The one Weekly Prize Winner in each of the eight (8) Weekly Prizes Rounds will be judged in accordance with the dates set out in the Competition Schedule in Condition 2. The one Major Prize Winner in each of the four (4) Major Prize Rounds will be judged in accordance with the dates set out in the Competition Schedule in Condition 2. 1.9 The names and entry of the winner/winners will appear on http://wwos.ninemsn.com.au/cricket/theclubroom between 25th November, 2012 and 31st January, 2013. 2. Competition Schedule 2.1 The competition has ten (8) separate Weekly Prize Rounds and four (4) Major Prize Rounds. The entry and judging dates for each of the eight (8) Weekly Prize Rounds and four (4) Major Prize Rounds are set out in the Competition Schedule below. All times in the Competition Schedule are Sydney time. 2.2 All unsuccessful entries in any Weekly Prize Round (being entries submitted within the dates for a Weekly Prize Round specified in the Competition Schedule) that do not win the Weekly Prize for that Weekly Prize Round will not be carried over for consideration in subsequent Weekly Prize Rounds. 2.3 All unsuccessful entries for any Major Prize Round (being entries submitted within the dates for a Major Prize Round) that do not win the Major Winner prize for that Major Prize Round will not be carried over for consideration in subsequent Major Prize Rounds. 2.4 Each entry will be eligible to win both the Weekly Prize for the Weekly Prize Round in which that entry is submitted, as well as the Major Prize for the Major Prize Round in which that entry is submitted.2.5 Competition Schedule 2.6 There are four Major Prizes and eight Minor Prizes (i.e. eight Weekly Prizes). Unless expressly stated all other costs and expenses associated with taking the Major Prize become the responsibility of the Major Prize Winner. Any applicable taxes/surcharges/fees relating to flights are included as part of the prize. 2.8 If on the judging date in Condition1.8 the winner is under the age of 16 years, that winner‟s prize must be awarded on their behalf to that winner‟s parent or legal guardian on behalf of the relevant winner. 2.9 The judges' decision is final and no correspondence will be entered into. 2.10 All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The prize is not transferable, exchangeable or redeemable for cash. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner. 3. Who may enter The only persons who may enter and be awarded prizes are residents of the place specified in Condition 1.1, who have attained the age specified in Condition 1.2 (if an age is specified in that condition), who are not (i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition, or (ii) members of the immediate family of such employees and contractors. At the time of entering the competition, if entrants are under 18 years of age they must obtain their parent‟s or legal guardian‟s consent to enter. Entrants bound by conditions By participating, entrants agree to be bound by these conditions. 5. How to enter 5.1 To enter, entrants must (a) Read and accept these terms and conditions; (b) Log onto http://wwos.ninemsn.com.au/cricket/theclubroom, follow the prompts to the registration page and register their details (full name, address, daytime telephone number and email address, among other things); and (c) Tell us in 50 words or less, “how do you express the passion you have for your cricket?” and upload a supporting photowhich demonstrates your love of the game. * *Please note the entry (including photo) must comply with these Terms and Conditions (including without limitation conditions 7 and 8) 5.2 Each entrant acknowledges and agrees that their entry will be published along with his or her first name and State/Territory on http://wwos.ninemsn.com.au/cricket/theclubroom. Your entry may be moderated and disqualified if in the Promoter‟s opinion the entry: (a) is or contains an element that is objectionable, offensive or inappropriate for publication (including but not limited to content containing profanity, nudity or potentially insulting, scandalous, inflammatory or defamatory images, language or other material); (b) contains material that may infringe a third party‟s rights; or (c) is otherwise non-compliant with these Terms and Conditions. Moderation of the publication of entries is in the Promoter‟s sole discretion. An entry will be disqualified if the Promoter considers that the entry is not in accordance with these Terms and Conditions. No correspondence will be entered into. 6. Selection of winner6.1 At the time and date specified in the Competition Schedule 2.2, the judges will choose a winner. The winner will be the entrant who has been judged to have entered the most creative, humorous and original response to the question asked in Condition 5.1(c). 6.2 Each entry will be individually judged based on literary and creative merit. Chance plays no part in determining the winner/s. 6.3 The Promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. 6.4 Incomplete or indecipherable entries will be deemed invalid. 