Competition and Promoter 1.1 By entering the "Palm Springs Golf Getaway" Game of Skill Competition (Competition) and in consideration for the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Information on how to enter and prize details form part of these Conditions of Entry. 1.2 The promoter of the Competition is FOX SPORTS Australia Pty Limited ABN 16 065 445 418 of 55 Pyrmont Bridge Road, Pyrmont NSW 2009 (Promoter). 2. Who may enter 2.1 Subject to paragraph 2.2, entry into the Competition is open to all permanent residents of Australia aged 18 years and over. 2.2 The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter, Delta Air Lines Inc. (Delta), Hyatt Australia Hotel Management Pty Limited (Hyatt) and their related corporations and associated agencies are not eligible to enter the Competition. 2.3 Each entrant may submit an unlimited number of entries in the Competition, provided that each entry is unique. 3. Competition Period 3.1 The Competition commences at 10:00am Australian Eastern Daylight Time (AEDT) on 10 October 2012 and closes at 5:00pm AEDT on 14 November 2012 (Competition Period). 3.2 Entries not received during the Competition Period or not completed in accordance with these Conditions of Entry will not be eligible to win. 4. How to enter Eligible entrants must, during the Competition Period: (a) go to the FOX SPORTS website (www.foxsports.com.au/win) and follow the link to the Competition; (b) enter the details requested; and (c) tell us in 25 words or less, "What would you do to win the Palm Springs Golf Getaway Competition?" (Entry Question). 5. Prize and notification 5.1 Judging of all entries received during the Competition Period will be conducted by the Promoter on 15 November 2012 at 55 Pyrmont Bridge Road, Pyrmont NSW 2009. 5.2 The entrant who submitted the most creative and unique answer to the Entry Question (as judged by the Promoter in its sole discretion) in accordance with these Conditions of Entry will win: (a) return business class airfares for the prize winner and one companion from Sydney to Los Angeles, valued at a maximum of A$22,000; (b) return airport/hotel transfers, valued at a maximum of A$150; and (c) five nights' deluxe king accommodation at the Hyatt Grand Champions Resort, Indian Wells, California, including two rounds of golf (18 holes each) at the Indian Wells Golf Resort, valued at a maximum of A$1,900. 5.3 The maximum total prize value is A$24,050 (including GST). 5.4 The prize winner will be notified by telephone and e-mail on 15 November 2012. The prize winner's name will also be announced during the broadcast of 'The Golf Show' on FOX SPORTS 1HD and 1 commencing at 7:30pm AEDT on 20 November 2012. The prize winner must accept or reject the prize by 9:00am AEDT on 29 November 2012. 5.5 The prize must be taken between 1 January 2013 and 31 December 2013. The Promoter will determine the travel dates in consultation with the prize winner and the prize suppliers (Delta and Hyatt). The travel dates must be determined before 15 November 2013. Blackout dates and periods apply (including, but not limited to, 1 February to 31 March, 12 to 14 April, 19 to 21 April, 27 to 29 April and all public holidays in the State of California). 5.6 Without limiting paragraph 5.9 below, in order to participate in the rounds of golf provided under paragraph 5.2(c), the prize winner and their companion must supply their own golf clubs or hire golf clubs at the Indian Wells Golf Resort at their own expense. 5.7 The Promoter accepts no responsibility for any variation in the value of a prize. The prize is not transferable or exchangeable. The prize is not redeemable for cash and must be taken as offered. If for any reason the prize winner does not take an element of the prize during the stated period and on the conditions stipulated by the Promoter or any third party, that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize. 5.8 In the event that any element of the prize is not available, the Promoter reserves the right to substitute a prize of equal or greater value. 5.9 The prize winner is responsible for all expenses not specified in these Conditions of Entry, including but not limited to, transport to and from Sydney, any transfers not stated above, meals, drinks, insurance (including medical, travel and health), items of personal nature (including gratuities, telephone and in-room charges), spending money and all other ancillary costs. 5.10 The prize winner and their companion are responsible for travel documentation (including passports and visas) and compliance with any health or other government requirements. 5.11 The prize winner acknowledges that the prize is subject to additional terms and conditions imposed by third party prize suppliers, including Hyatt and Delta. The prize winner must become acquainted with any such additional terms and conditions prior to taking the prize. Without limiting this paragraph, the prize winner and their companion must comply with the Indian Wells Golf Club dress code. The Promoter does not accept responsibility and is not liable for any conditions imposed on the taking of the prize by Hyatt, Delta, the Indian Wells Golf Club or any other third party prize supplier, or the breach of those conditions by any person. 5.12 Prize travel is subject to fare rules and other conditions of carriage. Tickets will not be exchanged for another destination. The prize winner and their companion cannot upgrade any prize travel or prize accommodation using cash or frequent flyer points and will not accrue frequent flyer points on any prize flights or with any prize accommodation. The prize winner and their companion must travel together on the same flights on all sectors and stay together at the nominated hotel. Prize travel must be taken in order to coincide with the prize in paragraph 5.2 above. Prize travel may not be changed by the prize winner under any circumstances. If the prize winner cannot travel in accordance with these Conditions of Entry and on the flights nominated by the Promoter, the prize will be forfeited. Bookings will be made by the Promoter. Flight schedules and accommodation arrangements are subject to change without notice. 