To enter, you must click the application form on the Promotional Website, complete your title, first name, surname, email address and mobile number. You must then upload a video, photograph or written piece which demonstrates why you should be an official Nissan Fan Blogger at the Australian International Motor Show (AIMS). Three (3) Entrants will be awarded a prize. Entries will be judged based on the originality and creativity shown as to why you should be an official Nissan Fan Blogger at the Australian International Motor Show. TERMS AND CONDITIONS 1. The Promotion is conducted by Nissan Motor Co. (Australia) Pty. Ltd., ACN 004 663 156, of 260-284 Frankston Dandenong Road, Dandenong South, Victoria 3175 (Promoter). 2. Entry into the Promotion constitutes acknowledgement and acceptance of these terms and conditions. Information on how to enter, all entry instructions, advertising material and prize information published by the Promoter form part of these terms and conditions. 3. To be eligible to enter, you must: 3.1. Be an Australian resident; 3.2. Be aged 18 years or older at the time of entry; 3.3. Like the Nissan Australia Facebook page and remain a fan of the Nissan Australia Facebook page throughout the Promotion Period and until the AIMS is complete; 3.4. Click on the application form, complete your title, first name, surname, email address and mobile number; 3.5. Upload a video, photograph or written piece which demonstrates why you should be an official Nissan Fan Blogger at the Australian International Motor Show; 3.6. Comply with these terms and conditions (Entrant). 4. Employees or directors of the Promoter, immediate family members of any employee or director of the Promoter, any retailer, supplier, associated company or agency of the Promoter and any person who the Promoter has previously notified are not eligible to enter. 5. Entries not completed in accordance with these terms and conditions are void. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way. 6. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements. Entrants can only enter in their own name. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the Promotion is prohibited and may render all entries submitted by that individual invalid. 7. Entries for the Promotion open at 12.00 (AEST) on 26 September 2012 until 10.00 (AEDT) on 12 October 2012 (Promotion Period). All entries must be received by the Promoter by 10.00 (AEDT) on 12 October 2012. 8. Judging for the prizes will take place at 260-284 Frankston Dandenong Road, Dandenong South, Victoria, 3175 at 14.00 (AEDT) on 12 October 2012. 2 9. This is a game of skill and chance plays no part in determining Winners. Entries will be judged based on the originality and creativity shown as to why you should be an official Nissan Fan Blogger at the Australian International Motor Show. All prizes will be allocated to successful entrants based on the subjective decision of the judge/s. The judge’s/s’ decision is final and no correspondence will be entered into. 10. There are three (3) prizes to be awarded. Each prize includes: 1 x economy class flight from the Prize Winner’s nearest major capital city to Sydney on 17 October 2012; 1 x economy class flight from Sydney to Prize Winner’s nearest major capital city on 19 October 2012; 2 nights’ accommodation at Hotel Ibis Sydney Darling Harbour, 70 Murray Street Darling Harbour in Sydney from 17 to 19 October 2012; 1 x Exclusive entry pass to the Australian International Motor Show media day on 18 October 2012 Return transfers between Sydney airport and Hotel Ibis Sydney Darling Harbour included. 11. The total value of the prize is $1,400.00. 12. The total prize pool is $4,200.00. 13. Prizes are not transferable, exchangeable or redeemable for cash. Prize values are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in the value of the prize. To the extent permitted by law, the Promoter makes no representations or warranties as to the quality, suitability, or merchantability of the prize(s). 14. Any and all ancillary costs associated with the prizes, including but not limited to passports, travel insurance and visa, meals, drinks and spending money (other than those specified in clause 10 above) are the sole responsibility of the respective Prize Winners. 15. Prize winners will be notified by telephone and email and their names will be published on the Promotional Website on 15 October 2012. 16. In the event that for any reason whatsoever the Prize Winner(s): 16.1. does not claim the prize or an element of the prize at the time stipulated by the Promoter despite every reasonable effort taken by the Promoter to contact the Prize Winner(s); or 16.2. is unable to attend the AIMS Media day; then the prize or that element of the prize will be forfeited by the Prize Winner and cash will not be awarded in lieu of the prize or that element of the prize. The Promoter may select other entrant/s based on the judge’s/s’ subjective decision as is necessary in order to distribute the prizes. The Promoter reserves its right not to award the prize if a suitable winner cannot be found. 