GAME RULES The POLIAKOV MUSIK CHALLENGE is a music quiz with several rounds of questions on music clips. The aim is to win the highest number of points in the shortest time possible. At the start of the quiz, players choose the style of music on which they would like to answer questions: ELECTRO or POP. The MOOVIZ category is unlocked when players reach the score of 1,000 points. Ten thirty-second music clips are played in each round. Whilst each music clip is being played, players must choose one of three possible answers comprising a "title" and an "artist". Only one answer can be selected. You earn points for every correct answer. When players select the right answer quickly or several right answers in a row, they earn more points. You earn no points if you select the wrong answer. The Société des Vins et Spiritueux LA MARTINIQUAISE, société par actions simplifiée with a capital of 3,426,700 euros, whose registered office is located in France at 18 rue de l’Entrepôt, 94220 Charenton le Pont, registered with the Registre du Commerce et des Sociétés of Créteil under number 632 003 877 and duly represented by its Chief Executive Officer Mr Cayard (“the Company”), is organizing "POLIAKOV MUSIK CHALLENGE", a free, no purchase necessary, game of skill competition available on the website http://www.facebook.com and more specifically at https://www.facebook.com/POLIAKOV-Vodka-Australia. The company is hereinafter referred to as the "Organizing Company". Participation in the competition constitutes full and unconditional acceptance of these rules. Failure to follow these rules will lead to disqualification and, where relevant, forfeit of prizes. The competition is not sponsored or administered by Facebook. Information is provided to Poliakov and not Facebook. The music rights associated with any prizes awarded under the competition have been acquired from Universal Music France. Article 2: Who can enter the competition? The competition is open to anyone over the age of 18 who lives in Australia. The competition is not open and no prizes will be awarded, whether directly or indirectly and in any form whatsoever, to: - Entrants who are under the age of 18 years, - Members of the Organizing Company, partner companies, sister companies, their employees or associates, including their relatives and spouses, - Anyone who has taken part in the competition in violation of these rules, - Anyone who has provided incomplete or incorrect contact details to the Organizing Company (see Article 10), - Anyone who objects to their personal details, which are required to run the competition properly, being collected, recorded and stored. Article 3: When is the competition open? The "POLIAKOV MUSIK CHALLENGE" competition will be held from 15 October 2012 to 31 May 2013. The Organizing Company reserves the right to extend, suspend or cancel the competition at any time and without notice if circumstances require. The Organizing Company cannot be held liable for this. Insofar as possible, these changes will be announced in advance by all reasonable means. Article 4: How can I enter the competition? To enter the competition, entrants must first be registered or register on the Facebook website to create a Facebook account (www.facebook.com); then go on the Facebook page POLIAKOV Vodka – Australia (https://www.facebook.com/POLIAKOV-Vodka-Australia) and access the "POLIAKOV MUSIK CHALLENGE" tab. To enter, log on to https://www.facebook.com/POLIAKOV-Vodka-Australia, on the "POLIAKOV MUSIK CHALLENGE" tab and complete the online entry form. Entrants are required to provide their contact details (surname, forename, date of birth and email address) to participate in the competition. Entrants can only enter in their own names. Article 5: What are the competition rules? The competition rules for the POLIAKOV MUSIK CHALLENGE will be available on the Facebook page POLIAKOV Vodka – Australia (https://www.facebook.com/POLIAKOV-Vodka-Australia). The POLIAKOV MUSIK CHALLENGE competition is a music quiz with several rounds of questions on music clips (Musik Challenge). It is divided into CONTEST and NON-CONTEST stages (see Article 6). The aim of the competition is to collect the highest number of points in the shortest time possible by answering the musiz quiz questions correctly. At the start of the quiz, entrants choose the style of music on which they would like to answer questions: ELEKTRO or POP. A third category of questions, the MOOVIZ category, is unlocked and made available to entrants when an entrant reaches 1 000 points. The quiz consists of 10 rounds where ten thirty-second music clips are played. Whilst each music clip is being played, entrants are shown three possible answers comprising a "title" and an "artist". Entrants must click on the title and artist that matches the music clip. Only one answer can be selected. You win 20 points at minimum for every right answer. There are no points awarded or deducted for an incorrect answer. When entrants give a right answer quickly or several right answers in a row, they earn more points for those answers. This is known as the "BOOST". The "BOOST" generated by the speed of answering and the number of consecutive right answers is shown by a gauge visible to the entrant as they play. Article 6: What are the competition stages? The POLIAKOV MUSIK CHALLENGE competition will operate in two separate stages, with different prizes available for each stage: The NON-CONTEST stages operate from 16/10/2012 to 04/11/2012 (NON-CONTEST stage 1), from 03/12/2012 to 03/02/2012 (NON-CONTEST stage 2) and from 04/03/2013 to 31/05/2013 (NON-CONTEST stage 3). The CONTEST stages operate from 05/11/2012 to 02/12/2012 (CONTEST stage 1) and from 04/02/2013 to 03/03/2013 (CONTEST stage 2). Entrants can access the Musik