7. Special conditions of entry 7.1 All entries must be: (a) the original independent creation of the entrant; (b) owned by the entrant; and (c) free of any claims, including copyright or trademark claims by other parties (including, without limitation, Cricket Australia). 7.2 Entries must not: (a) have been published previously; (b) have won prizes or awards in other competitions; (c) be restricted in any way; or (d) infringe any third party rights (including, without limitation, any rights of Cricket Australia). 7.3 It is a condition of the awarding of each prize that the winner must, if requested to do so by the Promoter, sign and return any Affirmation of Eligibility to Enter, Ownership of Entry, and Release and Compliance statements provided to the winner by the Promoter. The failure to return the signed statements will result in the entitlement to the prize being forfeited and the selection of another winner. 7.4 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant‟s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 8. Limitations on entry 8.1 There is no limit to the number of entries per person, subject to the following: (a) each entry must be substantially unique;(b) each entry must be submitted separately and in accordance with the entry requirements; (c) each entry (including the photo and word answer) must be created by the entrant submitting it; (d) each entry (including the photo and word answer) must not infringe a third party‟s intellectual property rights (including, without limitation, Cricket Australia‟s intellectual property rights); (e) the content in each entry (including any photos submitted in the entry) must be created by the entrant and if they feature a person other than the entrant, the person(s) featured in the photo must have consented to their image being used in connection with this competition; and (f) each entry must be submitted separately and in accordance with entry requirements and these Terms & Conditions. 9. Duration This competition starts at the Sydney time and date specified in Conditions 1.3 and 1.4. Entries must be received by the Sydney time and date specified in Conditions 1.5 and 1.6 (and the Competition Schedule in Condition 2). 10.Conditions of travel and prize acceptance 10.1 Each Major Prize Winner is free to select any person above the age of 18 as their guest. 10.2 If a Major Prize winner is under the age of 18, they must be accompanied by a parent or legal guardian who is above the age of 18. The respective parent/guardian will be liable for their own costs for accompanying the winner if those costs are not included in the prize. If the Major Prize winner selects a travel companion under the age of 18 the winner must be that person‟s parent or legal guardian, or have written consent from that person‟s parent or legal guardian for that minor travel companion to use the prize. 10.3 No compensation will be payable if the winner or their guest is unable to use the prize as stated for whatever reason, including denial of entry into Australia, United Kingdom or any other country. Any part of the prize which is not taken for any reason is forfeited. 10.4 The travel suppliers, including the airline, will be chosen by the Promoter. The itinerary of the travel in each Major Prize is to be determined by the Promoter with Granted Worldwide in agreement with the relevant winner; however, in the event that agreement with the relevant winner cannot be reached, the Promoter reserves the right to determine the itinerary. 10.5 Major Prize is valid for travel up to 12 months from relevant judging date on which the winner won that Major Prize. All travel must be booked within 2 months of date of notification of winning the prize. Travel must be booked a minimum 60 days in advance of the start of the travel. Not valid for travel over Australian School Holidays, Australian Public Holidays or other peak travel periods. Subject to availability at time of booking. 10.6 Not all elements of Lord‟s Tour may be available on the day of use by the winner. Exact time of tour may be changed at short notice (for reasons beyond the control of the Promoter). In the instance of the Lord‟s Tour in which the winner and their guest are booked being cancelled at short notice due to unforeseen circumstances or events, an alternative date to take the Lord‟s Tour may be available. However if the alternative tour date does not fall within winner‟s travel itinerary dates, then no alternative tour will be provided and the winner forfeits this element of the prize. 10.7 The Promoter accepts no responsibility for variations in the prize value. The components of the prize may alter for reasons beyond the Promoter‟s control. 10.8 The components of the Major Prize must be taken together as a single trip for two people to be booked by the Promoter and cannot be separated into different holiday vacations. 10.9 Any part of the prize that is not taken for any reason is forfeited. 10.10 Travel and accommodation are for the winner and their guest travelling together. As such, the winner and their guest must depart from the same capital city at the same time. 10.11 The prize cannot be exchanged for other travel or accommodation at other destinations. 10.12 Frequent flyer points will not form part of the prize. 