HOW TO ENTER
 
To be eligible to enter the draw, individuals who are members of the Bras N Things Rewards Program must present their Bras N Things Rewards card at the point of sale when they make a qualifying purchase at any Bras N Things store between 1st October 2012 and 11th November 2012. A qualifying purchase is defined as a purchase of $5.00 (AUD for Australian residents and NZD for New Zealand Residents) or more for existing and newly enrolled Bras N Things Rewards members.
 
With each qualifying purchase made, the entrant will receive a unique transaction code printed on their receipt. To enter the draw, entrants must visit www.brasnthingsrewards.com.au, follow the prompts to the competition entry page, input all requested details including the unique transaction code found on the receipt and submit the fully completed entry form by 11:59pm AEDST on 11th November 2012.
 


TERMS AND CONDITIONS
 
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to Australian and New Zealand residents aged 15 years or older who are members of Bras N Things Rewards. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Multiple are entries permitted, subject to the following: (a) only one (1) entry permitted per qualifying purchase; (b) each entry must be submitted separately and in accordance with entry requirements; (c) only one (1) unique transaction code per entry is permitted; (d) the same unique transaction code cannot be used more than once; and (e) unrecognised transaction codes will be deemed invalid.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Promotion commences on 1 October 2012. Final entries must be received by 11:59pm AEDST on 11 November 2012. The draw will take place at Anisimoff Legal, Suite 3, Erina Plaza, 210 The Central Coast Highway, Erina NSW 2250 on 15 November 2012 at 12pm AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by phone and in writing within two (2) working days of the draw and their names will be published in The Australian on 23 November 2012. The Promoter's decision is final and no correspondence will be entered into.

The first valid entry drawn, from all entries received during the promotional period, will win a holiday for two (2) people to Cayman Villas, Port Douglas (www.caymanvillas.com.au) valued at up to AU$3,700, depending on date and point of departure. Prize includes:
a) return economy airfares from winner's nearest Australian/New Zealand capital city to Cairns, QLD; and
b) five (5) nights' twin share accommodation in a one (1) bedroom Villa at the Cayman Villas, Port Douglas.

Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 31 May 2013 and is subject to booking and flight availability. Prize cannot be taken during Australian or New Zealand school holidays, public holidays or other peak periods. Booking must be made six (6) weeks prior to intended travel.

If the winner of the major prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner's behalf. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.

The winner and their companion must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.

As a condition of accepting the major prize, the winner and companion must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

If for any reason a winner does not take the prize (or element of the prize) by the time stipulated by the Promoter, then the prize (or element of the prize) will be forfeited.

The next ten (10) valid entries will each win:
a) A Pulsar watch (model no. PEGC40X) valued at $295 each; and
b) The '5 Year Engagement' on DVD valued at $30 each.

If any prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Total prize pool for this competition is up to $6,950. Prizes, or any unused portion of a prize, is not transferable or exchangeable and cannot be taken as cash.

A draw for any unclaimed prizes may take place on 15 February 2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners, if any, will be notified by phone and in writing within two (2) working days of the draw and their names will be published in The Australian on 22 February 2013.

In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia and New Zealand ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and as required, to Australian and New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, research, profiling and publicity purposes including sending electronic messages or telephoning the entrant Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