6. Unclaimed prizes If the prize is unclaimed by 9:00am AEDT on 29 November 2012, it will be awarded to the entrant who submitted the next most creative and unique answer to the Entry Question (as determined by the Promoter in its absolute discretion). The unclaimed prize winner will be notified by telephone and email on 29 November 2012. The process will be repeated every 24 hours until a prize winner is contacted and the prize is claimed. The prize remains the property of the Promoter until it is collected by the selected prize winner or unclaimed prize winner as the case may be. 7. Information for Prize Winner All entrants agree to provide the Promoter with identification and/or proof of age if selected as a prize winner. In accepting a prize, the prize winner agrees to the release set out below. The form of identification and/or proof of age are at the discretion of the Promoter. 8. Limitation of Liability 8.1 Except for any liability that cannot by law be excluded (including as set out under paragraph 8.3), the Promoter, its related corporations and associated agencies (and any of their personnel) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant (including the prize winner and their companion) in connection with the Competition or a prize, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, its related corporations and associated agencies (and any of their personnel); and (iii) any liability for personal injury or death. 8.2 No responsibility will be taken by the Promoter or its authorised agents for lost, ineligible, misdirected or late entries due to technical reasons or any other reason. Entries that are not genuine or are incomplete, late or in any way fraudulent will be declared void. 8.3 Nothing in these Conditions of Entry limits, excludes or modifies, or purports to limit, exclude or modify, the statutory implied guarantees/warranties as provided under the Competition and Consumer Act 2010 (Cth) and the ASIC Act 2001 (Cth), including the statutory consumer guarantees under the Australian Consumer Law, or similar laws in the States and Territories of Australia. 9 Privacy By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the entrant's personal information to assist in conducting the Competition or communicating with the entrant in regard to special offers from the Promoter. Without limiting the foregoing, the Promoter may disclose the prize winner's personal information to Delta and Hyatt for the purpose of fulfilling the prize. Entrants in the Competition acknowledge that the Promoter may share an entrant's personal information with the Promoter's Australian related entities which may contact the entrant with special offers. If an entrant elects to receive information from third parties, the Promoter may also disclose the entrant's personal information for that purpose. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). The Promoter's Privacy Policy is available at http://www.foxsports.com.au/privacy. Entrants can access the personal information the Promoter holds about them, notify the Promoter that they do not wish the information to be disclosed or notify the Promoter that they do not wish to receive further promotional material by writing to the Promoter at 55 Pyrmont Bridge Road, Pyrmont NSW 2009. 10 General 10.1 All entries must be original to and created solely by the entrant. All entries and all copyright and other rights in such entries and/or other materials become the property of the Promoter and will not be returned. Each entrant agrees to provide a written assignment of all rights to the Promoter if requested. By submitting an entry and any other materials (save for any personal information) to the Promoter in connection with the Competition, each entrant: (a) specifically authorises the Promoter to use and/or license third parties to use such entry in whole or in part, throughout the universe, in perpetuity in or on any and all media, whether currently in existence or developed in the future, and alone or together or as part of other information, content and/or material of any kind or nature; (b) represents and warrants that all elements contained in the entry or other material: (i) are original to the entrant and fully cleared for use as contemplated in these Conditions of Entry; (ii) do not and will not, in any way, violate or breach any of the terms of any other agreement the entrant may be a party to; (iii) do not contain defamatory, tortious or otherwise unlawful, untrue or inaccurate information, infringe or violate any copyright or other right; or contain any matter the publication or sale of which will violate any law; (iv) are not obscene or likely to cause offence; (v) are not in any way cruel or abusive; and (vi) will not require the Promoter to pay or incur any sums to any person or entity as a result of Promoters' use or exploitation of the same; and (c) unconditionally and irrevocably consents to any act or omission which would otherwise infringe any of their moral rights in the entry and waives all moral rights in the entry that arise outside Australia. 10.2 This Competition is a game of skill. Chance plays no part in determining the prize winner. 10.3 Acceptance of the prize constitutes consent on the prize winner's part to allow the use of the prize winner's name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law. 10.4 No correspondence will be entered into and the judges' decision is final and binding. 10.5 If for any reason the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the fairness or integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the Competition. 10.6 The prize winner is advised that tax implications may arise from the prize and should seek independent financial and taxation advice prior to their acceptance of the prize.
