How to enter:
To be eligible to enter the promotion, consumers must purchase any Johnnie Walker 700mL or larger spirits bottle, from a participating liquor outlet during the Promotion Period.

Consumers must then during the Promotion Period, send an SMS to 19 922 663 comprising of the following information and in the following order with a space between each item: first and last name, DOB (ddmmyy) and postcode. Sample SMS entry: Joe Smith 030178 2000. SMS entries are charged at 55 cents (including GST per entry). Entrants must have premium service access to enter by SMS.

Prize:
The first valid entry draw will win the major prize. The major prize winner will win The Johnnie Walker “Melbourne Cup Experience’’ for four (4) adults in Melbourne VIC, between 4/11/13 – 6/11/13. The winner’s nominated guests must be 18 years or over to participate in the prize. The prize includes two (2) nights accommodation at a five (5) star hotel in Melbourne, transfers between event and hotel and 4x VIP entry to the Melbourne Cup 2013 on 5/11/13. Total prize package valued at up to $8,000 (AU), depending on point of departure.


Terms and conditions
1.   Information on how to enter and the prize forms part of these Conditions of Entry. Participating in this promotion is deemed acceptance of these Conditions of Entry.

2.   Entry is only open to residents of Australia who are aged 18 years or over. Employees and their immediate families of the Promoter and their agencies associated with this promotion are ineligible to enter.

3.   The promotion commences on 1st October 2012 at 00:01am and closes 9th November 2012 at 23:59pm (“Promotion Period”). All times indicated in these conditions of entry are either AEST or AEDST as applicable.

4.   To be eligible to enter the promotion, consumers must purchase any Johnnie Walker 700mL or larger spirits bottle, from a participating liquor outlet during the Promotion Period.

5.   To enter, consumers must then during the Promotion Period, send an SMS to 19 922 663 comprising of the following information and in the following order with a space between each item: first and last name, DOB (ddmmyy) and postcode. Sample SMS entry: Joe Smith 030178 2000. SMS entries are charged at 55 cents (including GST per entry). Entrants must have premium service access to enter by SMS. 6.   The Promoter reserves the right, at any time during or after the closing date of the promotion to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7.   Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; (b) only one valid product required for each entry; (c) unrecognizable entries will be deemed invalid; and (b) each entry must be submitted separately and in accordance with the entry requirements. Limit of 2 entries per person per day (within a 24 hour period).

8.   Entrants must retain original store receipt(s) clearly showing the date of purchase of the Johnnie Walker product(s) used for each entry made as proof of purchase. Failure to produce the original receipt(s) for all entries upon request may, in the absolute discretion of the Promoter, result in invalidation of all of an entrant’s entries and forfeiture of any right to the prize.

9.   No responsibility accepted for late or misdirected entries. Incomplete or indecipherable entries will be deemed invalid.

10.   The major prize draw will take place at TigerSpike Pty Ltd Level 1, 28 Richards Ave, Surry Hills, NSW 2010 at 11:00am on 12th November 2012.

11.   The first valid entry draw will win the major prize. The major prize winner will win The Johnnie Walker “Melbourne Cup Experience’’ for four (4) adults in Melbourne VIC, between 4/11/13 – 6/11/13. The winner’s nominated guests must be 18 years or over to participate in the prize. 12.   If the winner is from NSW, ACT, QLD, SA, WA, NT or TAS, the major prize will also include return economy flights for 4 adults departing from their nearest capital city to Melbourne, VIC, and airport to hotel transfers. If the winner is a resident of VIC, they (and their nominated guests) will be required to make their own transport arrangements to the hotel.

13.   The winner will be contacted by SMS or phone and the Promoter will record their address details so that the prize may be awarded. The winner will be notified by either SMS or phone call, and in writing, within two business days of the draw, and will have their name published in The Australian on 23/11/12. The Promoter’s decision is final and no correspondence will be entered into.

14.   The prize (including flights and accommodation) must be taken on dates as specified by the Promoter. All travel must be booked by 01/03/2013 and must be taken between 4/11/13 – 6/11/13, and is subject to booking and flight availability. Flights must be taken in the order specified by the Promoter and the itinerary may not be extended or otherwise varied unless the Promoter, in its sole discretion, agrees otherwise. The Promoter is not responsible for any delays or cancellations of flights, nor the malfunction of any ground services provided to the prize winner. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.

15.   The 4x VIP entry to the Melbourne Cup 2013 ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or companions) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

16.   The prize does not (except as expressly stated) include: (i) additional transfers; (ii) other transport or accommodation; (iii) meals or beverages; (iv) taxes (excluding airline and airport taxes); (v) incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages); (vi) spending money; (vii) insurance (such as travel or health cover); (viii) vaccinations or other medical or health related services; (ix) any other ancillary costs which may be incurred by the winner or their nominated guests in relation to the prize trip. Visas, passports, and all entry, exit, health or other documents required by law, regulations, orders, demands or requirements of the countries visited or transited are the responsibility of the winner and their guests.

17.   The Promoter will not be responsible for the cancellation or delay of the 2013 Melbourne Cup Carnival or any part thereof, or the non-availability of any one or more of the prize components.

18.   There is one major prize to be won nationally, with a total prize pool value of up to $8,000 (AU). The Promoter accepts no responsibility for any variation in the prize value. The prizes, including any unused portion, is not transferable or exchangeable or redeemable for cash or other goods or services and cannot be taken as cash.

19.   Entries via SMS will only be accepted from mobile phones. SMS entries via the Internet are ineligible. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted invalid.

20.   If for any reason this competition is not capable of running as planned including (but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, war, terrorism or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any entrant who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion subject to state regulations.

21.   The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or website user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the Internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.

22.   The prize must be claimed by 1/02/13 and if the prize remains unclaimed by such date, the Promoter may conduct such further draws at the same place as the original draw at 11:00am on 1/02/13 in order to distribute the unclaimed prize, subject however to any written directions given under all State Regulations. The unclaimed prize winner, if any, will be notified in either SMS or phone call, and in writing, within two business days of the draw, and winner will have their name published in The Australian on 22/02/13.
23.   The prize must be taken as stated. If for any reason the prize winner cannot take the prize or any part of the prize in accordance to these terms and conditions, including at the time specified by the Promoter, the prize will be forfeited and will not be redeemable for cash.

24.   If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

25.   It is a condition of accepting the prize that the winner and their nominated guests who take the prize will, upon request by the Promoter, be required to sign a legal release and indemnity in a form to be determined by the Promoter. The prize winner and their guest(s) (where applicable) must each be 18 years of age or older and will, upon request by the Promoter, be required to provide identification satisfactory to the Promoter to verify same.

26.   Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

27.   Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia where it is illegal to do so (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

28.   Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) attendance at the prize event. 29.   The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

30.   Entrants grant the Promoter permission to communicate with them by email and/or SMS in order to provide details of the prize and/or instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
