TERMS AND CONDITIONS
Information on how to enter and the prize form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via Internet only.
Entry is open to residents of Australia aged 18 years or older who either: i) hold an existing subscription to Travelzoo at the start of the Promotional Period; or ii) who sign up to receive a subscription to Travelzoo during the Promotional Period (“Eligible Entrants”). The directors, management and employees (and their immediate families) of the Promoter and Escape Travel and each of their related bodies corporate are not eligible to enter the promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 6:00am (Sydney time) on 2 December 2012 and closes at 11:59pm (Sydney time) on 20 January 2013 (“Promotional Period”).
To enter the promotion, Eligible Entrants must complete the following steps during the Promotional Period:
a) log on to the Promoter’s website at http://www.travelzoo.com/au/win;
b) follow the prompts to the promotional entry page;
c) input the requested details (including their full name, a valid email address, postcode and country of residence);
d) subscribe to Travelzoo (if they do not already hold a subscription);
e) invite at least two (2) friends and/or relatives to subscribe to Travelzoo by providing their email addresses; and
f) click the submit button so it is received by 11:59pm (Sydney time) on 20 January 2013.
Eligible Entrants will automatically be awarded one (1) entry into the promotion for the first two (2) valid email addresses submitted and one (1) entry thereafter for every additional valid email address submitted. Eligible Entrants must remain subscribed to Travelzoo for the duration of the Promotional Period to be eligible to claim any prize.

The operation of the referral mechanic is subject to the Spam Act 2003. An Eligible Entrant may refer a particular friend or relative only once during the Promotional Period. Each Eligible Entrant’s relative or friend nominated must be an Australian resident and be aged 18 years or older. Each Eligible Entrant warrants that any and each friend or relative that they nominate is known to them personally and that they have permission to send email communications to such persons.

The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
Multiple entries are permitted but each entry must separately and independently comply with these Conditions of Entry.
Eligible Entrants can enter only in their own name. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. The Promoter reserves the right to request the Eligible Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Eligible Entrant’s identity, age, residential address, eligibility to enter and claim a prize. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draw will take place at 11:00am (Sydney time) on 22 January 2013 at Greeneagle Distribution and Fulfillment, Unit 10, 20-28 Ricketty Street, Mascot NSW 2020. The winner will be notified in writing within two (2) business days of the draw and their name and locality will be published in The Australian on 31 January 2013. All reasonable steps to notify the winner of the results of the draw will be taken by the Promoter.
Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn from all entries received will win a holiday package to Bali, Indonesia for themselves and one (1) travel companion (aged 18 years or older), valued at up to AU$6,764 depending on the date and point of departure (“Holiday Prize”). The prize includes:
• return economy airfares for two (2) adults from the winner’s nearest capital city to Bali, Indonesia flying Singapore Airlines;
• return private airport transfers to the Alila Villas Soori hotel for two (2) adults;
• seven (7) nights twin-share accommodation at the 5-star Alila Villas Soori hotel in a Private Beach Pool Villa;
• hotel breakfast daily for two (2) adults (exact menu to be determined by the Promoter in its absolute discretion);
• hotel butler service for the duration of their stay at the hotel;
• Alila Villas signature welcome drink, face spritzer and cold towel on arrival for two (2) adults;
• Alila “Welcome Pack” including a personalised luggage tag, a custom-designed ‘his and her’ hat and a Balinese sarong for two (2) adults;
• Spa Alila Package 90 minute spa treatment for two (2) adults;
• US$200 (approximately AU$192) resort credit that can be used in the resort’s Restaurant or Spa Alila facilities;
• daily yoga sessions for two (2) adults;
• Alila Hospitalities including WI-FI access, Alila Amenities and 24 Hour Gym;
• a Tanah Lot Sunset and Cocktail tour for two (2) adults (exact menu to be determined by the Promoter in its absolute discretion);
• an Ubud Artistry Tour for two (2) adults; and
• a Jimbaran Sunset Lobster Dinner for two (2) adults (exact menu to be determined by the Promoter in its absolute discretion); and
• AU$250 spending money to cover any additional travel costs (e.g. Bali airport arrival and departure taxes), awarded in the form of a Cash Passport Card.
Prize is valid for travel from 22 January 2013 until 10 December 2013. The Holiday Prize must be booked and the trip commenced prior to 10 December 2013.
The winner and their travel companion are responsible for their own transport to the international airport closest to the residential address of the winner. All other costs not disclosed in these Conditions of Entry including, but not limited to, additional meals/beverages, laundry services, additional in-room charges, additional spending money, transport to and from airport departure point, taxes (excluding airline and airport taxes), insurance, travel insurance, passports, visas and all other ancillary costs not expressly provided but incurred in acceptance and use of the Holiday Prize are the responsibility of the winner and their travel companions. The Holiday Prize cannot be used in conjunction with any other discounts or special offers.
The winner and his/her companion must depart from and return to the same departure point and travel together.
Any ancillary costs associated with redeeming the Cash Passport Card are not included. Any unused balance of the Cash Passport Card will not be awarded as cash. Redemption of the Cash Passport Card is subject to any terms and conditions of the issuer including those specified on the Cash Passport Card.
The Holiday Prize is not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in Holiday Prize value. All prize values are the recommended retail price including GST.
The prize-winner must book all aspects of their prize through the prize partner, Escape Travel. A winner’s letter will be issued with booking instructions and an Escape Travel consultant will assist the winner to book the prize.
It is the sole responsibility of winner and nominated travel companion to ensure they have the necessary travel documents, passports (with no less than six (6) months before expiry) and any necessary visas required by the date specified by the Promoter, or as and when requested by the nominated travel agent. Failure to do so could result in travel dates being missed and/or prize being forfeited.
Compliance with any health or other government requirements is the responsibility of the prize-winner and, if applicable, their travel companion(s). It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter and Escape Travel make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

