CONDITIONS OF ENTRY

These terms and conditions of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.


The Promoter is Fonterra Brands (Australia) Pty Ltd (ABN 80 095 181 669) of 327 Ferntree Gully Rd, Mount Waverley VIC 3149, telephone (03) 8541 1500. (Promoter)
PROMOTION PERIOD

The Promotion will be open from 00:01AEDT on 14/11/2012 until 23:59 AEDT on 14/12/2012 (Promotion Period).


Participating outlets are all Woolworths Outlets across Australia (Participating Outlet).


Entry in the Promotion is only open to Australian residents excluding: (a)   management, employees, directors and contractors of the Promoter, its related entities, firms or companies associated with the Promotion (including suppliers of Instant Prizes); (b)   a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Terms; (c)   persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period; (d)   persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and (e)   persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter, (Eligible Entrants). The persons referred to in paragraph 5(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
HOW TO ENTER

To enter Eligible Entrants must, during the Promotion Period, purchase any two (2) Western Star or Mainland products (Eligible Products) in one (1) transaction from a Participating Outlet (Qualifying Purchase); and (a)   retain a copy of the purchase receipt from their Qualifying Purchase (Proof of Purchase); (b)   complete their entry in accordance with these Terms (Eligible Entry).


Eligible Entrants can complete their Eligible Entry during the Promotion Period by: (a)   visiting www.itsnotChristmaswithout.com.au and follow the links to the Promotion site (Online Entry Site); (b)   fully completing the online Promotion entry form on the Online Entry Site (Online Entry Form), including: (i)   all details required on the Online Entry Form, including residential address (no Post Boxes accepted), the last five (5) digits of two (2) Eligible Product barcodes (Valid Barcodes) and the last three (3) digits of their purchase receipt evidencing their Qualifying Purchase; (ii) indicating their acceptance of these Terms (Web Entry).


When an Eligible Entrant submits a Web Entry: (a)   which complies with these Terms, they will receive an on-screen notification confirming that their Web Entry is valid and has been received and whether it is a winning entry or not; or (b) which does not comply with these Terms, they will receive an on-screen notification that their Web Entry is invalid, whichever is applicable in the circumstances.


There is a limit to the number of invalid barcodes that may be submitted by entrants in attempting to enter the Promotion. The Promoter may, at its absolute discretion, block and / or disqualify Entrants from submitting further entries into the Promotion where they have reached that limit. Entrants will be advised that they have been blocked and / or disqualified from submitting further entries into the Promotion if they are blocked and / or disqualified.


The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that any entry mechanism will be available at all times or that a Participating Outlet will be open at all times throughout the Promotion Period.


The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means invalid.
VERIFICATION

Entrants must retain their original or a photocopy of their store purchase receipt(s) evidencing their Qualifying Purchase (Proof of Purchase) which corresponds to each entry they submit in the Promotion in order to claim an Instant Prize (if won). Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrants entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.


If the items required by the Promoter are not received or an entrant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the entry(s) submitted by the entrant will be deemed invalid and the Instant Prize will form part of the Unclaimed Instant Prize Draw.
INSTANT PRIZE DRAWS & INSTANT PRIZE INFORMATION

All random electronic prize draws will take place at 403 / 62 Beach Street Port Melbourne VIC 3207 (Draw Location). 100 computer generated random times (Winning Time) will be selected each day of the Promotion Period. The first Eligible Entry drawn on or after each Winning Time will win an Instant Prize as described in paragraph 17 (Instant Prize Draws). There will be 3,100 Instant Prize Draws in total.


Each Instant Prize is a Nigella Christmas book, written by Nigella Lawson valued at $69.95 (RRP) (including GST) (Instant Prize).


The total value of all Instant Prizes available to be won in the Promotion is up to $216,845 (RRP) (including GST).
NOTIFICATION OF INSTANT PRIZE WINNERS

Instant Prize winners will be notified onscreen at the time of submitting their entry. All Instant Prize winners will be required to send their Proof of Purchase to the Promoter to validate their entries submitted. Instant Prize winners will also be notified by phone and in writing.
UNCLAIMED INSTANT PRIZE DRAW

If an Instant Prize is won by an Eligible Entrant and they do not claim, or their claim is not validated to the satisfaction of the Promoter, their Instant Prize by 12 noon AEDT on 29/03/2013 a random electronic re-draw will be conducted on that date at 12 noon AEDT at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the Promotion, subject to any directions from the State and Territory Gaming Departments (Unclaimed Instant Prize Draw).
NOTIFICATIONS OF UNCLAIMED INSTANT PRIZE DRAW WINNERS

Unclaimed Instant Prize Draw winner(s), if any, will be notified by phone and in writing.


Instant Prizes will be delivered to the residential address as advised by the respective Instant Prize winners within 28 days.


If more than one person attempts to claim an Instant Prize, the Promoter has sole and absolute discretion to determine which of those persons the winning entrant is.
GENERAL

Each Qualifying Purchase counts towards one (1) entry only.


There is a maximum of one (1) Eligible Entry per household on any given day throughout the Promotion Period.


Limit of one (1) Instant Prize may be awarded per household (excluding South Australia residents).


The Promoter shall not be liable for a prize being lost, stolen, damaged or tampered with in any way before they reach the winners or after it has been released to the winners.


The Promoter accepts no responsibility for any variation in the value of the Instant Prizes from time of printing Promotion materials.


If the Promoter is unable to provide a winner(s) with the nominated Instant Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated Instant Prize, subject to any directions given by the State and Territory Gaming Departments.


The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries.


If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State and Territory Gaming regulations, including cancelling, terminating, modifying or suspending the Promotion.


Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism or Instant Prize Draws in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.


Incomplete, illegible, indecipherable or incorrect entries are not eligible to win.


The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.


The: (a)   Promoter, the Promoter's related entities and all agencies associated with the Promotion; and (b)   employees, agents, directors and contractors, of all entities referred to in paragraph 34 (a), shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of Instant Prizes, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).


Instant Prize winners must, at the Promoter's request, participate in any Promotion activity (such as publicity and photography) relating to winning an Instant Prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material.


CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the promoter reserves the right to seek damages to the fullest extent permitted by law.
PERSONAL INFORMATION

All entries become the sole property of the Promoter.


All information entrants provide (Personal Information) will be used by the Promoter for the purpose of conducting this Promotion and may be entered into a database and the Promoter, the Promoter's related entities, agencies engaged by the Promoter, or any other third party nominated by the Promoter, for the Promoter's current and future promotional and marketing purposes without further reference or compensation to them.


The Promoter may disclose Entrants' Personal Information to its contractors and agents to assist in conducting this Promotion and as required, to Australian regulatory authorities.


Entrants can request access to update or correct their Personal Information held by the Promoter and may request that they not receive further Promotional or marketing communications from the Promoter by contacting the Promoter at the address above. Should an Entrant's contact details change during the Promotion Period, it is the Entrant's responsibility to notify the Promoter.


The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