10.13 The prize is subject to the standard terms and conditions of the respective products and services which constitute the prize. 10.14 The winner may be required to present a credit card at the time of accommodation check-in. 10.15 Once the booking is confirmed, changes to the booking may incur a fee, including GST plus supplier charges. 10.16 The winner and their guest may be required to sign a liability waiver form to receive the prize. Failure to sign the liability waiver form may result in the winner forfeiting the prize. 10.17 It is a condition of accepting the prize that the winner and their guest comply with all the conditions of use of the prize and prize supplier requirements.10.18 The Major Prize Winner and their travel partner must have a valid passport that is valid for the period during which they intend to take the Major Prize and up to 6 months after their intended return to Australia. 10.19 It is the Major Prize Winner‟s and their travel partner‟s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports, visas, and health requirements, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Major Prize Winner and their travel partner. 10.20 It is a condition of accepting the Major Prize that the Major Prize Winner must have a valid Australian bank account and the spending money component of the prize will be deposited directly into the Major Prize Winners‟ nominated bank account via EFT. Under no circumstances will the spending money be provided as cash to the Major Prize Winner. 10.21 Flight schedules and accommodation arrangements are subject to change without notice. 10.22 The Promoter makes no representation as to the safety conditions or any other conditions that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade. 10.23 As a condition of accepting thee prize the winner (and any companion) must sign any legal documentation as and in the form required by the Promoter, Granted Worldwide or organisers. 11.No quality, etc, representations/exclusion of liability 11.1 The Promoter: (a) makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes; (b) accepts no responsibility for loss or damage to prizes in transit; (c) accepts no responsibility for late, lost or misdirected registrations; and; (d) is not liable, to the extent permitted by law, for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner and, where applicable, to any family/persons accompanying the winner. 11.2 If the prize involves entry to an event and/or transport and accommodation, the winner and his or her guest must sign and return any liability release provided by the Promoter and/or its contractors as a condition of the prize being awarded. 11.3 If the winner or any guest is under 18 years old, the underage persons must be accompanied by a parent or guardian who signs any liability indemnity provided by the Promoter as a condition of the prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner. 11.4 Condition 11 does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again. 12.Winner notification and publication Each winner will be notified by telephone and/or email, using the details provided in their entry, and each winner‟s name, State/Territory and entry (including the photo and word answer) will be published as specified in Condition 1.9. 13.Use of Headings 13.1 Headings and subheadings are inserted for convenience only and shall not be used to interpret the text of these conditions in any way adverse to an interpretation in favour of the Promoter. 14.Ownership of entries 14.1 All entries become and remain the property of the Promoter. 14.2 In addition to publishing all entries in accordance with Condition 5.2, the Promoter reserves the right to use (including licensing to third parties) the content of any entries for the purpose of promoting this competition and future promotions in any media worldwide. 15.Internet 15.1 If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition. 15.2 The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. 15.3 The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition. 15.4 CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. 16.LIABILITY, INDEMNITY AND RELEASE 16.1 In consideration for the Promoter accepting the Entrant‟s entry, the Entrant releases and forever discharges the Promoter from all claims that the Entrant may have or may have had but for this release arising from or in connection with any entrant‟s participation in this promotion; the Winner‟s acceptance and use of the Prize, and the Winner‟s guest‟s acceptance and use of the Prize. 16.2 The entrant indemnifies and holds harmless the Promoter to the extent permitted by law in respect of any claim by any person (including but not limited to other entrants in the promotion), arising as a result of or in connection with the entrant‟s participation in the promotion. 16.3 In this Condition 16, “all claims” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising. 17.Promoter The Promoter is ninemsn Pty Ltd, ABN 33 077 753 461, Level 7 Tower Building, Australia Square, 264 George Street, Sydney NSW 2000. 18.Entire conditions These conditions constitute the entire agreement of the parties relating to the entry and the conduct of the competition. |
