THE WALT DISNEY COMPANY (AUSTRALIA) PTY LIMITED “FRANKENWEENIE” PREVIEW SCREENING COMPETITION OFFICIAL COMPETITION RULES AND TERMS AND CONDITIONS

The promoter of this Competition is The Walt Disney Company (Australia) Pty Limited (ABN 30 054 610 025), located at Level 7 The Como Centre, 650 Chapel Street, South Yarra VIC 3141, (03) 9832 6155 (the “Promoter”). The Promoter may contract the services of Salmat Digital Pty Ltd or such other agency as the Promoter may determine in its discretion (the “Agency”) to administer certain parts of this Competition.
Information on how to enter forms part of these terms and conditions. By clicking the “I Accept” button, ticking the box on the Competition webpage and submitting an Entry, you are stating that you agree to be bound by all of these terms and conditions of the “Frankenweenie” Preview Screening Competition (“Competition”).
Entry is open to all residents of NSW, SA, QLD, VIC and WA who are 18 years of age or over. However, neither you nor anyone in your immediate family (including your parents/guardian, brothers and sisters), can be an employee of the Promoter or the Agency, affiliated with the Promoter or the Agency or connected to the Competition in any way.
The Competition commences on Monday 8 October 2012 at 12:00 (AEDT) and concludes on Monday 15 October 2012 at 12:00 (AEDT).
The competition will be advertised on the official Walt Disney Studios Australia and New Zealand  Facebook page (www.facebook.com/WaltDisneyStudiosAUNZ)
To enter the Competition entrants must either:
go to www.disney.com.au/FB/fw/ and follow the links to the “Franekenweenie” Preview Screening Competition page;
OR
go to the official Walt Disney Studios Australia and New Zealand Facebook Page at https://www.facebook.com/WaltDisneyStudiosAUNZ; become a fan of the Facebook page, then go to the “Frankenweenie” Preview Screening Competition application tab;
OR
c)click through to the Competition page on www.disney.com.au via a Unique URL shared by another entrant to the Competition via one (1) of the platforms listed in clause 7 below.
Once at the Competition page, entrants must complete and submit the entry form (the “Entry”). Entrants are required to provide their full name, street address, suburb, state, postcode, e-mail address and phone number. Entry into the Competition is free, excluding normal internet connection charges.

Each entrant who submits a valid Entry will be placed in the draw to win a Contest Prize (as defined below in clause 14).  Each entrant who submits a valid Entry will also receive a unique URL (“Unique URL”). Entrants can then share their Unique URL through one of the following ways:
Facebook (Share); OR
Twitter (Tweet); OR
Google+ (+1)’; OR
Email (Refer a friend eDM).
Entrants who share their Unique URL which is then used by another entrant to submit their own valid Entry will be eligible for the Referral Prize.

Entrants may only enter the Competition once. Only one prize per household is permitted.
Incomprehensible and incomplete entries will be deemed invalid.
The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute prize will be offered.
The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Official Rules or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause 10.
Entries must be received by 12:00 (AEST) on Monday 15 October 2012.  The time of entry will in each case be the time the online Entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
Any entry that is made on behalf of an Entrant by a third party will be invalid.
There will be three hundred (300) contest prizes (each a “Contest Prize”) and one (1) Referral Prize to be won during the course of the Competition (each a “Prize”).
Each Contest Prize includes an Admit 2 pass to the preview screening of “Frankenweenie” valued at a maximum of $43.

There will be 60 x Admit 2 passes allocated for NSW residents, 60 x Admit 2 passes allocated for SA residents, 60 x Admit 2 passes allocated for QLD residents, 60 x Admit 2 passes allocated for VIC residents and 60 x Admit 2 passes allocated for WA residents.


Venues, times and dates are as follows:
60 x NSW residents will receive a double pass to see “Frankenweenie” in Sydney at Event Cinemas - George Street, 505/525 George Street, Sydney NSW 2000 on Monday 22 October 2012 at 6:30pm (AEDT).
60 x SA residents will receive a double pass to see “Frankenweenie” in Adelaide at Hoyts Cinema -  Norwood, 185 The Parade, Norwood SA 5067 on Monday 22 October 2012 at 6:30pm (ACDT).
60 x QLD residents will receive a double pass to see “Frankenweenie” in Brisbane at Event Cinemas - Indooroopilly 318 Moggill Road, Indooroopilly QLD 4068 on Monday 22 October 2012 at 6:30pm (AEDT).
60 x VIC residents will receive a double pass to see “Frankenweenie” in Melbourne at Village Cinemas – Jam Factory, 500 Chapel Street, South Yarra VIC 3141 on Monday 22 October 2012 at 7:00pm  (AEDT).
60 x WA residents will receive a double pass to see “Frankenweenie” in Perth at Reading Cinema - Belmont, Crn Knutsford Ave & Fulham Street, Belmont WA 6104 on Monday 22 October 2012 at 6:30 (AWST).
The total prize pool for the Contest Prizes is valued at a maximum of $12,900.00