Challenge 24/7 by using a standard Internet browser (Firefox, Safari, Chrome or Internet Explorer), from their smartphone or from their tablet using the Facebook Application. The CONTEST stages One CONTEST stage lasts 4 weeks. Every week, a Musik Challenge will be conducted every calendar week during the CONTEST stages. At the beginning of each calendar week during the CONTEST stages, entrants will be given access to the Musik Challenge. The three entrants with the highest scores as at each Sunday at 23:59pm AEST during the CONTEST stages will win the prizes detailed in Article 7. Every Sunday at 23.59 pm during the Contest Stages, the scores will be reset to zero for a new weeklong Musik Challenge. The NON-CONTEST stages A Musik Challenge will be conducted during each NON-CONTEST stage. At the beginning of each NON-CONTEST stage, entrants will be able to access to the Musik Challenge. Entrants who earn 20 000 points in the Musik Challenge will be able to download the Top 10 tracks before 31/05/2013 (see article 9). The scores obtained in each game during a NON-CONTEST stage are added together. Entrants can play as many games as they wish to increase their score. Scores achieved from a NON-CONTEST stage are reset to zero for all entrants at the end of that NON-CONTEST stage. The points accumulated in a NON-CONTEST stage do not apply to and cannot be used in CONTEST stages. Entrants can access their score throughout a NON-CONTEST stage and play to win ten free downloads in the following NON-CONTEST stages. Article 7: How can entrants win? During each NON-CONTEST stage: The first 1 000 entrants over the duration of the competition to reach 20 000 points will all be able to download the Top 10 tracks free of charge, as selected by POLIAKOV (Top 10 Tracks), on the TOP 10 Musik tab of the "POLIAKOV MUSIK CHALLENGE" Facebook page at https://www.facebook.com/POLIAKOV-Vodka-Australia. Winners of each NON-CONTEST stage must download their Top 10 Tracks before 31/05/2013, the date on which the POLIAKOV MUSIK CHALLENGE competition ends. During each CONTEST stage: The winners are the: Three entrants with the highest scores each week, creating 24 winners over the total competition. Where entrants scores are tied, the winner will be the entrant that earned their winning score earlier in time. Article 8: The opportunity to participate and win The Organizing Company is committed to ensuring that all entrants are provided equal opportunity to participate and win prizes in the competition. The Organizing Company may suspend and cancel the participation of one or more entrant(s) if suspicious activity is detected. This includes but is not limited to: the creation of an automated answering system, use by several different persons and computers of the same login, i.e. the same profile registered with the game, unusual rate of success, attempt to hack the organizers’ servers, holding several accounts, unrealistic answering times and 24-hour non-stop playing. The Organizing Company alone decides whether to exclude or reinstate the entrants and/or voters in light of the information in its possession. In the event of a dispute, it is the entrant’s responsibility to provide evidence that they have followed these rules. The Organizing Company cannot be held liable for this. To ensure that all entrants are provided equal opportunity to participate and win prizes, the Organizing Company reserves the right not to award prizes to fraudsters and/or to pursue criminal charges against the perpetrators of fraud. The Organizing Company may cancel all or part of the competition if it appears that fraud has occurred in any shape or form whatsoever, particularly via computer. Article 9: What can be won? During the NON-CONTEST stage, the first 1 000 entrants over the duration of the competition to reach 20 000 points will all be able to download the Top 10 Tracks free of charge, on the TOP 10 Musik tab of the "POLIAKOV MUSIK CHALLENGE" Facebook page at https://www.facebook.com/POLIAKOV-Vodka-Australia Winners must download their tracks before 31/05/2013, the date on which the competition ends. During the CONTEST stage, the 24 entrants chosen subject to the terms and conditions outlined in Article 7 will win the following prizes. The competition will reward the three entrants who have achieved the highest scores at the end of each week. There are twelve prizes to win per CONTEST stage: First score for first 3 weeks : Samsung Galaxy Tab2 10,1 16G – Value: $388 First score for the 4th and last week : A summer music festival experience for the winner and 3 friends. The prize includes flights, accommodation and 4 x VIP passes to an [Australian summer music festival] of the winner's choice up to a value of $ 3,000 - Winner to claim the prize within 21 days and required to book the festival within 12 months of being notified of the prize. In case of the choice of a music festival and location over $3,000, the supplement is at the charge of the winner. Second score: Logitech Pure-Fi Anywhere – Value: $95 Third score: Philips Oneill Strech White – Value: $88 Total value of the prizes per Contest stage : $4,896 Total value of the prizes awarded to winners of the CONTEST stages of the competition: $9,792 The competition winners of the CONTEST stages will be contacted by email and the result will be posted at the start of each week on the POLIAKOV Vodka - Australia Facebook page (https://www.facebook.com/POLIAKOV-Vodka-Australia). Winners of the CONTEST stages will have one month to send a copy of their Australian drivers licence or passport proving that they are over the age of 18 and live in Australia. If winners fail to respond within one month of being notified by the Organising Company, they forfeit their prize. Except in the case of force majeure, all