By entering, entrants accept these conditions. 2 Entry is open only to Australian residents (excluding Northern Territory residents), aged 18 or over except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with this competition. 3 The competition begins at 12.01am (AEST) on 12/10/12 (Commencement Date) and closes to consumers at 11.59pm (AEST) on 27/06/13 (Competition Period). The competition ends either: (a) on the final draw date, being 28 June 2013 in accordance with clause 7 and clause 9; or (b) if necessary, on the draw date for any unclaimed prizes, being 1 October 2013 in accordance with clause 18. 4 To enter, entrants must, during the Competition Period, sign up to the Houghton’s database either by: (a) visiting http://www.houghton-wines.com.au (Houghton Website) and fully completing and submitting the online registration form (including by providing their full name, date of birth, email address, postal address and post code), and inserting the promotional key word or the correct answer to the promotional question set out on the Houghton Website; or (b) visiting Houghton Classic Wine’s Facebook page (Houghton Facebook Page) and, if the entrant has not previously done so, clicking on the “like” button on the Houghton Facebook Page; fully completing and submitting the online registration form (including by providing their full name date of birth, email address, postal address and post code) and inserting the promotional key word or the correct answer to the promotional question set out on the registration page. Entrants are responsible for their own costs associated with accessing the internet; 5 Each entrant will receive an online notification confirming their membership and successful entry into the competition. By entering this competition, entrants consent to receiving this electronic message. 6 All entries must be received by the Promoter during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter and not at the time of submission by the entrant. Maximum 1 entry per person per week during the Competition Period. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise including failure of any event to forward entry forms to the draw location. Weekly Prize Draws 7 Each weekly prize draw will be conducted at 12noon (AEST) every Friday commencing 19/10/12 and ending 28/06/13 (37 draws) (Weekly Prize Draw Date) at Kinetic Marketing, 201 Darling St, Balmain, NSW 2041 There will be a total of 37 weekly prize winners (1 prize winner every week for 37 weeks) determined as follows: the first valid entry randomly drawn in each weekly prize draw from all valid entries received during the week previous to the applicable Weekly Prize Draw Date (and excluding the applicable Weekly Prize Draw Date) will win a prize; • if no entries are received during any particular competition week, the weekly prize draw will be postponed to the next Weekly Prize Draw Date and an additional draw will take place on that Weekly Prize Draw Date from all valid entries received previous to that Weekly Prize Draw Date. 8 There are a total of 37 weekly prizes to be won. Each weekly prize is 2 x 750ml bottles of Houghton Classic range wine valued at $26 (inc GST). The total prize pool for all Weekly Prize Draws is valued at $962.00 (inc GST). Monthly Prize Draws 9 Monthly prize draws will be conducted at 12:05pm (AEST) on the last Friday of every month during the Competition Period, commencing 26/10/12 and occurring thereafter on 30/11/12, 28/12/12, 25/01/13, 22/02/13, 29/03/13, 26/04/13, 31/05/13, and 28/06/13 (9 draws) (Monthly Prize Draw Date) at Kinetic Marketing, 201 Darling St, Balmain, NSW 2041. There will be a total of 9 monthly prize winners (1 prize winner for each of the Monthly Prize Draws) determined as follows: • Subject to paragraph 13, the first valid entry randomly drawn in each monthly prize draw from all valid entries received during the month previous to the applicable Monthly Prize Draw Date (and excluding the applicable Monthly Prize Draw Date) will win a prize; • if no entries are received during any particular competition month, the monthly prize draw will be postponed to the next Monthly Prize Draw Date and an additional draw will take place on that Monthly Prize Draw Date from all valid entries received previous to that Monthly Prize Draw Date. 10 There are a total of 9 monthly prizes to be won. Each monthly prize is a picnic pack and 4 x 750ml bottles of Houghton Classic range wine valued at $200 (inc GST). The total prize pool for all Monthly Prize Draws is valued at $1,800 (inc GST). 11 Winners of the Weekly Prize Draw will also be eligible to win the Monthly Prize Draw. 12 There are 46 prizes to be won in total for the competition. The total value of all prizes for the competition is $2,762.00 (inc GST). 13 There will be a maximum of 26 x 750ml bottles of Houghton Classic range wine awarded to entrants residing in NSW throughout the Competition Period. Once 26 x 750ml bottles have been awarded to entrants residing in NSW (whether awarded via the weekly and/or monthly prizes), any further winning entries from NSW will be deemed invalid and will be discarded, and the remaining prizes will be awarded to entrants from ACT/QLD/VIC/SA and TAS. No substitute prize or compensation will be awarded to subsequent NSW entrants whose entries are drawn after the maximum of 26 x 750ml bottles have been awarded to NSW entrants. 14 Where a draw date falls on a public holiday in New South Wales, the draw will take place on the next New South Wales business day. 15 The winners will be notified in writing (via email) and by phone within 2 days of the relevant draw date. The Promoter may publish the name of the winners on the Houghton Website and/or the Houghton Facebook page. 16 The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their names and images in promotional material. 17 If a winning entry is deemed not to comply with these conditions of entry, that entry will be discarded and a new winner of the prize will be determined by drawing a further valid entry in accordance with paragraph 7 (if it is for a weekly prize) or paragraph 9 (if it is for a monthly prize). The judges’ decision is final and no correspondence will be entered into. If any prize is not accepted or claimed within 3 months of the last draw date, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws on 01/10/13 at the same time and location as the original draw as are necessary to distribute any remaining prize/s, subject to any requirements of any gaming authority. Any winners in this draw will be notified in writing (by email). 19 The Promoter may require winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion. 20 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person. 21 This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability. 22 The prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory if required. 23 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 24 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes. 25 If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory if required. 26 The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values. 27 The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. Unless the entrant has marked the “opt-out” box on the entry form, each entrant consents to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products including contacting the entrant via electronic messaging (and entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility).
