CONDITIONS OF ENTRY
By entering this Promotion, Entrants agree to abide by these Conditions of Entry. The Promoter is Defected Pty Ltd (trading as The Defectors) ABN 22 140 475 798 of 3/145 William St, Darlinghurst, New South Wales, Telephone (02) 9993 0450 on behalf of T.M. Lewin Australia Pty Ltd, ABN Number 89155226556, 129 King Street, Sydney NSW 2000.
This Promotion is not sponsored, endorsed, administered by or associated with Facebook.
The Promotion commences as 11.01am AEDT on 20 November 2012 and closes at 16.59pm AEDT on 17 December 2012 (Promotion Period).
Entry is open to any Australian resident aged 13 years or older (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the promotion and their related companies are ineligible to enter.
To enter the Promotion, Entrants must “Like” the T.M.Lewin Australia Facebook page at http://www.facebook.com/TMLewinAus then accurately complete an online entry form on the T.M.Lewin Australia Facebook page and submit it so that it is received during the Promotion Period (Entry).
Only one Entry is permitted per Entrant. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promotion database. The Promoter is not responsible for any delay in, or failure of, transmission which causes an Entry not to be received within the Promotion Period.
The total Prize Pool is valued at $828.75. There is only one (1) Prize which includes 1 x T.M.Lewin Black Dinner Suit (RRP $549.00), 1 x T.M.Lewin Bow Tie (RRP $ 34.95), 1 x pair of T.M.Lewin Dress Studs ($24.95), 1 x pair of T.M.Lewin cufflinks (RRP $59.95), 1 x T.M.Lewin cumber band ($59.95, and 1 x T.M.Lewin white dinner suit shirt (RRP $99.95)
The Prize Draw will be conducted at 11.00am AEDT on 18 December 2012 at 3/145 William St, Darlinghurst, New South Wales. The Winner of the Prize will be the first valid Entry drawn. Prizes are not transferable or exchangeable.
The Winner will be notified by email within two days of the Prize Draw, will receive written confirmation within twenty-one days and their name will be published in The Australian newspaper on 27 December 2012. In their written confirmation, winners will be provided with details of how to claim their Prize and the date by which they must claim their Prize (Prize Claim Date). Winners may need to provide sufficient identification in order to claim their Prize.
If the Prize is unclaimed by the Prize Claim Date, subject to any directions from a regulatory authority, the Promoter may conduct a further draw on 19 March 2013 at the same time and location as the Prize Draw, in order to distribute the unclaimed Prize (Unclaimed Prize Draw). In the case of a winner, they will be notified by telephone within two days of the Unclaimed Prize Draw, receive written confirmation within twenty-one days and their names will be published in The Australian newspaper on 26 March 2013.
The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.
The Promoter is not liable for any loss, damage or personal injury suffered or sustained as a result of, in connection with, or arising out of the Promotion or taking the Prize.
If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
The collection, use and disclosure of personal information in connection with the Promotion is governed by the Privacy Act 1988 (Cth). By entering the Promotion, Entrants agree and consent to the Promoter:
I. using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming the Prizes and any other matter connected to or incidental to the Promotion;
II. using the Entrant’s personal information for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including email and SMS, unless an Entrant otherwise withdraws their consent to the use of their information in this manner; and
III. using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and for any other purpose at the Promoter’s sole discretion.