The referral prize (the “Referral Prize”) includes a “Frankenweenie” prize pack valued at a maximum of $337.87 comprising of the following:
Disney’s “Alice In Wonderland” (Live Action) 3D Bluray/2D Blu-ray valued at a maximum of $39.95; and
Disney’s “Nightmare Before Christmas” 3D Blu-ray/2D Blu-ray valued at a maximum of $39.95; and
Disney promotional T-shirt (size Large) valued at a maximum of $20.00; and
Disney Messenger Bag  valued at a maximum of $35.00; and
Disney Hat valued at a maximum of $15.00; and
Disney Lenticular Journal valued at a maximum of $10.00; and
Disney Sticker Set valued at a maximum of $5.00; and
Disney Watch valued at a maximum of $20.00; and
Disney Key Chain valued at a maximum of $15.00; and
Disney LED Pet Lash valued at a maximum of $25.00; and
Disney Pencil Set valued at a maximum of $10.00; and
Admit 2 in-season pass to see “Frankenweenie” valued at a maximum of $43.00; and
Frankenweenie Sparky 10” Plush valued at a maximum of $29.99; and
Frankenweenie 3” Collectible Figure (2-pack) valued at a maximum of $9.99; and
Frankenweenie Collector Pack valued at a maximum of $19.99.
The maximum value of the Referral Prize is $337.87

The total maximum value of the Competition is $13,237.87 (including GST)
Prizes cannot be transferred, exchanged or redeemed for cash.
Unless expressly stated in these terms and conditions all other expenses in relation to partaking in the Contest Prize and/or Referral Prize become the responsibility of the winner and their guests.
If a Prize is unavailable, for whatever reason, the Promoter reserves the right to substitute a Prize for a Prize of equal or greater value, subject to State Regulation.
The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of a Prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the Prize.
Once a Prize has left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
By accepting a Prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to a Prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of partaking in a Prize.
In consideration for the Promoter awarding a Prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in a Prize to appear in connection with the Promoters or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
In the event that for any reason whatsoever a winner does not take an element of a Prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the winner and cash will not be awarded in lieu of that element of a Prize.
Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in Prize values between now and the ultimate prize redemption date.
Independent financial advice should be sought as tax implications may arise as a result of accepting a Prize.
Each valid entrant who has entered the Competition over the duration of the Competition period will be entered into the draw. Entrants will be entered into the state entry pool for a Contest Prize for the state in which they reside as stated in their Entry (NSW, SA, QLD, VIC and WA) (the “STATE ENTRY POOLS”):
Sixty (60) valid entrants from NSW State Entry Pool will be drawn at random to become the Contest Prize winners.
Sixty (60) valid entrants from SA State Entry Pool will be drawn at random to become the Contest Prize winners.
Sixty (60) valid entrants from QLD State Entry Pool will be drawn at random to become the Contest Prize winners.
Sixty (60) valid entrants from VIC State Entry Pool will be drawn at random to become the Contest Prize winners.
Sixty (60) valid entrants from WA State Entry Pool will be drawn at random to become the Contest Prize winners.
The Referral Prize winner will then be drawn at random from all entrants who have entered the Competition during the duration of the Competition period, have shared their Unique Link, and there is at least one entry into the Competition coming from their shared Unique Link.

All draws will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, on Monday 15 October 2012 at 16:00 (AEDT).

The Winners of the Contest Prize and the Winner of the Referral Prize will be notified in writing immediately after the draw. The Winner of the Referral Prize will have their details published in the Public Notices section of The Australian newspaper on Wednesday 17 October 2012.
Should an entrant’s contact details change during the Competition period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060 on Thursday 18 October 2012 at 9:00 (AEDT). The winners will be notified in writing immediately after the draw.  The Winners of the prizes over $250 will have their details published in the Public Notices section of The Australian newspaper on Friday 19 October 2012
The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.
It is a condition of accepting a Prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with a Prize except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
Subject to the Promoter complying with all relevant State and Territory laws and regulations, the Promoter reserves the right to change, amend, delete or add to these Official Rules without prior notice at any time and each entrant shall be bound by such changes. Where changes are permitted by the relevant State and Territory laws and regulations, the Promoter will post any changes to the Official Rules on the Competition website. Before you submit your Entry, please check the Competition website to ensure you are aware of the terms.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Official Rules, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

The Promoter, Agency and both their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
The Promoter will collect your personal information (such as your name and biographical data) as part of the Competition and may use this information anywhere in the world for the purposes of administering the Competition, and other purposes for which we obtain your express consent.  Where you have consented, your personal information may be provided to the Promoter’s affiliates, including overseas affiliates for future promotional, marketing and publicity purposes without notice and without any fee being paid unless otherwise advised by you.  You hereby waive any rights of privacy, publicity or similar rights which you may have in the Entry.
No personal information collected from you will be used for any marketing or promotional purposes, either by the Promoter or its affiliates, without your express consent.
The Promoter will comply with its privacy policy in the collection and use of your personal information.  The Promoter’s privacy policy is available at http://www.disney.com.au/policy.html.
The Agency, on behalf of the Promoter, is collecting the entrant's personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to the Agency for this purpose. If you are not willing for this to occur you cannot participate in the Competition.
Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.
Any provision (or part thereof) of these Official Rules that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions (or parts thereof) of these Official Rules nor affect the validity or enforceability of that provision (or part thereof) in any other jurisdiction.
These Official Rules and any entry forms contain the entire agreement between you and the Promoter with respect to the Competition. They set out the only conduct that you have relied on and supersede all earlier conduct and prior agreements and understandings between you and the Promoter in connection with the Competition.
