These terms and conditions of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.
The Promoter is Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594 119) of 40 Mount Street, North Sydney, New South Wales 2060 (Promoter).
The outlets participating in the Promotion (Participating Outlets) are listed at www.facebook.com/kirksoriginals
The Promotion will be open from 12:01am AEDST on 01/11/2012 until 11:59pm AEDST on 31/12/2012 or once twenty five thousand (25,000) valid entries have been received whichever occurs first (Promotion Period).
Entry in the Promotion is only open to Australian residents aged 18 years and over:
excluding;

management, employees, directors and contractors of the Promoter, its related bodies corporate, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of prizes);
a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5 (a) of these Terms;
persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period;
persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and
persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter.
(Eligible Entrants). The persons referred to in paragraph of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
To be eligible to enter, Eligible Entrants must, during the Promotion Period, purchase either: (a) any four (4) specially marked Kirks® 10 x 375mL Multipacks; or (b) any five (5) specially marked Kirks® 1.25L bottles (Eligible Products), in a single or multiple transactions from a Participating Outlet (Qualifying Purchase).
To enter, Eligible Entrants must, then during the Promotional Period:

visit the Kirks® Australia Facebook page at www.facebook.com/kirksoriginals and enter through the “Budgies or Boardies" (Application) on the Kirks® Australia Facebook Page.
When entering via the Application, Eligible Entrants will be shown the number of Budgies and Boardies and sizes available and remaining. Eligible Entrants must then, via the Application:

input their required personal information, including; name, full address, email address and mobile number;
input the codes (“Entry Codes") found on the specially marked Kirks products for their Qualifying Purchase;
indicate which prize they would like to claim, subject to availability;
enter their payment details (either credit card or PayPal) to pay for the $4.99 postage and handling fee. Payment of $4.99 for postage and handling can only be made via credit card (Visa and Mastercard accepted only) or PayPal. Payment will be processed at the time the claim is submitted online;
agree to the full Terms and Conditions; and
submit the fully completed online claim form
(an Eligible Entry).
For the removal of doubt the number of Budgies and boardies are limited. The claim part of the Application will close once the last Prize has been claimed however, Eligible Entrants will be able to continue to vote for their preference of budgies or boardies. An Eligible Entrants claim choice of either Boardies or Budgies is not linked to their vote in the Facebook debate.
PRIZES
There are up to 25,000 prizes (Prizes) available to be claimed.
Prizes are awarded to the first 25,000 valid entries received.
There are 20,000 pairs of Kirks® branded Mambo designed boardies valued at $39.95 (including GST) (RRP). There will be 7,000 x size 32', 10,000 x size 34' and 3,000 x 36'. There is only one design available for the Mambo designed Boardies. For image of designs see the Kirks® Facebook page.
There will be 5,000 pairs of Kirks® branded Mambo designed Budgies valued at $29.95 (including GST) (RRP). There will be 1,750 x size 32', 2,500x size 34' and 750 x size 36'.. There is only one design available for the Mambo designed Budgies. For image of designs see the Kirks® Facebook page.
Successful Eligible Entrants should allow up to 28 days for delivery of their Prize.
The total value of the Prize pool available to be won in the Promotion is up to AU$948,750.00 (including GST).

VERIFICATION
Eligible Entrants must retain the original purchase receipt/s from their Qualifying Purchase and their label/s from the Eligible Product they purchased as part of their Qualifying Purchase (Proof of Purchase) which corresponds to all entries they submit in the Promotion in order to claim the Prize. Failure to produce the Proof of Purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant's entry and forfeiture of any right to a prize.

GENERAL
Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook.
Each Qualifying Purchase counts towards one (1) entry only.
Only one (1) claim permitted per person.
Eligible Entrants can only enter the Promotion in their own name.
The Promoter accepts no responsibility for any variation in the value of the Prizes.
If the Promoter is unable to provide a winner with a nominated Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize, subject to any directions given by State and Territory regulations.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available, or will be open, at all times during the Promotion Period.
If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State and Territory regulations, including cancelling, terminating, modifying or suspending the Promotion.
Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to claim.
Incomplete, illegible, indecipherable, unrecognised or incorrect entries / Entry Codes will be deemed invalid.
The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award Prizes. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each Eligible Entrant consents to disclosing their personal information to the Promoter and the Promoter using, and disclosing their personal information to the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including suppliers of Prizes for use for, the following purposes:

contacting the entrant in relation to the Promotion;
improving the Promoter's or the Promoter's related entities' goods and services; and
in the Promoter's and its agencies case, the purposes set out in the Promoter's privacy policy (available by writing to the Promoter at the address set out in paragraph of these Terms).
The Eligible Entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Eligible Entrants can also gain access to, update or correct any personal information held by the Promoter by contacting the Promoter at the address set out in paragraph 2 of these Terms. All personal information will be stored at the office of the Promoter.
Eligible Entrants, at the time of entering the Promotion, consent to receive commercial electronic messages and CCA Marketing Communications (as defined in this clause) from the Promoter (Express Consent). The Promoter will use the information provided by the Eligible Entrant to send the Eligible Entrant further communications in relation to special offers, exclusive competitions, news and event information in relation to the Promoter's product range (CCA Marketing Communications). Eligible Entrants may unsubscribe from the CCA Marketing Communications at anytime.
The:

Promoter, the Promoter's related entities, and all agencies associated with the Promotion; and
the employees, agents, directors and contractors, of all entities referred to in paragraph 29(a),
shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of, or participation in, Prizes, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a Prize.
