TERMS AND CONDITIONS FOR RESIDENTS OF AUSTRALIA AND NEW ZEALAND
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Promotional Period
2. Promotion commences at 08.30am AEDST on 15/10/12 and ends at 8.30pm AEDST on 30/11/12 (“Promotional Period”).
Eligibility to Enter
3. Entry is open to Australian and New Zealand residents aged 18 years or over.
4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
How to Enter
5. To enter, individuals must complete Facebook Entry or Website Entry, as outlined below:
6. Facebook Entry: To enter via the Peregrine Adventures Facebook Page, individuals must complete the following steps during the Promotional Period:
a) visit the Peregrine Adventures Facebook Page at www.facebook.com/peregrineadventures (“Facebook Page”);
b) become a fan of the Facebook Page by clicking the ‘like’ button, if not an existing fan of the Facebook Page;
c) follow the prompts to the promotional entry form;
d) input the requested details; and
e) submit the fully completed entry form.
7. Website Entry: To enter via the Peregrine Adventures website, individuals must complete the following steps during the Promotional Period:
a) visit the Peregrine Adventures website at http://www.peregrineadventures.com;
b) follow the prompts to the promotional entry form;
c) input the requested details; and
d) submit the fully completed entry form.
8. Limit one entry permitted per person and Facebook account per day.
Weekday Draws
9. A draw will be conducted for each weekday of the Promotional Period (35 draws in total). Entries open and close for each draw on the dates and times stated in the table below. All draws will take place at Peregrine Adventures, Level 4, 380 Lonsdale Street, Melbourne, Victoria 3000 on the dates and times stated below. All times stated in the table are in AEDST. Non-winning entries in each draw will be entered into any subsequent draws.

10. Winners will be notified by email and their names will be published in The Australian on 07/12/12. Winners’ names will also be published on the Peregrine Adventures Facebook Page on the same day of the draw.
11. The first valid entry drawn in each weekday draw will win a Peregrine Adventures tour. The tour prize to be awarded in each draw is outlined in the table below. The number of places on the tour provided as part of each prize is also stated below (all participants of a tour must be aged 18 years or over). All tours must be taken by 30/09/13.

12. Prizes are provided on a twin-share basis. Each winner may be sharing a room with another member of the tour group, and is dependant on the number of travellers on the tour at departure. All prize values listed above are correct as at 5 September 2012. The Promoter is also not responsible for any variation in the value of any prize or tour itinerary that occurs after this date. The Promoter also does not accept any responsibility for any variation in the itinerary of the prize that occurs between when the winner is contacted and the date the prize is claimed. All prize values are in Australian dollars.
13. Each tour has set dates. See websites listed above for dates tours may be taken, subject to availability. Spending money, meals, insurance, transport from winner’s home to tour departure point and transport from tour end point to winner’s home (including any airfare costs), transfers, items of a personal nature, in-room charges and all other ancillary costs that are not listed in the prize tour itinerary are not included.
14. Each winner and his/her travel companion (if applicable) are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Each winner and his/her travel companion (if applicable) must travel together. Itinerary to be determined by the Promoter in its absolute discretion. Prize is subject to the standard terms and conditions of individual prize and service providers. Each winner may be required to present their credit card at time of accommodation check in
General
15. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
16. Incomplete or indecipherable entries will be deemed invalid.
17. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
18. The Promoter’s decision is final and no correspondence will be entered into.
19. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize), then the prize (or that element of the prize) will be forfeited.
20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
21. Total prize pool value is AU$141,540.
22. Prizes, or any unused portion of a prize, are not transferable, not exchangeable, not refundable, cannot be sold or exchanged for cash and cannot be used in conjunction with any other offer.
23. A draw for any unclaimed prizes may take place on 04/03/13 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and their names will be published in The Australian on 08/03/13.
24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
26. Any cost associated with accessing the promotional website and Facebook Page is the entrant’s responsibility and is dependent on the Internet service provider used.
27. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia and New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
30. As a condition of accepting a prize, each winner (and his/her companion, if prize is for more than one person) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
31. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
32. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
33. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained  by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
34. The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
