Bedshed's 'Name Baxter's Dog' (Promotion) Terms and Conditions
1. Participation in the Promotion is deemed to be an acceptance of these Terms and Conditions.

2. Entry is open to all residents of Australia over the age of 18 years and have registered online at Bedshed's Facebook contest page.

3. Employees and franchisees (and their immediate families) of Bedshed Franchising Pty Ltd (Promoter) and agencies associated with the Promotion are ineligible to enter.

4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers or attempts to tamper with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. Incomplete or indecipherable entries will be deemed invalid. The Promoter reserves the right to disqualify any entry which in the reasonable opinion of the Promoter includes any content which may be unlawful, profane, inflammatory, defamatory to any person and/or damaging to the goodwill or reputation of the Promoter.

6. The Promotion starts at 09.00 am Western Australian time on Monday 3 September 2012 and closes at 10.00 am Western Australian time on Friday 5 October 2012 (Promotion Period).

7. To enter, eligible participants must visit http://www.facebook.com/BedshedAU and fill out and submit the Promotion entry form during the Promotion Period. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.

8. Only one (1) entry per eligible entrant will be accepted during the Promotion Period.

9. All valid entries received during the Promotion Period will be judged by Bedshed Franchising Pty Ltd at 12.00 pm Western Australian time on Friday 5 October 2012 at the Bedshed Central Office, 14 Collingwood Street Osborne Park WA 6017, Australia. Bedshed Franchising Pty Ltd will deem which entry is the best name for Baxter's Dog and award the Prize to the winning Entrant. The Promoter's decision is final and no correspondence will be entered into, including in the event of a dispute.

10. There will be one (1) Prize consisting of a kid's bedroom suite with a retail value of $1,650 AUD. The Prize will contain 1 Lasalle bedside and 1 Lasalle Tallboy and the winner's choice of an Andee (boy's single bed) or a Chloe (girl's single bed). Mattress, pillows and linens are not included. The value of the Prize is accurate and based upon the recommended retail price as at the date of these Terms and Conditions. The selection of the Prize is random and at the discretion of the Promoter.

11. The Prize winners first name and state will be published on Bedshed's Facebook page on Monday 8 October 2012 Western Australian time. The Prize winner will also be notified by email within two (2) business days of the end of the Promotion Period.

12. The Prize is not transferable, nor exchangeable and cannot be taken as cash, unless otherwise agreed by the Promoter.

13. The Prize winner is responsible for inspecting the Prize before acceptance. Any and all claims regarding the fitness for purpose, quality and use of the Prize should be directed to the Promoter, Bedshed Franchising Pty Ltd.

15. The Promoter will use its best endeavors to provide the Prize as listed. If a Prize is unavailable, the Promoter will, at its absolute discretion and where possible provide an alternative prize of equivalent value, subject to any directions from a regulatory authority.

16. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

17. Any cost associated with accessing the Promotion is the entrant's responsibility and may be dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

18. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, or any other similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

19. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize.

20. By participating in the Promotion, participants release Facebook from any liability. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Participants are providing information to the Promoter and not to Facebook.

21. The Promoter requires the entrants' personal information for the purpose of conducting the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. Unless the entrant elects otherwise, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. In order to do this, the Promoter may share the entrants' details with its service providers who are contract-bound to protect the entrants' privacy.

22. Entrants should direct any request to opt out, access, update or correct information to the Promoter. 23. Ownership (including intellectual property rights) of all entries is assigned to the Promoter upon submission of the entry and remains the property of the Promoter.

24. Acceptance of a prize constitutes permission for the Promoter to use winner's name, suburb of residence, and entry for advertising and promotional purposes without compensation, unless otherwise prohibited by law.
