Conditions
These terms and conditions of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.


The Promoter is Appletiser S.A. (pty) Ltd of Level 1, Cnr R44 & Main Road, Somerset West 7130, South Africa (Promoter), distributed in Australia by Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594 119) of 40 Mount Street, North Sydney, New South Wales 2060 (co-Promoter NSW and ACT only).


The outlets participating in the Promotion (Participating Outlets) are any outlets in Australia that stock the eligible Appletiser products (as set out in paragraph 6(a) below). For a list of Participating Outlets please call 1800 025 123.


The Promotion will be open from 09:00am AEDST on 8th November 2012 until 11:59pm AEDST on 31st January 2013 (Promotion Period).


Entry in the Promotion is only open to Australian residents aged 18 years and over, excluding: (a)management, employees, directors and contractors of the Promoter, its related entities, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of prizes); (b)a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Terms; (c)persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period; (d)persons who have used or attempted to use any more than one name in order to qualify to win a Promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and (e) persons who have breached the terms and conditions of any Promotion run by or on behalf of the Promoter, (Eligible Entrants). The persons referred to in paragraph 5(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
HOW TO ENTER

To enter and be eligible to win, Eligible Entrants must , during the Promotion Period: (a)purchase one or more of the following eligible Appletiser products (Eligible Products) in a single transaction from a Participating Outlet: (i)Appletiser 750mL; (ii)Red Grapetiser 750mL; (iii)White Grapetiser 750mL; (iv)Appletiser 275mL; (v)Red Grapetiser 275mL; (vi)Appletiser 250mL; (vii) Red Grapetiser 250mL; (viii)Appletiser 4 x 250mL Pack; (ix)Red Grapetiser 4 x 250mL Pack; or (x)Appletiser 15 x 375ml Pack, (Qualifying Transaction); (b)visit the Appletiser Australia Facebook Page at www.facebook.com/AppletiserAU (Facebook Page), “like” the Page (if not an existing fan of the Page), follow the prompts to the promotion entry page, and fully complete and submit the entry form so that it is received by 11:59pm AEDST on 31st January 2013. The Facebook Page will be managed by Prime Focus (Suite 403/62, Port Melbourne, Victoria 3207) on behalf of the Promoter. (an Eligible Entry).
DRAW AND PRIZES

Weekly Draws

There will be twelve (12) Weekly Prize Draws in total (one (1) draw for each week of the Promotional Period). Entries for each draw open at 12:00am AEDST and close at 11:59pm AEDST on the dates specified in the table below (with the exception of the first Weekly Prize Draw 1, which opens at 9:00am AEDST). Weekly Prize Draws will be conducted at Suite 403/62, Beach Street, Port Melbourne, Victoria 3207 at 12:00pm AEDST on the dates specified in the table below. All non-winning Eligible Entries each week will roll over to future Weekly Prize Draws, and all entries (including winners in a Weekly Prize Draw) will be entered into the Major Prize Draw.

The first Eligible Entrant with a valid Eligible Entry drawn in each Weekly Prize Draw will each win a $500 EFTPOS Card (Weekly Prize).


Any ancillary costs associated with redeeming the EFTPOS Card are not included. Any unused balance of the EFTPOS Card will not be awarded as cash. There is a $10.00 per card cancellation or replacement fee in addition to the cost of the card production. Your Card will require activation prior to use. Once activated, funds are available by 12 pm the following business day. Major Prize Draw

The Major Prize Draw will be conducted at Suite 403/62, Beach Street, Port Melbourne, Victoria 3207 on the 1st February 2013 at 12:00pm AEDST.


The first Eligible Entrant with a valid Eligible Entry drawn in the Major Prize Draw will win a trip to New York City, USA for two (2) people, valued at up to AU$13,500.00 (including GST) depending on the date and point of departure, including: (a)two (2) x return economy flights from the international airport in the Australian capital city nearest to the winner’s residence to New York City, including taxes and checked luggage allowance for two (2) people (up to 20kgs of checked luggage for each person); (b)six (6) nights twin share accommodation in a 4 star Manhattan hotel (Accommodation); (c)coach transfers for two (2) people from the airport in NYC to the Accommodation; (d)dinner at Balthazar Restaurant for two (2) people (to the maximum value of US$150.00 total); and (e)AU$1,000 spending money for the winner only, (Major Prize). The Major Prize prize must be booked through Granted Worldwide.


The Major Prize winner (and his/her companion) must depart from and return to the same departure point and travel together. All components of the Major Prize must be taken together in a single trip and cannot be redeemed separately.


The Major Prize dates of travel must be confirmed with the Promoter within 2 months of the draw date.


The travel must be completed within 12 months of draw date, and is subject to booking and flight availability.


Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary.


Any components of the Major Prize not used by the winner or their nominated travel companion are forfeited and the Promoter is not obliged to provide the winner or their nominated travel companion with the cash equivalent of or any substitute for any Major Prize component in those circumstances.


Penalties may apply for re-booking, amending, extending or cancelling travel and/or accommodation, and the responsibility or winners and/or their nominated travel companion as the case may be.


