Lair Sauvignon Blanc; and (c) 1 x 750ml Devil’s Lair Cabernet Sauvignon Shiraz. The Third Prize is valued at $75. 6857923/2 Total prize pool is valued at $775 (including GST). 8 The First Prize cannot be taken during specified event/peak/public holiday periods or any other exclusion periods as specified by the Promoter and or the prize supplier/s. The First Prize must be booked and completed by 01/05/13. All other costs associated with the First Prize, including but not limited to any transfer costs, meals, additional taxes, insurance and other ancillary costs are the responsibility of the winner and his/her companion, as incurred. The winner and their companion/s must depart and return at the same time. The First Prize is subject to any additional terms and conditions specified by the First Prize supplier/s. Travel dates cannot be changed with less than 30 days notice. If any fees are incurred due to changing of travel dates, the fees are the responsibility of the First Prize winner. 9 The winners will be notified by phone and in writing. By entering this competition, each entrant requests that his or her full address not be published. 10 If a prize has not been accepted or claimed within 3 months of the draw, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws on 5 February 2013 at the same time and location as the original draw as are necessary to distribute the prize. Any winner(s) in this draw will be notified by phone and in writing. 11 The prize winners (and their companions where relevant) must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material. 12 Entrants acknowledge that there are inherent risks in some aspects of the First Prize and that using the Firs Prize involves participating in dangerous activities. By entering this competition and accepting the prize, entrants accept that risk. 13 The Promoter may require winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion. 14 If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 10. The judges’ decision is final and no correspondence will be entered into. 15 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person. The Promoter may in its absolute discretion cancel the prize or otherwise cease to provide any benefit of the prize to a winner (and their companion, if applicable) if the winner (or their companion, if applicable), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. 16 Prizes are not transferable or exchangeable and (except where cash is specified) cannot be redeemed for cash. If for any reason a winner does not take an element of a prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. If a prize or any element of a prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory if required. 17 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or 6857923/2 not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 18 If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory if required. 19 The Promoter is not liable for any tax implications arising from prize winnings.