of the prizes won during the CONTEST stage will then be sent to the winners within four to six weeks of the Organising Company receiving a copy of winners Australian drivers licence or passport, provided that there is a full and accurate address. Under no circumstances can the prizes be exchanged for cash or any other prize. Prizes will only be delivered to addresses in Australia. Entrants agree to provide accurate information. Entrants are responsible for the accuracy of the information that they have provided at all times. Therefore, they are responsible for updating their address and providing their new contact details to the Organizing Company if they move home. If circumstances require, the Organizing Company reserves the right to replace a prize with any other prize, in which case winners will not be entitled to claim any compensation whatsoever other than the replacement prize. Only one prize from the CONTEST stages will be awarded per household (same name, address and telephone number provided by entrants when registering) throughout the competition, whether or not the phone line or web address used to take part is in their name. If winners provide incomplete or inaccurate contact details, they will be exempt from the competition and forfeit their prize. Article 10: Do I have to give my personal details? It is expressly stated that an entrant’s participation in the competition and direct or indirect acceptance of a prize implies unreserved agreement to the collection, registration and storage of their personal details, which are required to run the competition properly. The personal details of competition entrants will be computer processed. These details are the surname, forename, date of birth, email address, mobile phone number and postal address of entrants. The Organizing Company receives the personal details. Competition entrants have the right to access, correct and remove their personal details. To exercise this right and see a copy of the information held on them, they should write to LA MARTINIQUAISE, 18 rue de l’Entrepôt, 94220 Charenton le Pont, FRANCE. If they are winners, entrants authorize the Organizing Company to use their name and/or photograph in any advertising or promotional campaigns associated with the competition during the competition and for three months after it ends. This includes use of the entrants name and/or photograph on the leaderboards displayed on the "POLIAKOV MUSIK CHALLENGE" tab on the Facebook page POLIAKOV Vodka - Australia (https://www.facebook.com/POLIAKOV-Vodka-Australia). Entrants can oppose this use in writing, without this entitling them to any payments or benefits whatsoever other than the prize they may have won. Article 11: How can I obtain a copy of the competition rules? The full competition rules are available on the "POLIAKOV MUSIK CHALLENGE" app. To see the rules, it is first necessary to access the "POLIAKOV MUSIK CHALLENGE" tab on the Facebook page POLIAKOV Vodka - Australia (https://www.facebook.com/POLIAKOV-Vodka-Australia). Article 12: Liability The Organizing Company cannot under any circumstances be held liable if entrants are unable to access the competition for technical reasons, e.g. a problem with access to the Internet. In this eventuality, entrants will not be entitled to claim any compensation whatsoever. The Organizing Company cannot be held liable for strikes or delays in the prize delivery services that prevent the winner from receiving and enjoying their prize. The Organizing Company accepts no liability for loss, damage and/or theft of the prizes during delivery. The Organizing Company cannot be held liable if, for reasons beyond its control, the competition is changed, shortened, delayed or cancelled in total or in part without notice if circumstances so require. Insofar as possible, these changes will be announced in advance by all reasonable means. No exchange value of the competition prizes will be offered in compensation. The Organizing Company is not the supplier, seller or distributor of the prizes and it accepts no liability for the delivery, correct operation, use, compliance with standards to which they are subject, safety and/or enjoyment of the prizes awarded. Therefore, winners declare that they have been informed and expressly agree that the Organizing Company cannot be held liable for any loss or damage whatsoever (personal, physical, material, financial or other) or any incident occurring during participation in the competition and thereafter. The Organizing Company accepts no liability for any loss or damage incurred by the winner during use or enjoyment of the prize. As no purchase is necessary to enter the competition, it is expressly agreed that the liability of the Organizing Company is limited — if it were held liable — to a lump sum amount between one dollar and the average value of the prize awarded as first during the CONTEST stages of the competition. Article 13: Associated costs All costs associated with entry into the competition will be incurred by the entrant, including but not limited to interest usage, postage and any data costs. Article 14: General terms and conditions Participating in the competition and accepting a prize constitutes full and unreserved acceptance of these rules and the results. Any issue involving the competition must be raised by recorded delivery letter within 1 (one) month of the end of the competition. Any dispute that cannot be settled amicably by the Organizing Company will be brought before the competent courts under the applicable law. The law applicable to these rules is Australian law. Cancelling a clause or part of a clause does not render these rules invalid and the other clauses or part of clause remain(s) in force, applicable and binding upon entrants. |