Travel and Accommodation are subject to availability at the time of booking.


Frequent flyer points will not form part of the prize. Acceptance and use of the Major Prize is subject to the Major Prize winner and their nominated travel companion: (a)agreeing to comply with all applicable laws and cultural mores in the United States of America; and (b)agreeing not to act or fail to act in a manner which brings or may in the Promoter's opinion bring the Promoter or its related entities into disrepute, during the course of their participation in the Major Prize.


The Major Prize winner and their nominated travel companion must have a valid passport with 6 months or more remaining before expiration when they arrive back in Australia following the completion of their trip.


Unless expressly stated all other costs and expenses associated with taking the Major Prize become the responsibility of the Major Prize winner including: (a)Costs associated with Visa applications; (b)Costs associated with Passport applications; (c) Additional taxes (excluding airline and airport taxes); (d)Costs associated with inoculations; (e)Transport to and from the departure point; (f)Additional transfers; (g)Insurance; (h)Additional spending money; (i)Meals (not specified); (j)Domestic airfares to the winner’s nearest Australian State Capital City, if required; (k)Any sightseeing or activities; (l)Any additional accommodation; (m)In-room charges; (n)Items of a personal nature; (o)Personal spending money; and (p)All other incidental and ancillary costs, incurred by the Major Prize winner and/or their travel partner as a direct or indirect result of taking the Major Prize that are not otherwise stated as included in the Major Prize.


Credit card imprint or cash deposit maybe required from the Major Prize winner and/or travel companion at check-in to the Accommodation for all incidental charges.


During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.


As a condition of accepting a prize, each winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter/prize supplier/organisers in their absolute discretion including but not limited to a legal release and indemnity form. In the event that the companion of the Major Prize winner is under the age of 18, their parent/guardian must sign any legal documentation on their behalf.


The Major Prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The prize (and any element of the prize) is not transferable to another person (unless agreed by the Promoter) or exchangeable for other goods and services and cannot be redeemed as cash. The itinerary is to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary.


Winners final travel itinerary and all applicable documentation, e-tickets and vouchers are sent via registered Australia Post to the Major Prize Draw winner’s nominated residential address no later than 2 weeks prior to departure from Australia.


It is the Major Prize winner’s and their travel companion’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports, visas, and health requirements, which meet the requirements of immigration and other government authorities in the USA and any stopover destinations. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Major Prize winner and their travel companion. The Promoter takes no responsibility for forfeiture of travel as a result of a failure to meet such requirements.


The Major Prize winner must have a valid bank account and the AUD$1,000 spending money awarded as part of the prize will be deposited directly into their bank account or provided as a “not-negotiable” cheque that must be paid into the valid bank account. Under no circumstances will the spending money be provided as cash.


The Promoter makes no representation as to the safety conditions or any other conditions that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
NOTIFICATION

The winners of the Weekly Prize Draw and the Major Prize Draw will each be notified within two (2) days of the draw by phone and in writing. All winners’ names will be published in The Australian newspaper on 15th February 2013 and within 14 days of each draw on the Appletiser Australia website (www.appletiser.com.au).
VERIFICATION

Entrants must retain the original barcode(s) from their Qualifying Transaction(s) (Proof of Purchase) which corresponds to the entry they submit in the Promotion in order to claim the prize (if won). Failure to produce the required barcode(s) for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Entrant’s entries and forfeiture of any right to a prize.


If requested by the Promoter, the prize winner(s) must produce, within the time requested by the Promoter at its absolute discretion: (a)appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim the prize(s) and compliance with these Terms; and (b)their Proof of Purchase that corresponds to all entries they have submitted in the Promotion, before the Promoter issues the relevant prize. If the items required by the Promoter are not received or a provisional winning entry has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the provisional winner's entry will be invalid and, at the Promoter's absolute discretion, all of the provisional winner's remaining entries will be invalid. Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.
GENERAL

Total prize pool value is up to AU$19,500.00 (including GST).


Winners will have until 3:00pm AEST on 2nd May 2013 to claim their prize, failing which their right to the prize shall be forfeited. An unclaimed prize draw will be conducted at 3:00pm AEST on the 7th May 2013 at the same place as the original draws, from all remaining Eligible Entries received in the Promotion. Winner(s), if any, will be notified by phone and in writing within two (2) days of the draw, and their name(s) will be published in The Australian newspaper on 13th May 2013. These prizes must be claimed by 21st May 2013. In the event that any winner does not claim the prize by this date, the prize will be automatically forfeited by the winner and cash will not be awarded in lieu of the prize. The forfeited prize(s) will, subject to any written directions from the various state and/or territory regulatory authority, be donated to a charity of the Promoter’s choice.


If more than one person attempts to claim a particular prize, the Promoter has sole and absolute discretion to determine which of those persons is the winning Eligible Entrant.


