Pumpa “Get Pumped – Win $10,000” Competition Terms and Conditions
1. Promotion
1.1. Holistic Pty Ltd invites Australian and New Zealand residents to participate in the Pumpa
“Get Pumped – Win $10,000” Competition (the “Promotion”). Participants who
successfully enter through the Pumpa “Get Pumped - Win $10,000” Competition will be
eligible to enter the Promotion to win the prizes, as detailed in these Terms and
Conditions. The Promotion is a game of skill, and chance plays no part in determining the
winner. Each entry will be individually considered.
1.2. The Promotion commences at 12:01am on APRIL 1st 2012 (AEST) and concludes at
11:59pm on December 21st 2012 (AEST) (the “Promotion Period”).
1.3. The promoter is Holistic Pty Ltd 30 003 964 850 of PO Box 1652, Dee Why, New South
Wales, Australia (the “Promoter”).
2. Eligibility
2.1. By participating in the Promotion, participants accept that these Terms and Conditions
create a legally-binding agreement between the Promoter and the participant.
2.2. Participants are only permitted to participate in the Promotion using one IP address.
Multiple entries from a single participant are not allowed, and Pumpa may in its sole
discretion disqualify and disregard any and all entries from that participant.
2.3. Employees, officers and directors of the Promoter and their respective parents, affiliates,
subsidiaries and agencies and any entity or person involved in the design, production,
execution, administration, distribution or hosting of the Promotion and the judges for the
Promotion, and their immediate family members are ineligible to enter.
2.4. The Promoter reserves the right, at any time, and in its sole discretion, to disqualify a
participant if the Promoter has reason to believe that the participant has submitted an
entry not in accordance with these Terms and Conditions or any relevant law, or if the
entry is otherwise deemed inappropriate.
2.5. Entries must be in the English language. Incomplete, indecipherable, or illegible entries
will be deemed invalid and disregarded by the Promoter.
2.6. To be eligible to win a prize, if requested to do so by the Promoter, participants must
complete and sign a Publicity Licence and Release Deed which grants the Promoter a
licence to use the entry and Submission for promotion of the Promoter’s products and
services, and obligates the participant to participate in publicity arrangements.
3. Entry and Submission

3.1. To enter the Promotion, during the Promotion Period, participants must:
(a) be above the age of 18 years at the time of entering into the Promotion;
(b) be a resident in Australia or New Zealand and be able to provide evidence of
residence if requested to do so by the Promoter;
(c) visit the Pumpa website competition page at www.pumpa.com.au/pumpa*
competition*20122(the “Page”);
4. Prizes
.4.1. The winner will receive a prize of $10,000 AUD in the form of a bank cheque made out to
the participant.
4.2. In the event that any prize or any component of a prize is unavailable for any reason, at
any time, the Promoter reserves the right to substitute the prize or that prize component
with another prize of equal value and the prize winner will be notified accordingly.
4.3. To the extent permitted by law, the Promoter (including its officers, contractors,
employees, agents and representatives) is not liable for any loss (including loss of
opportunity), damage (including, but not limited to, direct, indirect or consequential loss),
cost, expense or claim arising from or in relation to the Promotion, any entry or prize that
is late, lost, altered, damaged or misdirected, or the use of a prize.
5. Winners
5.1. Winner will be notified by email by the Promoter or its agent or representative, and the
winner and their Submissions will be announced on the Page.
5.2. Winners must complete and sign a Publicity Licence and Release Deed which grants the
Promoter a licence to use the entry for promotion of the Promoter’s products and
services, and obligates the participant to participate in publicity arrangements.
5.3. The Promoter will arrange for the prize to be mailed to the winner. Property and risk in
and to the prizes will pass to the winners on the prizes being passed to the carrier for
delivery to the winner and the Promoter will not be responsible for any damage or loss to
the prize after that time.
6. Consents
6.1. In accepting a prize, a winner agrees to grant to the Promoter an irrevocable and
perpetual worldwide licence to reproduce the entry and Submission, in part or in full in
any media now known or later devised and to participate in any publicity arrangements
made by or on behalf of the Promoter.
6.2. A winner further agrees that the Promoter has the right to publicise the winner’s first
name and surname, likeness, photograph and voice, and also the State/Territory in which
the winner ordinarily resides, without restriction, in respect of the Promotion and any
products or services offered, manufactured, distributed and/or supplied by the Promoter,
without any payment being made to the winner.
6.3. By entering into this Promotion, each participant acknowledges and consents to the
reproduction and publication of his/her entry and Submission by the Promoter, its
successors and assigns, in any media throughout the world, for any purpose and without
restriction, in perpetuity.
7. Information provided by participant
7.1. Participants acknowledge and agree that winners of this Promotion will have their first
name, surname and state published on the Page and on other media throughout the
world.
7.2. The Promoter collects personal information from participants to conduct the Promotion
and may, as required in the course of business, disclose the personal information to
other parties. Entry into this Promotion is conditional on provision of the personal
information requested. If the participant consents at the time of entry, their entry may be
entered into a database and the Promoter may use the participant’s name and address
for promotional, marketing and publicity purposes. Participants may direct any request to
access their personal information to the Promoter..
8. General
8.1. If the Promotion cannot, for any reason, be conducted as anticipated, the Promoter
reserves the right in its sole discretion, to the maximum extent permitted by law, to
modify, suspend, or cancel the Promotion.
8.2. The Promoter takes no responsibility for any delays or failures in any telecommunications
service or equipment.
8.3. To the maximum extent permitted by law, the Promoter and its parent company, affiliates,
related corporations, subsidiaries, directors, officers, employees and agents accept no
responsibility whatsoever for any damage, loss or any other liability that may occur as a
consequence of participation in the Promotion.
8.4. These Terms and Conditions constitute the entire agreement between the parties
regarding the matters set out in it. Participants will do such acts and sign, or cause to be
signed, such instruments that the Promoter may reasonably request for the purposes of
these Terms and Conditions. All prices stated are in Australian dollars. The laws
applicable in New South Wales govern these Terms and Conditions and the parties
submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts
competent to hear appeals from those courts

What exactly is 'pumpa'?

Thanks for the answers Helga22, but the answer to the first question is incorrect.  PUMPA sings about 'reaching for their CIALIS' and that medication is also featured pictured in the video clip.

I think PUMPA is the name of the artist who appears in the videos.

I do not understand why you have to add to the post that i have done as i have already got all of the information for the competition.What is the problem with this comp ? Please
And i think if you look closely to most of the comps that are listed the information is used to sent to other 's
 So why is this  such a big issue !!!!!!!!!!!!!!!!!!!!!!!!!!
I am so trying to do my best with the comp's that i post ,but i am so getting upset with some people that like to override  what posters  post .I think it is time that these people take a step back and think about what they are doing to these people ,let them do their postings without you having to correct them all the time .Me i am one of them i am starting to feeling that my postings are just that postings and all you want to do is pull them apart .I think some people need to sit back and think about what they are doing ..... Please leave them alone and give them and me a chance to grow instead of knocking us down.

Why PM someone when the initial post is missing 4 of the T & C's - sorry, but I don't understand.

[EDIT]  - this is all very confusing, the missing T&C's now appear in the original post. They weren't there before.

I think that all of us here are really grateful to all the posters for the comps.  Without them(and you, Cazatim)we wouldn't have a comp site!  When an error is noticed, though, we all also try to do our bit by correcting it(such as when an incorrect answer to a question is posted).  I'm sure most of us mean absolutely no harm at all, and no personal insult would be intended.

Most compers only look at the first post and expect all the information to be there, if it's not, the Mods will amend the post.
