Information on how to enter and prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions. Eligibility to Enter and Vote 2. Entry is open to residents from Australia, aged 18 years and over only. Individuals who enter via the Facebook Page must be a member of Facebook to enter. Voting is open internationally to persons 13 years of age or over who are Facebook members. 3. Voters under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the voter must read and consent to these Terms and Conditions. Parents/ guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this competition. 4. Directors, management and employees of the Promoter and its agencies directly associated with this Competition are ineligible to enter or vote. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1 st cousin. Competition Period 5. Competition commences 12.00 noon AEST Wednesday 05/09/2012 and closes at 11:59pm AEDST on Tuesday 27/11/2012 (“Competition Period”). To enter, eligible individuals must complete the following steps during the Competition Period: a. take a picture of a favourite old pair of shoes they own (photo must be below 4MB and in JPG or PNG format only). The photo must demonstrate to the Promoter how much the entrant wants a new pair of shoes; b. visit the Women’s Confidential Facebook Page at; www.facebook.com/ womensconfidential (“Facebook Page”) and follow the prompts to the competition entry form or visit www.womensconfidential.com.au and follow the prompts to the competition entry form, input the requested details as prompted including their first name, last name, residential address and valid email address; c. upload the photo taken; d. read and consent to these Terms and Conditions by selecting the relevant tick-box; and e. submit the fully completed entry form. 7. Multiple entries permitted per person, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements. 8. Each entry must: a. not be offensive, defamatory, unlawful or likely to cause offense to other persons; b. be free of any claims, including copyright claims, by other parties; c. not promote or depict illegal or negligent activity; and d. not be in breach of clause 38 of these Terms and Conditions.9. The Promoter may exclude any entry that does not meet the above criteria or is in any way in breach of these Terms and Conditions. The Promoter may also, at any stage; in its absolute discretion remove any entries uploaded to the Facebook Page it later determines to be in breach of these Terms and Conditions. Once a valid entry has been received, the entrant will be provided with details as to its location for viewing and voting on the Facebook Page. How to Vote 10. To vote, eligible individuals must complete the following steps during the Competition Period: a.visit the Women’s Confidential Facebook Page at www.facebook.com/ womensconfidential (“Facebook Page”); b. become a fan of the Facebook Page by clicking the ‘like’ button (if not already a fan); c. select the competition Facebook app and follow the prompts to the voting section; and d. click the ‘vote’ button next to the entry they deem to be the most interesting and original picture. 11. Limit one vote per Facebook account and per person each day. 12. The Promoter reserves the right to exclude any entry that has obtained votes by means of voting exchanges, voting payments or technical interference. Prizes 13. There are a total of thirty five (35) Weekly Prizes to be won and one (1) Voting Prize to be won. Weekly Prizes 14. Entries received throughout the Competition Period will be judged by the Promoter. There will be one judging event taking place each Wednesday from Wednesday 12/09/2012 to Wednesday 28/11/2012 – a total of 12 judging events. This judging will take into account all valid entries received during the previous week (i.e. between 12.00am the previous Wednesday to the judging event date, until 11.59pm the Tuesday immediately before the judging event date, excluding the first week where entries open at 12 noon), and any nonwinning entries received prior to that week but during the Competition Period. 15. Each entry will be judged based on its creative merit and how well they represent in their photo entry that they are in need of new shoes. 16. The best three (3) valid entries, as determined by the Promoter, for each Weekly Prize judging event will each be deemed a winner of a Weekly Prize, excluding the last Weekly Prize judging event, where the best two (2) entries, as determined by the judges will each be deemed a winner of a Weekly Prize. The Weekly Prize is one (1) pair of customised shoes from Shoes of Prey valued at $375 (awarded as an online voucher). Total of thirty five (35) Shoes of Prey vouchers to be won. 17. Any ancillary costs associated with redeeming the voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher. 18. The Promoter may select additional reserve entries that it determines to be the next best in the event of an unclaimed prize or an invalid entry or ineligible entrant being selected as a winner. Voting Prize 19. The valid entry with the highest number of valid votes received during the Competition Period will win a pair of customised shoes from Shoes of Prey valued at $375 (awarded as an online voucher). 20. Any ancillary costs associated with redeeming the voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher. 21. In the event that there is a tie for the highest number of votes, each tied entry will be judged by the Promoter. The tied entry deemed best by the Promoter, based on creative merit will be deemed the Voting Prize winner. 22. The Promoter may select additional reserve entries that it determines to be the next best in the event of an unclaimed prize or an invalid entry or ineligible entrant being selected as a winner. Winner Notification and Publication 23. All prize winners will be notified in writing by email. All prize winners will be announced on the Facebook Page each week for a consecutive 12 weeks from the second week of the Competition Period, until the week after the Competition Period ends. There will be three (3) announcements of winners per week. Announcement of winners will start from the first judging date on Wednesday 12/09/2012 to Wednesday 05/12/2012. General 24. This is a game of skill and chance plays no part in determining the winners. 25. The Promoter's decision is final and no correspondence will be entered into. 26. Total prize pool value is $13,500. 27. The Promoter reserves the right, at any time, to verify the validity of entries, votes, entrants and voters (including an entrant's/voter’s identity, age, place of residence and Bayer Australia Ltd employment status) and to disqualify any entrant/voter who submits an entry/vote that is not in accordance with these Terms and Conditions or who tampers with the entry/voting process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 28. The Promoter reserves the right, at any time: (a) to invalidate any entry or votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or entries or votes that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts; and/or (b) to disqualify any entrant (or invalidate his/her entry) that the Promoter reasonably suspects has paid, bartered or offered payment or other consideration to another person in exchange for entries or has otherwise encouraged or procured any person to submit an entry contrary to these Terms and Conditions. 29. Incomplete or indecipherable entries/votes will be deemed invalid. 30. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 31.The Promoter accepts no responsibility for late, lost or misdirected entries or other communications, or technical difficulties. Entries will be deemed void if forged, manipulated or tampered with in any way.32. If for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. 33.