Eligible Entrants may enter the Promotion as many times as they wish, subject to the following conditions: (a)only one (1) entry permitted per Qualifying Transaction (regardless of the number of Eligible Products purchased in excess of one (1) in that transaction); (b)each entry must be submitted separately in accordance with these Terms; (c)unrecognised barcode numbers will be deemed invalid; (d)a maximum of one (1) entry per person per day is permitted;


Entrants can only enter the Promotion in their own name.


Prizes (or any element of a prize) are not transferable, exchangeable or redeemable for cash. Prizes must be taken as offered and may not be varied.


To the extent permitted by law, the Promoter shall not be liable for prizes being lost, stolen, damaged or tampered with in any way before the prizes reach the winners.


Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize), then the prize (or that element of the prize) will be forfeited.


The Promoter accepts no responsibility for any variation in the value of the prizes.


If the Promoter is unable to provide a winner with a nominated prize (or part of any prize), the Promoter reserves the right to supply an alternative prize of equal monetary value to the nominated prize (or that part of any prize), subject to any directions given by the relevant State and Territory Gaming Departments.


The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries.


If, for any reason, the Promotion is not capable of being run as planned, including due to electronic draw element in the Promotion being infected by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State and Territory regulations, including cancelling, terminating, modifying or suspending the Promotion.


Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism or any draw in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.


Incomplete or indecipherable entries are not eligible to win.


The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each Eligible Entrant and no correspondence will be entered into.


Any cost associated with accessing the Facebook Page is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.


The Promoter collects (and Prime Focus collects on the Promoter's behalf) personal information about Eligible Entrants to include Eligible Entrants in the Promotion and where appropriate award prizes. If the personal information requested is not provided, the Eligible Entrant cannot participate in the Promotion. By participating in the Promotion, each Eligible Entrant consents to Prime Focus disclosing their personal information to the Promoter and the Promoter using, and disclosing their personal information to the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including prize suppliers) and, as required, to Australian regulatory authorities. The Promoter may use this information for use for, the following purposes: (a)contacting the Eligible Entrant in relation to the Promotion; (b)improving the Promoter's or the Promoter's related entities' goods and services; (c)contacting the Eligible Entrant in the future for the Promoter's, the Promoter's related entities' or the Participating Outlets' purposes via any medium including mail, telephone (regardless of whether the Eligible Entrant is registered on the Do Not Call Register) and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other media including media not yet in existence at the time of the Promotion; and (d)in the Promoter's and its agencies’ case, the purposes set out in the Promoter's privacy policy (available by writing to the Promoter at the address set out in paragraph 2 of these Terms). The Eligible Entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Eligible Entrants can also gain access to, update or correct any personal information held by Prime Focus by contacting Prime Focus at PO Box 365, Port Melbourne, Victoria 3207. All personal information will be stored at the office of the Promoter and/or Prime Focus as the case may be.


By entering the Promotion, Eligible Entrants agree and acknowledge: (a)they may be contacted by the Promoter (or an agent of the Promoter) to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos or recordings of them; (b)the Promoter may use any comments obtained from them, their name, and/or likeness and any photos or recordings taken of them (the Materials) for the Promoter's future promotional and marketing purposes without further reference or compensation to them; (c)the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means (including communicating them to the public in any media, including media not yet in existence). The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same; (d) they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose it determines; (e)they unconditionally and irrevocably: (f)consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights); and (g)waive all Moral Rights in the Materials that arise outside Australia; and (h)they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.


Eligible Entrants may, at the time of entering the Promotion, consent to receive commercial electronic messages and CCA Marketing Communications (as defined in this clause) from the Promoter by checking the tick box next to the following message: "I would like to sign up to receive information on special offers, exclusive competitions, and more from Coca-Cola Amatil group of companies " (Express Consent). Where an Eligible Entrant provides Express Consent, the Promoter will use the information provided by the Eligible Entrant on the Entry Form to send the Eligible Entrant further communications in relation to special offers, exclusive competitions, news and event information in relation to the Promoter's product range (CCA Marketing Communications). Eligible Entrants who do not provide Express Consent will not receive CCA Marketing Communications. Eligible Entrants may unsubscribe from the CCA Marketing Communications at anytime. For the avoidance of doubt, an Eligible Entrant does not have to provide Express Consent in order to enter the Promotion.


The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of the prizes.


In the event that the Major Prize winner’s nominated companion is under the age of 18, the parent or legal guardian the nominated companion: (a)must read and consent to these Terms on behalf of the nominated companion; and (b)must ensure that the nominated companion complies with these Terms. In the event that the nominated travel companion of the Major Prize winner (or his/her parent/guardian, if under the age of 18) does not agree to these Terms, they will not be able to be the travel companion for the Major Prize.


The Promoter, the Promoter's related entities, the participating outlets, and all agencies associated with the Promotion; and the employees, agents, directors and contractors, of all entities referred to in paragraph 54(a), shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of, or participation in, prizes, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).


Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.


Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use/redemption of the prize or participation in the prize.


Entry and continued participation in the Promotion is dependent on Eligible Entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.


This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an Eligible Entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury, which is suffered or sustained by an Eligible Entrant, as a result of participating in the Promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