17. If a prize is unavailable for any reason, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 18. After attending the AIMS, the Prize Winners are required to create at least one (1) piece of content in the form of video(s), photographs (gallery of minimum 20 photographs with captions) or written piece(s) (Show Report). The Show Report must document the Prize Winners’ experience at the AIMS. The Prize Winners must forward their Show Report to the Promoter for approval by 22 October 2012. The 3 Promoter reserves the right to amend or vary the Show Report as it sees fit. The Promoter will return the approved Show Report to the Prize Winners by 24 October 2012. 19. The approved Show Report will be published on the Promotional Website and Nissan Australia website by 28 October 2012. The Prize Winners are required to publish their approved Show Report on their own Blog, Facebook page, Twitter page or other social media account by 28 October 2012. 20. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete, inaudible or incomprehensible entries will be deemed invalid. 21. Entrants can only enter in their own name. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the Promotion is prohibited and may render all entries submitted by that individual invalid. 22. By entering this Promotion, the Entrant (a) consents to the Promoter’s use of his or her personal details (including name, likeliness, image and/or voice); and (b) agrees to partake in media exposure; for the purpose of any future promotional, marketing, advertising or publicity (in any form of media) that the Promoter may choose for an unlimited period without remuneration or other compensation. 23. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Promoter reserves the right, subject to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the Promotion. 24. The Promoter reserves the right, at any time, to verify the validity of entries. The Promoter reserves the right to verify the Entrant’s identity particulars (including but not limited to an Entrant's identity, age, place of residence.). Proof of identification, age, residency and entry considered suitable for verification is at the discretion of the Promoter. 25. The Promoter, its associated agencies and companies associated with this Promotion will take no responsibility for any prize(s) damaged or lost in transit. Once the prizes have left the premises of the Promoter, the Promoter’s associated agencies or the companies associated with this Promotion, the Promoter, the Promoter’s associated agencies and the companies associated with this Promotion will not be responsible for any delay, failure to deliver, or damage caused to the prize (s) during transit. 26. The Promoter reserves the right to prohibit the winner (s) taking part in any or all aspects of the prize(s), if the Promoter determines, in its absolute discretion that the winner(s) are not in the mental or physical condition necessary to be able to safely participate in the prize(s). 27. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. 28. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct that may jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from any offender(s) are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 29. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, and subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion as appropriate. 30. To the full extent permitted by law, the Promoter, the Promoter’s officers, employees and agents, the Promoter’s related companies and all those entities' personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense, including loss of opportunity) which is suffered or incurred by any individual in connection with the Promotion or prizes, including but not limited to: (i) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (ii) any theft, unauthorised access or third party interference; (iii) any entry or prize claim that is late, lost, 4 altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (iv)any variation in prize value to that stated in these terms and conditions; (v)any tax liability incurred by the winner or entrant; (vi) any prize(s); or participation in or use of any prize(s); (vii) any direct, indirect, economic or consequential loss; (viii) any loss arising from the negligence; (ix) any liability for personal injury or death. All entries and entry details become the property of the Promoter. The Promoter may use the Prize Winner(s) personal details (including name, likeliness, image and/or voice) for any marketing and advertising (in any form of media) without compensation, unless the prize winner(s) advises the Promoter otherwise when accepting the prize. By entering the promotion, unless the Promoter is otherwise advised, Entrants consent to the Promoter using their personal information provided for facilitating the promotion, awarding prizes and for future promotional, marketing and publicity purposes, and disclosing that information to its related entities and contractors for those purposes.