If the prize (or any part of the prize), in the opinion of the Promoter and/or Escape Travel, cannot be provided for any reason, then the Promoter and/or Escape Travel reserves the right to provide an alternative travel prize (or part of the prize) (including to an alternative destination) to the same or greater value as that part of the prize being replaced, subject to any written directions of a regulatory authority.
The prize is not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person. There can be no changes made to travel arrangements once tickets are issued.
The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. If for any reason the winner does not take the prize (or an element of the prize), then the prize will be forfeited. Subject to the unclaimed prize draw clause, the Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these competition Conditions of Entry or forfeiting or not claiming a prize.
The Promoter may conduct a further draw at the same time and place as the original draw on 22 April 2013 in order to distribute the prize if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. The winner in any unclaimed prize draw will be notified by telephone and in writing within two (2) business days of the draw and their name and locality will be published in The Australian on 29 April 2013.
Entry details remain the property of the Promoter. The name, likeness, image and/or voice (including photograph, film and/or recording the same) of the prize-winner may be used in any media for an unlimited period without remuneration for promotional purposes (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and Escape Travel, unless the prize-winner otherwise notifies the Promoter at the time of accepting the prize. The winner and their travel companion consent to the Promoter and Escape Travel using personal information provided in connection with this promotion and awarding the prize. Without limiting the foregoing, personal information provided in connection with this promotion will be handled in accordance with the Privacy Statement available at http://www.escapetravel.com.au/company/policies/privacy-policy.
Companion Identification: The Promoter reserves the right to request the winner’s travel companion produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to, amongst other things, make necessary travel and associated bookings and applications.
Legal Release: It is a condition of accepting a prize that the winner and their travel companion must sign any legal release in a form determined by the Promoter and/or prize suppliers in their absolute discretion.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Time of Entry: Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Force Majeure: In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any written directions made under applicable State or Territory legislation, the Promoter reserves the right to either provide an alternative holiday prize (including an alternative destination at an alternative date as specified by the Promoter) to equal or greater value as the original prize or to cancel, terminate, modify or suspend the promotion.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any attempt to cause malicious damage or interference with the normal functioning of the Promoter’s website or the information on the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Eligible Entrant, the Eligible Entrant agrees to indemnify the Promoter for those losses, damages and costs.
Copyright and privacy generally: An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about an Eligible Entrant to include the Eligible Entrant in the promotion and, where appropriate, award the prize. If the personal information requested is not provided, the individual cannot participate in the promotion and is deemed ineligible.
An Eligible Entrant also agrees that the Promoter may, in the event the Eligible Entrant is the winner, publish or cause to be published the winner’s name and locality in any media, as required under the relevant State or Territory legislation. An Eligible Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter’s Privacy Officer. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
By participating in the promotion, an Eligible Entrant also acknowledges that a further primary purpose for collection of the Eligible Entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Eligible Entrant in the future with information on special offers or to provide the Eligible Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to an Eligible Entrant’s or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use and/or taking of the prize.
If for any reason the promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize of equal or greater value as an original prize, subject to any written directions made under applicable State or Territory legislation.
