By entering the Name Our Penguins & Win an iPad Competition, you are agreeing to the following terms and conditions:
1.STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. ELIGIBILITY TO ENTER
2.1 Subject to clause 2.2, entry is open to all residents of Australia and, if request, must be able to show proof of residency e.g. Drivers Licence.
2.2 Employees of Moving ON Audits and their immediate families are not eligible to enter. Immediate families means any of the following: spouse, ex-spouse, de facto spouse, child or step-child [whether by natural or by adoption], parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. HOW TO ENTER AND WIN
3.1 The competition commences on Wednesday, 19th September 2012 at 00:01 (AEST) and concludes on Thursday, 17th January 2013 at 23:59 [the competition period].
3.2. In order to enter the competition, entrants must go to http://www.facebook.com/movingonaudits and/or www.twitter.com/movingonaudits and like the Moving ON Audits Facebook page and/ or Follow Moving ON Audits on Twitter. To enter you must then post the two names you suggest that the Moving ON Audits ‘Better Together’ penguins are bestowed. The best name suggestion combination, as decided by the Moving ON Audits team, will win the competition.
3.3 There is no limit to the number of name suggestion combinations and therefore entries per person.
3.4 Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 years before entering the competition.
3.5 The prize winner will be notified by email within seven business days of Thursday, 17th January 2013.
3.6 The winner will be announced publicly on both http://www.facebook.com/movingonaudits and www.twitter.com/movingonaudits.
3.7 The Promoters (Moving ON Audits) decision is final and the Promoter will not enter into correspondence regarding the result.
4. THE PRIZE
One (1) prize winner will receive:
One (1) Apple iPad 16GB (2nd Generation – Wi-Fi) valued at $400 each including postage.
4.1 If for any reason the winner does not take the prize or any element of the prize at the time stipulated by the promoter, then the prize or any element of the prize will not be redeemable for cash. No part of this prize can be used in conjunction with any other offer.
4.2 If the winner is under 18 years of age the prize will be awarded to a parent or guardian.
4.3. The prize is not transferrable, exchangeable or redeemable for cash. In the event that any prize item is unavailable; the promoter reserves the right to substitute a prize of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winners.
4.4 The prize is as stated above, any additional costs including internet connection are the responsibility of the winner.
4.5. In participating in the prize, the winner agrees to participate and cooperate as required in all editorial and promotional activities relating to the competition, including but not limited to being interviewed and photographed. The winners grant the promoters a perpetual and non-exclusive licence to use such footage, media and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
5. NO LIABILITY
5.1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, acts of terrorism and online sabotage, the promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.
5.2. Moving ON Audits and their associated companies will take no responsibility for prizes damaged or lost in transit, or late, lost or directed mail.
5.3 Moving ON Audits and their associated companies will not be liable for any misadventure, accident, injury, loss [including but not limited to consequential loss] or claim that may occur:
5.3.1 During the draw.
5.3.2 Whilst undertaking any travel won or connected with their entry into the draw; or
5.3.3 In the participation in any prize;
5.3.4 As a consequence of late, lost or misdirected mail.
5.3.5 To circumstances outside the promoter’s reasonable control
